      I ordered a dumpster and when they came to pick it up the dumpster was too heavy for the wench. ***, the owner came out and said he told me not to put dirt and rocks in the dumpster. But *** was not the one who delivered the dumpster to me. So I told him that and asked him why would he lie about it? He began walking towards me yelling, "Listen here ************ you are stupid and you are the one who will be paying for this!" I immediately began walking away from him as I thought he would strike me.

      My employee **** arrived in the morning on Wednesday, October 26, 2022 to drop off a dumpster in the back of the property at **** ************ **** *** ****** ** *****. He spoke to the customer - *** ********* - and asked him what he was planning to put in the dumpster (standard procedure for dropping off a dumpster). *** ********* indicated he was planning to fill it with branches and other yard debris. **** informed *** ********* he was not allowed to mix yard debris with regular trash or junk, and that if he was putting any dirt of rock in it he couldn't fill it higher than 1/4 to 1/3 or it would be way overweight (which is also stated in the attached Terms and Conditions). *** ********* said it would just be branches. My employee ******* arrived on the afternoon of Thursday, October 27, 2022 to pick up the dumpster, which had been rented by ******* ********* ** **** ************ **** *** ****** ** ****** He found the dumpster filled to the top with a mixture of yard debris, dirt, trash, rocks, concrete and other debris. He attempted to pick up the dumpster with the truck and it would not pick it up (much too heavy). He immediately called me (*** *********** I went to the address to see what could be done. Upon arriving *** ********* came out and after a quick inspection by me, I informed *** ********* that the dumpster was much too heavy and the winch and truck could not pick it up. I informed him that it was his responsibility to get the excess out or we would charge him for labor. He said in response, "I guess that's your ******* problem, isn't it." And he went back inside. I cannot recall what exactly I said in return to him (it probably wasn't very nice), but I had no choice but for ***** and me to start digging out the dumpster. We worked 2 hours each (four hours of labor). I had 4 other guys come to the site to assist, and they worked one hour each (four hours of labor). So in total, we performed eight (8) hours of labor. As you can see from the attached Terms and Conditions, which *** ********* received prior to getting the dumpster dropped off at his site, if we are required to perform labor it is charged at $50 per hour. So he would be charged $50 x 8 hours = $400. In addition, the per diem on the dumpster is $328 for the time he rented the dumpster, so that would be another $328. We estimated that the dumpster was somewhere between 22,000 and 26,000 pounds, which means it was AT LEAST 20,000 pounds overweight. According to the Terms and Conditions, we charge $.05 per pound for anything over 2,000 pounds. So that means there should be an overweight charge of AT LEAST $1000.00. So the total Junk King St. Louis can rightfully charge *** ********* (and we will be seeking this in Small Claims Court if *** ********* refuses to pay) is $400 + $328 + $1000 = $1728. I also have attached three photos. Two of them show the dumpster filled to the very top with a variety of materials, but probably at least 8 yards of dirt and brick and concrete (at least 22,000 pounds worth). The other photo shows the front wheel of the truck, which lifted off the ground when we attempted to pick up the dumpster. Based on the facts of what transpired - not the fairy tale *** ********* provided you - Junk King St. Louis will not be refunding the $328 that we charged *** *********. We can charge him as much as $1728 according to the Terms and Conditions, which he received. The $328 we collected so far was his deposit, which is all we can charge at this time. But we may seek the rest via Small Claims Court.
