The salesman, ******, said that my truck, Dodge Ram was not a multi function truck, it is a straight 8 cylinder. I called **** Morlan, my phone was on speaker and my son heard it, and it is a multi function truck. I wanted a straight 8 cylinder truck. They told me to bring the truck back. I gave them $5000 down on this. If he gives me $1500 back I will deal with this truck.

On November 15, 2021 I sat down with *** at ******s to order a new truck to pull my camper. I stressed that there were 2 main things that I had to have on this truck: 1) a 3.92 axel ratio and 2) the LARGEST cab size. I signed the order, trusting that he had ordered what I requested AND put down $1,000 deposit. The deposit was NEVER discussed about being non-refundable. On March 18, 2022, *** called to tell me that the truck had been delivered to the lot. We were headed out-of-town at that time and told him we would come when we got back. On March 21, 2022 I went to get the new truck and turn in my trade-in. When I got there, the truck was, in fact, NOT what I had wanted or thought was ordered. Instead, this truck had the Smallest cab size, instead of the requested largest size. I refused to buy the truck, which upset him as well. I left the lot with *** telling me he would look around for something comparable. A week later, I found a truck that fit my criteria at another dealership and purchased it while it was still available, since I had heard nothing back from *** about possible options. A few days later, I called to discuss getting my deposit refunded. I talked with **** ******, Sales Manager/Owner. He told me, " You will NOT be getting your $1,000 back. Sue me." Very unprofessional! Companies have no right to treat consumers this way! All I want is my $1,000 deposit back and I will NEVER set foot on any ****** lot ever again!!

Mr. **** had come in and sat down with my salesman seven times over a two to three month period to order his truck. Here at our dealership we have our customers sign a POC when ordering their new vehicle to ensure that the vehicle we are ordering together is ordered as promised and exactly what the customer is requesting. When the order process is completed, it is our policy to take a NON-REFUNDABLE PARTIAL PAYMENT. The partial payments we request range between $1000-$5000. Mr. **** signed the POC which is time stamped and dated. It shows all the options he wanted at the time of order and he signed off on it, like every customer who orders a new vehicle with us. Mr. **** was also provided a copy of this POC the day of the order that he took with him when he left. When Mr. **** arrived at the dealership to pick up his 2022 Ram 1500 Big Horn Quad Cab 4x2 he ordered Mr. **** stated that is not what he ordered claiming he wanted the Crew Cab instead of the Quad Cab model that he had signed off on when he placed his order. I told Mr. **** that I would see if I could find him a New truck at another dealership with the Crew Cab he now claimed that he needed instead of the Quad Cab he had signed off on and ordered. I also assured Mr. **** that if he bought any truck new or used from me I would gladly apply the $1000 partial payment he paid to order his 2022 Ram 1500 Big Horn Quad Cab 4x2 that he was no longer going to purchase. I cannot send vehicles back to the manufacturer when a customer orders the wrong package from them. I have to keep the vehicle until I can sell it at either a profit or possibly a loss depending on the unit. I am only promised to sell the vehicle to the customer that I ordered it custom for. Outside of that it is a gamble, ESPECIALLY when its a two wheel drive quad cab packaged TRUCK. Mr. **** agreed to let me try to find him a truck that would now better suit his needs, but after about five to seven days with no luck Mr. **** purchased a vehicle at another dealership. Days later, Mr. ****** wife went onto facebook and created a facebook post bashing and slandering my dealership. The next day Mr. **** calls me and ask me to give back his $1000 partial payment that he now claimed was a deposit. Mr. **** also stated that he was never told that the $1000 was NON-REFUNDABLE under any circumstances. That is completely false. Mr. **** stated that he had already turned me in to the Better Business Bureau and threated to get an attorney involved and I stated if your lawyer needs to call my lawyer that's fine, they can work it out that's his job. I have attached a copy of the POC Mr. **** has signed off on and also a photo attachment of the facebook post slandering my dealership. I did try to work on alternative solutions for Mr. **** so that he could still apply his $1000 partial payment to a vehicle I was selling him but in the end it did not work out. I am stuck with a $43,000 two wheel drive 2022 Ram 1500 Big Horn Quad Cab that I may or may not turn a profit on and Mr. **** is out his $1000.
