The apartment complex charged me a fifty dollar late fee for *** rent when I was never late. I contacted the office and they have been telling me every day for the last month that it will get fixed and it has not been fixed yet and it is affecting how I look as a *****, making it look like i'm not paying my stuff. I need the $50 fee removed off of my account before I contact the US. Attorney general.

We sent up communication to corporate office to get it refunded. We apologize for that wait, we have been down a manager so things have been pushed back like crazy, we are waiting for them to take it off.

There are 4 apartments in my building that are contaminated with mold. I didn't know that it was completely missing the ceiling. It is so bad it has spread out to other apartments. They moved me in to the apartment that has mold in the walls, I got bit by spiders and they are in my apartment, underneath my sink there is a leak and many other issues. They never show up to fix any of this.

I would like to get out of the lease.

I put $250 down to hold an appointment. It won't be ready for another 3-4 weeks. I asked that they refund my deposit.   I could not wait that long. They never told me it was not refundable. I never signed anything. Now they will not return my calls.

      RE:BBB Complaint ID - ********

      Dear Dispute Resolution Department:

Plato’s Cave requires all applicants to pay a $35 application fee per adult to process their application and run their credit/criminal checks. If the applicant(s) is approved and if they want to hold an upcoming unit, applicants are asked to pay an apartment hold fee to make sure that they are truly interested in renting with us. We have 39 other applicants at this very moment that have also paid this hold fee, and we explain to each and every one that this will be applied to their security deposit at move in. If they back out it is non-refundable. Mr. Nicholson, as all other applicants waiting to get into our building 1, were all told we are shooting for the 15th but will all depend on the final city inspections. This was not a problem with Mr. ********* as he still put down the hold fee for the unit. When he came into the office to tell us he couldn’t wait till the 15th now, we offered him a couple other units in different buildings, and he stated he has already found another apartment. We had a unit that Mr. ********* could have moved into. H e made the choice to back out; therefore, the hold fee is non-refundable, as he was told multiple times during the application process.

      Complaint: ********

I am rejecting this response because: The leasing agent never explained that the deposit was non refundable. The leasing agent told me they were 100% full and had no other units to offer me.

      Sincerely,

      ******* *********
