I run an **** ****** **** ** *******. On 07/08/2021 I ordered an engine from Cooks Auto Parts through ****. It states on the order that it is: Fully Remanufactured. I am attaching documentation from two Engine dealers that shows Fully Remanufactured means the engine has been built back to factory specifications. This is completely different from Used or even Rebuilt. The Customer that the engine was purchased for had a family emergency and did not get the vehicle into the shop for installation until November. The engine install was completed 11/16/2021 and the vehicle was test driven and seemed fine. The customer came to pick the truck up a few days later as he lives out of town and while he had it sitting outside idling the check engine light came on. We scanned it and it had a code: misfire on cylinder #4. This vehicle never left the shop with the customer. We kept the vehicle for diagnostics. Upon inspection we found that the engine failed both wet & dry compression tests, the cylinder walls are scored and upon removing the oil pan we found metal debris in the oil. The installation and diagnostics were performed by a professional automotive technician. This is not a remanufactured engine. it is a used engine that they falsely sold to us as remanufactured. The truck is still at our shop and the customer who paid $3500.00 for a remanufactured engine still does not have a working engine. We paid $3257.99 with shipping. The actual engine cost was $2998.00. I contacted cooks multiple times and they have refused to settle this by replacing it stating it's outside the warranty period. This is not a warranty issue. They did not sell us what was advertised or what we paid for.Business response

The buyer installed the engine after the warranty period ended. Therefore, he was not able to do a return through ****. All items we sell come with a 90 day warranty as clearly shown on the **** listings. Regardless, I have discussed this with the owner and he has agreed to refund you as long as we can get the engine back. Please contact us so the engine can be returned. Thanks!Customer response

(The consumer indicated he/she DID NOT accept the response from the business.)
I accept this only if they pay for the return shipping as our company has already paid the shipping one time. The shipping charge we paid was $259.99. I want a refund and the engine returned, but I am unwilling to pay an additional shipping charge. The seller keeps mentioning the warranty, but this is clearly not a warranty issue. It is an issue of them falsely advertising an engine as "Professionally Remanufactured (which again means built back to factory specs)", charging us Remanufactured price for an engine that was not remanufactured to begin with. So yes, we are more than happy to send the engine back after they arrange and pay for the freight.
