      D2 Paint & is now doing business as MD Remodeling as of 12/2022. Owner of both companies is *******************. I am seeking refund of $540 for staining services which were never even started. I have texts between myself + the owner supporting the facts outlined below: 4/7/22: contract to wash, clean, sand + stain deck for $2,160 was signed + check for 1/4 ($540) was given to + cashed by ****. Before signing, I told him I needed it completed by 1st week in June + he agreed to that date.5/20/22: Having heard nothing from him after 6 weeks, I asked if he cld start the following week. He said it was possible + wld let me know. 6/1/22: After 2 weeks of again hearing nothing, I asked for update + he said he cld start on 6/4 to pressure was + sand + stain on 6/5. 6/5/22: he did not show up on either day nor call so I told him to take me off schedule + refund my money. I started the project myself. He texted- "If thats the route youd like to take then Ill send your deposit back tomorrow". Then, 10 minutes later he texted we didn't have a date in contract. I reminded him of our June date discussion + had even given *** an extra week. He said the job he has been working on kept adding more + more + he had gotten behind but he cld do my project on 6/6. Told him, I wld not risk another no show + wanted refund. He said he wld take off $200 for my pressure washing + cleaning..ridiculous since that is the most difficult part + took me 3 days! I also said: " If your other customer was adding to his original large job, it wld have been my hope that you wld have told them yes, but u wld need to come back. And, still that doesn't explain away not showing up or calling this weekend. A good deck process can't be done in 2 days." 6/28/22: I texted him: ****. I was expecting to receive the down refund check by now. Plz advise. I never heard from him again. I want this down-payment refunded asap. A business that reneges on promises + does NO doesn't get paid.
