      I hired them to cut down 3 trees. They took the stumps out, but they left a mess. Where they dragged one of the trees out they left a rut about a foot deep and 20 feet long. They just say that they are not responsible for damage to your lawn.

      Mr. ****** accepted the proposal for tree removal which included language pertaining to the possibility of lawn damage not being our responsibility due to the nature of the removals. Mr. ****** accepted the proposal and did pay his invoice in full when work was completed.

      On Sept 9, 2021, Monster Tree Service came to our home to cut down a tree and remove another tree that was knocked down during a storm. In the process of cutting down the tree, the tree fell on our children's playset. In addition, they damaged our fence but did not report that damage to us. I contacted Monster Tree service the same day and the General Manager, ***** came out the next day to inspect the damage. He accepted all fault and told us he would make things right. We agreed that we would purchase a new playset in exchange for Monster Tree Service waiving the price of the tree service, hauling away the debris of the old playset, assembling the new playset, and fixing the fence. Over the course of the next month, ***** did send people to work on the playset sporadically, but they never finished the job. We've tried texting, emailing and calling ***** and Monster Tree Service but we can get no one to come out and finish the job. At this point, we need help.

      We have been in touch with the customer. There was some confusion at the time. We did not charge for the work. We credited all the cost for the play set damage.

      I am rejecting this response because crediting the cost of the work performed was only part of the agreement we reached with the GM, *****.  On September 15, ***** sent us the following text:  

       

      The fence guy was at your house Monday. He said our best option is to replace top rail and bend everything back best as possible. With the way the fence is in the ground and how old the fence is matching it would be very hard.

      As for the play set let's go with the one your kids want. I will put it together.

      If you would like to buy the play set. And I put it together. And I replace the top rail of the fence and mold the chain link best as possible. I will just give you the tree work for the cost of the play set?
      Please let me know if this is acceptable arrangement for you?

       

      As you can see from this text, the agreement was to (a) credit the cost of the tree work in exchange for us purchasing a new playset (b) ***** would put the playset together (c) ***** would replace the top rail of the fence and mold the chain link.  ***** did not finish putting the playset together nor did he repair the fence.  He sent the foreman, ******,  to our house on 10/7/21 after we complained about the work not being completed.  ****** reiterated that they would finish putting together the playset and fix the fence.  However, that never happened.  Instead, they stopped responding to our calls, emails and text messages when we kept inquiring when they would finish the work.    There is no confusion here.  They simply didn't honor their end of the agreement.
