I paid for overnight parking with ability to come and go as desired. I was first blocked in around 6 pm Friday and when I returned around 9 pm the same night and I pointed out I prepaid $90 I was countered with well I'm getting $80 for a couple of hours. There are ROWS of cars blocked for his $80 a couple of hours while the rest of us were told we could come and go without penalty.

I have parked in the same lot behind my residence for almost two years paying monthly. I was off of work and did not move my car because I didn't need to, and had paid monthly. Apparently the ownership changed during my time off of work, but no signage changed and there was no note/ticket or any indication of this change. At 9:26 a.m. on January 4th I received a text message from a friend who also had been paying monthly for the lot saying that the lot had apparently changed ownership and was towing cars. By 9:51 when I went down to pay or move my car, it had already been towed. The owner of the lot was unreachable and refused to rectify the situation by even calling the tow company.

      Business response

      01/09/2023

      Good afternoon,

We assumed management control of the lot on January 1, 2023.  The previous company (Air ********* believe) is responsible for explaining the change in management prior to the 1st of the month, as payments were initiated through them to gain access to monthly parking.  We did not collect any money from you for monthly parking, nor were we aware there were ANY people that had access to monthly parking at this location; ************************************************ 48226.  The previous management company has no obligation to inform ** of their previous business services for this location, although it would be helpful, they are not legally expected to.  If you paid for the month of  January to them, I suggest you contact that company to obtain a refund or whatever you can work out with them.  We are not affiliated with that company in any way - we are completely separate entity.

      Respectfully,

      Customer response

      01/09/2023

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint, as there is no proposed resolution in their response. For your reference, details of why I am rejecting this response appear below:

I sincerely hope to settle this matter without litigation but have been unable to speak to anyone who acknowledges being an employee of Metro Valet with authority to resolve this issue, other than through this message forum.

Firstly, the statement that the business was not "aware there were ANY people that had access to monthly parking at this location; *******************************************" is categorically incorrect. The attendants of the lot and other monthly parkers plainly told me that those working in the lot informed other monthly tenants of the change in management. However, they did not inform me simply because they did not cross paths with me during their limited business hours. When I asked the attendants why they did not inform me, they had absolutely no explanation. They said their policy if someone parks and has not paid is to wait until they come back to obtain payment, rather than to tow cars as their first response. However, for some unknown reasons, they refused to apply such policy to me. Further, there was no attendant in the lot, signage about new ownership, etc. when I left and went to the grocery store and returned around 6 pm on January 3rd.

Also, there is no actual proof that Air Garage is actually not still the owner of the lot and this Metro Valet is pulling an elaborate scam. On December 12th, *************************************************************** the lot, and on January 7th, 2023, I received an email from Air Garage that my rental is ending in 3 days, on January 10th. Those emails are attached to this response.

Their contention that The previous company (Air ********* believe) is responsible for explaining the change in management prior to the 1st of the month is simply incorrect. Assuming Metro Valet does in fact own the lot located at *************, it is entirely their responsibility to communicate with the previous owner and/or entrants on to their property regarding pre-existing agreements. A tenant with no notice, information, or reason to believe that they are now being accused of illegally parking in an area in which they have paid to be cannot reasonably be expected to somehow know through clairvoyance that new owners have taken over said property.

For illustrative purposes: if one bought a building in which someone rented a unit, it would be illegal to simply take possession of the building an evict those renting space without any notice of this change in possession. Essentially, this is what Metro Valet has done and is claiming to be perfectly legal and ethical.

As a final note, I find it deeply troubling that Metro Valet is lying to the public in their reply to my ****** review. In their reply to my review, they are claiming that they do not even own the lot. Also, I have called numerous times on the line publicly available as a point of contact, without any reply.

In sum, Metro Valet wrongfully towed my car, and should either reimburse me in whole or in part for such expense. I would be happy to discuss with a representative of Metro Valet to avoid having to go through the tedious court process. However, if I do not receive a response, I will have no choice but to pursue legal recourse.

      Regards,

      *************************
