Refund and Exchange Policy

Return Policy

Before shipping your return or exchange, please call 1-888-376-9954 toget a Return Merchandise Authorization Number. All merchandise returnedwithout a Return Merchandise Authorization Number (RMA) will be refusedat the time of delivery.

Returns

Allreturns must be made within 30 days after purchase date, in originalsealed packaging and are subject to a 15% restocking fee plus the cost ofreturn shipping. Shipping and handling fees are non-refundable. Allreturned merchandise must have a valid Return Merchandise AuthorizationNumber (See Return Policy for RMA procedures). Please note: our MetallicPearl Effect epoxy products are custom made, are non-returnable and youmust allow up to 7 business days for the custom product to bemanufactured. (NOTE: Please check all epoxy colors prior to applying the product. We are not responsible for variation in color.)

Please allow 7-10 business days for your package to be delivered, before checking on status of returned merchandise.

Exchanges

Allexchanges must be made within 30 days after purchase date, in originalsealed packaging. All additional shipping fees are payable by thecustomer. All exchanged merchandise must include a valid ReturnMerchandise Authorization Number (See above for RMA procedures).

Please allow 10-14 business days to receive new merchandise.

Damaged Product

Allcustomers who receive damaged merchandise must notify EpoxyMasterwithin 10 days of receipt. A Return Service Tag will be issued and uponnotification or delivery from FedEx the replacement merchandise will bere-shipped, using the same service as originally shipped. The customermay upgrade the shipping service at an additional charge. Formerchandise that is damaged without notification from FedEx, productsmay be re-purchased and shipped, for urgency by the customer. Uponnotification from FedEx a credit will be issued for the damagedmerchandise.

The re-shipping of merchandise may take up to 10-14 business days, including shipping time.

Shipping Terms

Allshipments of EpoxyMaster's products shall be made FOB at EpoxyMaster’splant and liability for loss or damage in transit, theft or loss afterdelivery or anything after the product leaves EpoxyMaster’s plant, shallpass to purchaser upon EpoxyMaster’s delivery of the products to acommon carrier for shipment. Purchaser shall bear all costs oftransportation and insurance and will promptly reimburse EpoxyMaster ifEpoxyMaster prepays or otherwise pays for such expenses. EpoxyMastershall not be in default by reason of any failure in its performanceunder this agreement if such failure results from, whether directly orindirectly, fire, explosion, strike, freight embargo, Act of God or ofthe public enemy, war, civil disturbance, act of any government, de jureor de facto, or agency or official thereof, material or labor shortage,transportation contingencies, unusually severe weather, default of anyother manufacturer or a supplier or subcontractor, quarantine,restriction, epidemic, or catastrophe, lack of timely instructions oressential information from purchaser, purchaser’s failure to followinstructions or otherwise arisen out of causes beyond the control of theEpoxyMaster. Nor shall EpoxyMaster at any time be liable for anyincidental, special or consequential damages.

Applicable Law & Jurisdiction

ThisAgreement shall be governed by and construed in accordance with thedomestic laws of the State of Michigan without giving effect to anychoice or conflict of law provision or rule (whether of the State ofMichigan or any other jurisdiction) that would cause the application tothis Agreement of the laws of any jurisdiction other than the State ofMichigan. Each party irrevocable and unconditionally agrees that any andall claims or disputes arising out of or in connection with any aspectof this agreement shall be exclusively subject to binding arbitration.Such arbitration shall be conducted in Oakland County, Michigan, andshall proceed under the national rules for the resolution of commercialdisputes of the American Arbitration Association ("AAA"). Purchaser mustpay the initial filing fee to AAA for filing a written Demand forArbitration with AAA. The arbitrator's fees and any administrative feescharged by AAA will be initially paid equally by each party subject toreallocation in accordance with the final arbitration award. Thearbitration shall provide each party with all substantive rights andremedies including any applicable damages provided under any pertinentstatute(s) related to such claims, the right to representation bycounsel, a neutral arbitrator, a reasonable opportunity for discovery, afair arbitral hearing, a written arbitral award containing findings offacts and conclusions of law, and any other provision required by law,shall be available in the AAA forum. Any decision of the Arbitratorshall be final and binding as to both parties, and enforceable by anycourt of competent jurisdiction.
