On July 12, 2021, a representative from Betterliving Sunrooms visited my home and a handwritten contract was signed to have a Porch/Awning added to the front of my rental home, The contract stated that the install would happen in approximately 6-8 weeks. A deposit of $1,244.80 was made on that date. I was advised that someone would be out in the next week to do a final measurement. After 2 weeks no one had been out to measure so I emailed Betterliving Sunrooms to find out when someone would be out. I was told in the next week. After another 2 weeks when no one had been out I emailed again and was told someone would be out when they have time. As of 9/6/2021 no one has been out to measure which is 8 weeks from the date of contract signed. I am not wanting to do business with a company that is not holding their part of the contract timeline. I would like to cancel this order and receive my deposit back. All of our "start dates" are approximated due to us being a construction company and many different factors decide our schedules. According to the calendar, this week is in fact week #8 and she chose to contact me last week with her cancellation request...which would have still been within the approximated install time frame.
I did keep her updated with what is/was going on in our business (delays due to weather, materials, employees, etc.) and let her know why the pushback was happening.
Her reason for cancelling came with a "well I'm unexpectedly moving in october"...so that says to me that it is in fact not our "fault" she's cancelling.
Also, there is a clause on the back of the contract that she signed and kept a copy of, that states the customer has 3 days from signing to cancel and still receive their deposit back.

I am rejecting this response because:If I had any expectation that this would be installed at this time, the 8th week, I would not have cancelled. I was advised at the time of signing that the install would be 6 to 8 weeks after measuring. The measurements had not even been done in the 8 weeks. The updates company sent me were only after I inquired first, they were not initiated by the company. Since measurements have not been taken yet, the install date will not be for another 6-8 weeks. Since this has been seriously delayed and no materials have been ordered, I am requesting my deposit be refunded.

I am sorry she is moving from her home and cancelled, but we were still within the contractual agreement when she cancelled.

I am rejecting this response because:The contract states “Install approx 6-8 weeks”. I cancelled in the 8th week, no measurements have been taken, and no materials have been ordered, that you feel install could have still been completed within your contract perimeters? And if you have not ordered any materials yet, what is my $1200 being used for? Me moving has little to do with me cancelling because I could have worked this out with my landlord. I would like to have my deposit refunded.
