The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On February 3, 2025, the business entered into an Assurance of Voluntary Compliance (AVC) with the Michigan Attorney General’s Corporate Oversight Division. The Assurance settles allegations that the business violated the Michigan Consumer Protection Act (MCPA) and Unsolicited Merchandise Act.
The AVC alleges Baker’s Best Health sent postcards advertising a gift and a risk-free trial of a health product. The AVC alleges the postcard failed to disclose the full terms of the offer. After responding to the offer, the consumer received the gift along with a trial supply of the product, and a billing invoice. The invoice revealed previously undisclosed terms, including hidden charges and automatic enrollment in Baker’s “Smart Ship Service”, which authorized automatic billing for future shipments, potential additional fees, and that consumer’s personal information may be shared with other businesses.
Under the Assurance, the business agreed to:
• Cancel all balances on “past due” or “overdue” consumer accounts nationwide, except for consumers who ordered and accepted products through informed consent or have accepted and paid for 2 or more consecutive Smart Ship products in the 12 months prior to February 3, 2025 (the date of this Assurance).
• Immediately mark as “returned” any product shipped to a consumer who contacts the business with a complaint that they did not order the product and provide a return shipping label upon the consumer’s request.
• Cease any reference to its “Legal Department” and “Bad Credit Division”, neither of which does the company currently have.
• Ensure, as a condition of doing business, that any mailing list providers guarantee its lists exclude consumers whose names appear on “do not contact” lists.The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
