      **** ********* with Sanderson Homes is in breach of the builder’s contract that we have with him. We provided Mr ********* with $60,000 and have followed our terms to the agreement. Mr *********’s committed to a March 2022 completion date. He didn’t complete the home until November 2022. We seek reimbursement of lock extension fees and construction loan interest associated missing this contract date. Mr Sanderson plumbing contractor installed a floor drain in the wrong location which contributed to the flooding of our family’s home on 12/23/2022. Drain needs moved and reimbursement for flood damage that occurred. Also the sump pump was improperly installed and needs replaced. Mr Sanderson’s carpenter installed several exterior doors and 3 of those doors aren’t installed properly. Doors need installed properly. Mr Sanderson didn’t install proper drainage at the footings of a 9 foot tall retaining wall and a crack has already formed and a structural engineer confirmed the wall will likely prematurely fail. Wall needs replaced. Mr *********’s septic installer improperly installed our septic system, going against county code requirements. Our septic system has been pooling black sewage water for the last 146 days (11/6/2022 to 3/31/2023. System likely needs replaced. Mr ********* has been provided with professional home inspections and soon a structual engineering report to document these issues. Mr ********* has failed to provide the builder’s warranty that’s in the contract on the items listed above and other items. We seek a refund of Mr Sanderson’s Builder’s fee, the refund of expenses associated with his breach of contract and the replacement cost of several items.

      i have been in home construction  for 27 years , and never had anyone like this person to deal with  , he has done nothing but threaten me and my subcontractors and suppliers with lawsuits and turned a number of us into  the bbb for a complaint , wanting everyone to look as bad as possible , he twist the truth around on all types of situations . i can send you a copy of the contract  which  does not guarantee  a completion date , and also mr ****** used his own subcontractors in some instances which cost me  at least 3 months  of delays  , but weathe rconditions through the winter months and just coming out of the corona pandemic  caused all kinds of problems with supply chain  and prices on all types of products , his home had minimal damage  of water in his mechanical room and hall way  which i have a letter from  the insurance company  after the incident occurred  that it was from his irrigation contractor that he hired who was at fault for the damages ,  my plumber  did try on several occasions  to move the floor drain and mr ****** denied letting him to come back and  correct the problem  , he also  did not pay the carpenters  who set the front door to come back and correct the problem , the carpenter wanted his money and mr ****** did not pay him so they would not come back and do the work until payment was made , i have not seen anything  from an engineer  about a retaining wall  which did have a hairline crack in it  which most concrete does  crack  and all was approved by building inspectors  on the home  from greene county   there was no improper drainage issues  on the home as it also was  approved by greene county inspectors  and again i have seen no report from a engineering company  , mr ****** has a copy of the home warranty ,  which i can also send you , there is no coverage on a septic system  as it was approved by greene county  enviromental  services who came out  3 diffrent occassions  to approve the system  which was  engineered by a certified engineering firm  and installed by a certified septic installer and was approved  , the inspector told mr ****** , that everything  was done exactly as it should have been done  and it was no ones fault  that the system is  not working  properly  .  if you need copies  of anything i wuld be more tham happy to provide  them  from the septic engineering documents through completion , and my contract also  i offered also to come out and do a test drilling on the retaining wall  to prove no  water is  causing any damage to the wall  it could have been where  his irrigation company backfilled the wall with rock and dirt  . or just a hairline crack  as most walls  will have  it was built in accordance with greene county  and approved  , its ironic mr ****** has  people out  such as the engineer , but wont let me be present to  be there as i have ask several times to meet people and  be there  , i have done no breach of contract which would be clear in the viewing of the contract ,

      I am rejecting this response because it is factually not true.

      Our contract has a March 2022 completion date and Sanderson Homes is unable to provide our family with a final occupancy permit due to the failing septic system that started to fail as early as 11/6/2023 and due to Sanderson’s misuse of the sump pump, which flooded our basement and is a code violation.

      Greene County also recently notified us of another code violation related to Sanderson Homes running the basement floor drain into the septic system.  The county wants the floor drain run to daylight vs going into our septic tank.  

      For a builder who claims to have 27 years of experience, his lack of knowledge related to code is worrisome and has created great harm to our family.

      Sanderson Homes’ insurance company initially denied our family claim due to Mr ********* providing them with false information.  Sanderson Homes is aware of this and so it’s misleading for them to say the insurance claim was denied.  During this process of the claim being delayed, one of our children nearly broke her foot on the construction zone that Sanderson has going on in our basement but has refused to complete.

      Upon Sanderson’s insurance company discovering they were provided false information by Sanderson they reopened their investigation and sent out a structual engineer.  We should have that structual engineers report soon.

      Once Sanderson and his plumber heard that the insurance investigation was being reopened and a structual engineer was being sent out, only then did they offer to move the floor drain because they realized a structual engineer would ask them why they placed the floor drain in the wrong room.  Sanderson’s insurance company informed Sanderson and my family that they didn’t want any more structual changes made to the home, including moving the floor drain, until after the structural engineer completed their investigation.

      Bank records and emails suggest that Sanderson Homes provided our lender with misleading and possibly false information regarding the materials he claimed he would use to construct our house.  We are having this investigated to see if criminal charges can be filed.

      On 4/21/2023 Greene County visited our home with 3 certified soil scientists and overturned their decision regarding our septic system.  The county confirmed that our septic system was not installed to code.  We believe we’ll be able to document that Sanderson Homes attempted to mislead or hide this information from the county when they were at our property on 3/30/2023.  We are requesting an investigation into this as well to see if criminal charges can be filed.

      Regarding the comment of Sanderson never having to deal with clients like my family.  In reviewing Casenet.com and doing a search for **** Sanderson there seems to be a history of Sanderson being taken to court.  Just a couple of years ago it appears he was sued by another family for breach of contract.

      Sanderson Homes lack of good faith in dealing with warranty issues has made it impossible for our family to enjoy our home like we should be able to.  This company has caused a high-level of stress, created a health and environmental risk and cost our family significant time, money and lost wages.

      We would like to productively work with Sanderson Homes and their insurance company in getting reimbursed in full for the warranty issues, time, stress, injuries, lost wages and the nusiance this has created for us and limited our family in being able to enjoy our home.  We want to be made whole for all that has transpired.

      The contract states the completion of the home  will be done as quickly as possible  **** ****** hired people. To do work which caused  a 3 month delay. In the home completion    There has been no  written information from my insurance company that anything we did on the home construction  was incomplete or defective  mr ****** denied to have the final inspection for occupancy done on the home. Of which I have documents to prove that  Greene county. Did approve the drainage of the water coming from water softener to go into sump pump which did run to outside of home and not put into the septic system drain until mr ****** said to run it into the septic system because it was good for the system. We had a meeting  with Micheal bowers the Greene county inspector for septic systems  myself / mr ****** /the septic installer /another inspector from Greene county /who Micheal bowers told me ****** at that meeting that the septic system was installed properly and the installer did nothing wrong  .  The time the home was under construction we were just coming out of supply chain issues and some items were substituted with same or equal quality  which is also in my contract mr ****** has turned in several of my subcontractors and suppliers into the bbb and Google  of whom never got turned into before with any issues
