      On December 19th a gentleman names **** ******, who works is Midwest Housing Solutions, came to my home to inquire about buying my deceased mothers home. I explained to him that it wasn't possible but he explained a way that it could be possible. He laid out the steps that needed to be done & the time frame they could be done in so I was interested. After doing some research we decided to move forward with MHS. **** ****** brought paperwork to my home for me & my wife to sign, we had it notarized & **** ****** took it to the courthouse to be filed with the recorder of deeds. In these recorded documents, and also multiple emails & text messages, we were told that we would be paid in full by no later than January 3rd, 2022. It is now January 5th and no type of payment has been made. Every day we are told how & where the payment will come from, but when we inquire about it we found out it's a lie. Then when we question **** ****** about it is when the method/form of payment changes. There have also been multiple times he has acted very unprofessional. Bringing up religion for no reason, guilt tripping about how we should buy him a thank you card at the very least to name a few. All we are asking for is what is owed to us. It is all written down on legal paperwork.

      It Is True I Approached **** ********** to buy his Mother's House (She Is DECEASED); On December 23, 2021 We Signed A Contract To Purchase The Property TWO DAYS BEFORE CHRISTMAS.  WE Have Tried To Get Title Work From Four Different Title Companies However EVERY TITLE COMPANY IS SWAMPED And We Are Having Trouble Getting Any Title Report.

      Mr. ********** Told Me The Reason He Did NOT Take This To PROBATE Is Because His Mother And Step-Father Had Numerous MEDICAL, HOSPITAL, & DOCTOR BILLS Outstanding.  Also, His Own Attorney Told Him That He Would Have To Take It To Probate Which Mr. ********** Did NOT Want To Do Because He SAID There Would Probably Be NOTHING LEFT After Probate When All The Medical Bills, Doctor Bills, & Hospital Bills Are PAID.

      Further, I Showed Mr. ********** That We Could Do An Affidavit Of Heirship And Avoid Probate And He Signed A Quit Claim Deed To My Company First Place Properties, LLC (A Missouri Limited Liability Company).  To PROTECT Mr. ************ FINANCIAL INTEREST I Also RECORDED A DEED OF TRUST In The Amount Of $90,157.17 Which Is His Equity. 

      My Offer To Purchase The Property Is $115,000.00 Minus The Loan That Is Being Foreclosed Upon In The Amount Of $24,842.83.  Further, When I Met Mr. ********** He Told Me He Had NO KNOWLEDGE That The Subject Property Was Being Foreclosed Upon; And, Mr. ********** Would Have LOST $90,157.17 IN CASH / EQUITY If I Had NOT COME INTO THE PICTURE.

      Further, I Have Been Truthful And Tried To Do FULL DISCLOSURE Of Everything But It Seems Like Even When I EXPLAIN SIMPLE CONCEPTS OF HOW THE FORECLOSURE BUSINESS WORKS Mr. ********** Doesn't Understand.

      All I Have ASKED Mr. ********** Is That We NEED TITLE WORK (Even An "O&E" Ownership & Encumbrance Report) Showing What Is On Title - But He Doesn't Care About Anything Or Anyone Else Just His Money (WHICH WE PROTECTED) And We Are Doing Our BEST To Get Some Title Work So We Don't Face The MASSIVE DOCTOR BILLS, HOSPITAL BILLS, & MEDICAL BILLS Which He Didn't Want To Pay.

      We Are NOT Trying To CHEAT THIS MAN - Just We Are Asking For A Little Bit Of Time To TRY TO GET A TITLE REPORT.

      Further, I Told Mr. ********** That He Would Receive A Check From A Title Company Escrow Agent OR The TRUSTEE From ******* * ******* *** (Foreclosing Attorney) And Mr. ********** Called ******* * ****** Asking If He Would Get A Check From Them - Of Course They Said "NO"

       

      The Reason Is Because When They Did Their Title Work Mr. ********** Was NO WHERE In Or On The CHAIN OF TITLE.  And, Mr. ********** CALLED BEFORE ******* * ****** Received My Package Which Included The AFFIDAVIT OF HEIRSHIP, QUIT CLAIM DEED, & THE DEED OF TRUST SHOWING MR. ********** WAS OWED $90,157.17.

       

      I Have NEVER Worked With A SELLER Like This In Twenty (20) Years And It Is UNCONSCIONABLE & UNSCRUPULOUS On Mr. ************ Part To Expect Someone Else To Face All The Financial Burdens When He Wanted To AVOID THEM - ALL I HAVE ASKED MR. ********** Is For A Little Time To Get A TITLE REPORT.

       

      And, Look At The Deed Of Trust With Mr. ********** & His Wife In The Amount Of $90,157.17 NOTHING CAN HAPPEN WITH THAT PROPERTY UNTIL HE GETS PAID.

       

      Further, I Sent Out Over 300 TEXT Messages To CASH BUYERS & My Assistant Sent Out Over 300 FaceBook Messages To CASH BUYERS And The Foreclosure Sale Was Postponed For One Week But There Were TWELVE (12) CASH BUYERS Ready To Bid That Property In Excess Of The Purchase Price Of $115,000.00 (ONE HUNDRED FIFTEEN THOUSAND DOLLARS) And I Told Mr. ********** I Wasn't Concerned About Anything EXCEPT THAT HE GOT PAID.

      And, He GOT THE FULL AMOUNT WE AGREED TO - Further, If We Can Get Title Work Within The Next 48 Hours We Are READY, WILLING, & ABLE TO GIVE Mr. ********** A CASHIER'S CHECK IN THE FULL AMOUNT OF $90,157.17 (NINETY THOUSAND ONE HUNDRED FIFTY-SEVEN & 17/100) As PAYMENT IN FULL.

       

      This Complaint Has NO BASIS Because I Have Been HONEST, STRAIGHT FORWARD, & TRIED TO DO FULL DISCLOSURE .

      I am rejecting this response because:
      I am trying my best to be patient with Mr. ******. First of all, these things that he has mentioned about my mother and step-father are not true, nor do I understood why they are even being said. To my knowledge when my mother passed away in Novermber of 2020, neither her or my step-father had left behind any kind of medical debt. Saying that I was not aware of the house being in the foreclosure status is also false and inaccurate. The house was already close to foreclosure status when my mother passed away, so I have been fully aware of it for quite some time. If not then how would I have known that the foreclosure was suspended for a brief period of time towards the end of last year. I was also aware about the house having an auction date of January 3rd 2022 at 4pm. I was told that by ****** * ****** in mid December before ever meeting Mr. ******. I'm not sure why Mr. ****** is acting like I was unaware of these things, the only thing I can think of that he just assumed I did not know any of this information. As for ****** * ******, I have been in communication with them quite frequently since early November. Yes I did ask them about some type of payment, yes I did ask this after Mr. ****** told me that ****** * ****** would be mailing me a check for $90,157.17. Yes ****** * ****** told me that would not be happening. What Mr. ****** failed to leave out in his response is that I spoke with them again after they received the paperwork that he sent them. Their response was still the same as far as mailing a check goes. They also did not understand why Mr. ****** was sending them this paperwork. This correspondence was done via email which I showed Mr. ******. Therefore Mr. ****** is aware that I spoke to ****** * ****** AFTER they received his paperwork and also that their answer had not changed. Between December 24th 2021 & January 6th 2022 I have asked Mr. ****** at least a dozen times what title company he is working with, wanting to use, etc. Each time he has either completely ignored the question or changed the subject. Yes it is true in this situation my main concern is the money, as it should be. The paperwork that Mr. ****** filed with the courthouse clearly states that payment will be made in full by January 3rd 2022. As I am writing this on January 7th 2022, no type of payment has been made. Mr. ****** is still continuing to tell me to give it another 24-48 hours, which is what he has been saying for over 10 days now without answering a simple question. I have no problem understanding very simple things, but Mr. ****** does display difficulty in being clear and transparent. He should be able to report to me what title company he is working with. After asking numerous times I still do not have this information. I would like Mr. ****** to provide me direct information of the title company and confirmation of closing date. Lastly, when Mr. ****** said I don't understand, that was accurate about one thing. I don't understand why he said some of the things that he has said. On December 29th he told me he feels like he is owed a thank you card from me & my wife. I do not understand where that came from or why it was even mentioned.

      Mr. ********** Is Being UNREASONABLE, UNCONSCIONABLE, & UNSCRUPULOUS - I Have NOT HARMED That Man In Anyway Shape Or Form

      I Simply Approached Mr. ********** To Purchase His Mother's Property (Who Was DECEASED); And, I TOLD Mr. ********** That MY OFFER WAS SUBJECT TO A SATISFACTORY TITLE REPORT (WORK)

      Mr. ********** And I Signed The Offer To Purchase On December 23, 2021 (TWO DAYS BEFORE CHRISTMAS)

      The Title Company I Tried To Get Title Work Through The CLOSER Was Out Sick & I Was EXTREMELY SICK And Spent December 26-30, In BED With NyQuil Trying To Get Rid Of A REALLY BAD COLD

      Finally, I Got In Touch With ********* At ******** ***** (See Exhibit "C") And She Said That They Were TOO BUSY & Because We Had Recorded Some Documents They Could NOT WORK ON THE FILE

      When Doing Trying To Find Out What Was On Title We Saw NUMEROUS JUDGMENTS And TAX LIENS -

      PLUS Even Though Mr ********** Has DENIED Saying This He Told Me, "The REASON He Didn't Take This To PROBATE Was Because He Was VERY CONCERNED That There Were Numerous Medical Bills, Hospital Bills, & Doctor Bills Because HIS MOTHER WAS IN THE HOSPITAL AND HAD CANCER."

      I Contacted ******* * ****** And Talked To ****** ***** (ATTORNEY) And She Told Me That ******* * ****** Was Going To Send ALL THE EXCESS PROCEEDS TO THE CIRCUIT COURT In Saint Louis For A HEARING ON THE DETERMINATION OF HEIRSHIP - Therefore, Mr. ********** Just Might Wind Up With More MONEY That What He Was Supposed To GET

      Because The Judge Could Rule That The AFFIDAVIT OF HEIRSHIP, QUIT CLAIM DEED, & DEED OF TRUST ARE "NULL & VOID" And Give Mr. ********** The ENTIRE PROCEEDS Which Could Be An EXTRA $25,000 +/_

      THEREFORE, HOPEFULLY THIS WILL BE THE LAST I HEAR FROM MR. ********** REGARDING THIS MATTER

      AND, I WISH HIM & ******* THE VERY BEST!

      HOWEVER, THERE WAS NO REASON TO FILE A COMPLAINT AGAINST MY COMPANY

       

      I DID NOTHING TO HARM HIM IN ANY WAY - AND, I SIMPLY TRIED TO HELP HIM!

      In response to **** ******s recent reply, I am willing to drop my BBB claim if **** ****** writes a letter reversing the quitclaim deed and all of his interest in the property. This letter needs to be notarized. That will be the only way to resolve the BBB complaint
