Our roof was replaced at the end of June beginning /of July. After it rained, our roof leaked so bad that it came in through the ceiling, wall and onto the carpet in our bedroom closet and into the ceiling below our bedroom causing our family room ceiling to start peeling and falling off. The company came out once to "fix it" but once it rained again, we found not only our roof was leaking in the same spot again, but also in our garage. The first time that it rained, we looked up into the attic area with the representative from the company and to our surprise and his we saw daylight through a hole in the roofing! We also had damage to our gutter guards and facia (a whole piece of it is missing on our upper peak of our house. We had young boys on the roof (***** years old) from this company, possibly working with their families (as stated by a company representative.) The representative that came out 11/10/23 after 4 months of going back and forth referred to the crew as "inexperienced amigos." He stated that "they don't know about the construction of a roof they just put on shingles." In this day and age to use derogatory comments about another person's color, being or heritage is unacceptable. We have tried to get someone to come out and fix the problem. I'm thinking they might have to start all over to figure out where the roofing project went wrong. We have worked with 3 different representatives from this company. Our first representative was responsive... the rest. NOT. A resolution would be to get to the bottom of the roof leaks and fix the outside and inside. I wonder about mold in the walls, carpet or insulation and if there was one leak now two, what will the next rain/snow bring? We do have photo and video evidence, but it is larger than the 5MB limitation.Business response

I have been in contact with these clients and we are working to resolve this issue. I went onsite on Tuesday and looked at the roof myself, went into the attic and also met with the homeowner.
We believe that the issue is almost completely a siding issue/chimney issue, not a roofing issue but they do tie together. I have taken many photos as well as explained this to the homeowner. But, we are in a position to fix and resolve this.
I had two of my carpenters out there today making repairs to the entire area to stop any future water intrusion. The completed the repairs already.Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.Thank you **** for coming out to address the issues with your own eyes. We appreciate your help in finding the problems associated with the roof replacement so that we can now get the inside of our house and garage fixed from the water damage we had. **** was good about getting a crew out to fix the area of the roof that had not had boards replaced as per their contract and also even helped to. fix an area of the roof over the garage that was a design flaw so that we wouldn't have future leaks. We are happy with the work that has been done and want to thank ************************* for stepping in to help.

This complaint might open a can of worms. I live in a large townhome community. We had a storm in 2019. I had professionally installed working gutters. Capital Construction tore off my working gutters and whatever they did/didn't do has caused my gutters to not function correctly and this affects the entire building (6 townhomes). They never came back to do my deck(repair/paint). Prior to this Capital Construction project, I had my windows/trim all replaced with quality products. Capital Construction said that if we proved we had a better product they would put it back the way it was. I did send in proof, however, that was never finished either. This has been going on for 3 years now.Capital Construction guaranteed no subcontracted labor. Yet most workers were sub constructors. Why did we allow this? Why didn't we fire them? This small siding/roof project turned into a replacement of doorbells, light fixtures, some air conditioning units, some gutters, etc.Capital Construction sent around a ***************** (I would hope he was an electrician) to go into everyone's home to install a tamper-proof light switch. I didn't allow this person in my home. I was told that it is illegal to make/force a homeowner to change their switches. Capital Construction was paid over $160,000 for this and there are many switches/boxes left uninstalled.All buildings were supposed to have gutters. Now many don't and the ones that do are not installed properly for the amount of water that goes through them. The gutters all worked perfectly until Capital Construction touched them.We have several units that have interior water damage, water leakage, and mold.There have been multiple meetings with Capital Construction, MBE Board members, and MBE residents. There are many reports on file from experts stating the workmanship from Capital Construction is insufficient/not done correctly/needs to be redone. They claim they haven't heard of these issues. The storm that hit your HOA damaged several components of your property including roofing, siding, gutters, decks, chimney caps, window trim and HVAC units for a total loss of **** million dollars. At the time of the project you were not on the board of directors making decisions for the project based on approved scope. It was never stated to any board member, resident or management company that Capital Construction would not use subcontractors for the work. Now to discuss the items you specifically called out. The gutters you had professionally installed were damaged by the storm and covered by your association's insurance carrier and professionally installed by Capital. Since the project completion this is the first time I have been made aware of your gutters or the gutters on the entire 6 units having issues. Also the deck repairs / paint you are referring to was completed and similar to the gutters, Capital has no record of any work order stating otherwise since the project completed. Your trim around your windows were damaged and replaced by Capital Construction per the carrier scope. You had brought to our attention a few areas that were not to your satisfaction that were corrected by our onsite staffed project manager and sub. No proof was ever provided of previous material used. The light switches and doorbells were added as a retail item your association agreed to for uniformity. The work was performed by a journeyman and two apprentices from a licensed union electrical contractor working for Capital Construction. The lockable switches you're referring to was also an association decision that we were carrying out per a signed contract. All entry into units was facilitated by the board president, not Capital as we work for the association agreed to. The interior damages to some units comes after one of the worst years of ice dams in **. Ice dams that you and your husband, the board president, contracted with Capital Construction to remove for 215k to remove early winter of 2023. Lastly, the experts you're referring to is a report generated by an engineer (singular) to look at the gutters and determine that due to the construction of the buildings and the roof surface the gutters were not large enough to facilitate the water entering into them. A proposal before the project was started was presented to the board at which time they declined and remained with what was existing, the standard K style gutter system. Given everything you have had to say regarding Capitals workmanship on this project in 2020 you being treasurer and husband being board president still contracted with us for all exterior needs including ice dam removal. We appreciate your continued use and trust of Capital.

This is why we are in a lawsuit. We are spending thousands monthly in what is possible a fraud case with Capital Construction involved.
My gutters and windows were not damaged. You even told us when we became board members that the previous board president told you to not listen to us regarding our concerns. I have turned in requests for both the deck that wasn't repaired and the trim around the windows. I also turned in a work order for the cap on the divider wall in which this was done. Apparently you are receiving them, but are selecting which you want.
There is endless documentation by engineers and others stating that the gutters are pitched incorrectly for the amount of water that comes down them.
It appears you rather argue than fix thing that are warranty or finish uncompleted tasks.
If you need more documentation to complete these tasks, please let me know and provide a completion date.

No, there is no lawsuit regarding the workmanship on my home, our homes. Athough many homeowners are unhappy with Capital Construction, I can only speak for myself.Customer response
