      Hail damage happened to **** ************* in *********** ** on 8-9-2020 at which time the property was owned by ***********************. I purchased the property on November 19, 2020. New Concepts' (the *** management company) 7-14-2021 letter to ********************* (owner at the time of the loss)assessing her $14,146.21 for the hail damage. ( I have and **** had (at the time of loss) the State farm home owners policy. ***************** agent filed a claim #****N119L policy 23BMV0245. My State Farm agent confirmed that such a policy covers damage from date of loss not some other date such as date of assessment and should have been routinely processed and paid. My agent recently inquired and found that ****** claim has not been paid. New Concepts' 3-17-2022 statement attempts to **** me for the $14,146.21 assessment which occurred when **** owned the home and was covered by *****************

      I passed this on to our staff to see which of our managers is assigned to this homeowner association.

      The name of the association is the River **************************** in Bloomington.  We are limited to our involvement with this association.  We handle only the financial management, which includes, invoicing their members, paying all invoices for work completed at the property, providing a monthly financial statement and all only under the direction of the associations board of directors.  It appears that the association realized they had an insurance claim, and in between the time of the initial date of this claim and the time the association made this claim, the current homeowner whose insurance policy is responsible for the payment sold their home to the complainant.

      It is not anyones fault, however the only person who can try collecting this amount is the complainant.  They should go back through their closing company and ask for the sellers information and they will have to be responsible for getting that prior homeowner to pay.

       I am rejecting this response because:

      The State Farm home owners insurance that both I and the previous owner both have covers losses from the date of loss not some other date such as when the cost to fix the loss is determined. The loss occurred in August 2020 when the previous owner, *********************** owned the home so her insurance would cover the loss. New Concepts correctly billed her for the loss and then later also billed me for the loss thus fraudulently trying to collect the same amount twice.

      Once again, I will try to explain, we handle only the financial aspects of this homeowner association.  ********* of directors tell us what the monthly assessments are to **** out, and the same if there is a special assessment.  *************** has not received the special assessment billed from either the previous homeowner or the current).  

      Nothing has been done fraudulently.  The bottom line is, there was an insurance claim, all homeowners were charged accordingly.  Everyone else has paid.
