I went to Mr. ******* ******* for a nightguard. When it came, he adjusted it. After a few nights I felt pain in my upper left jaw. I made multiple trips back to his office for adjustments, which he failed at adjusting correctly. My patient history shows I had pain and the nightguard was never fitted right. On a recorded phone conversation (which was made very clear to those representing the dentist office the phone conversation was being recorded), it was discussed and agreed upon by both parties to refund my $650, but it has not been done. I also asked for copies of my health records be sent to my home address. It was agreed upon in the same recorded phone conversation that it would occur. It has not.Business response

We have mailed the customer's records and he should be receiving that this week. We informed the customer that we would be happy to issue him a refund the way the payment was made. We would just need the customer to come in to the office so we could issue the refund back on to his card or he can call us and give us the card number over the phone and we can issue the refund that way as well.Customer response

I am rejecting this response because:The "records" I received from this office are ridiculous. I have been going to this dentist office for many years. They sent me 2 pages of 5 x-ray pictures. There was no dates, office visit records or procedures done. I have not received any compensation for the refund as well. I do not feel comfortable going to this office any longer so the refund can be processed through a check.

We sent the x-rays because he needed health records. He didn't specify what he wanted from us. So we need it in writing, in detail, what he wants from us and where he wants it mailed to. He used a Mastercard and however you pay is how you get refunded. We can only refund him through his Mastercard. If he doesn't feel comfortable he can have someone bring his credit card in to the office, however he wants to give it to us, the one ending in ****. We can not refund him by check because that is not how he paid. This is standard policy everywhere.Customer response

I am rejecting this response because:
Because of this company’s refusal to refund the agreed upon amount, I have filed a chargeback claim against the business with my credit card. This chargeback comes with fees for the business. I have given them multiple opportunities to send a check and they have refused, so my credit card company will take the money back with force and fees.I have also written multiple times I want ALL records, x-rays, noted, dates of appointments….everything. This request has been documented in this BBB dispute history as well. I have turned this problem into the Office of Civil Rights for failure to provide HIPPA information upon request. If the office continues to refuse to provide all my records, I will proceed with legal matters as allowed by law.
