On January 19,2022, the business received an Administrative Penalty Order from the Minnesota Pollution Control Agency (MPCA). The Order settles allegations that the business constructed and installed a 200,000 gallon ethanol storage tank in November 2021 without required MPCA review and approval, as required and that aqueous ammonia transfer area for the tank, was not properly designed to contain any possible spills. Under terms of the Order, the business is required to submit a permit modification application (which was completed) and not use the tank until MPCA approval is received and redesign the transfer area.
