      I contracted Mark Hicks to remodel our deck and halfway through the project they emailed me to let me know that they were not going to finish the project and when I got ahold of Mark Hicks to find out why, he stated that they weren't going to finish the project because they're not making money. Most unprofessional company I have ever worked with.

      I understand the Customer's disappointment, however, the Customer's narrative is grossly misleading and purposely twisted with the intent to defame my company. The Customer  was provided estimate ****** on 2/14/24 for three (3) things:  (1) Install frp deck columns, (2) replace deck beam, (3) wrap the newly installed beam.  ******** (*****************************) approved estimate 2/15/24. Our schedule at that time was appxly 30 days out.  Customer was having concrete poured by another contractor prior to the deck work to be done in our estimate.  Apparently the concrete contractor refused to dig the holes for the piers and Customer called us to dig holes for piers so concrete contractor could do a monolithic pour.  This was not included in our estimate 12691R.  We dug the holes for the concrete and billed accordingly.  The other contractor poured the holes and we were called to install temporary support of the deck and remove the existing posts so the concrete contractor could pour around the previously poured piers. Then it turned out the concrete couldn't be poured for lack of a permit for the holes we dug for the concrete to be poured.  We secured the necessary permit.   In summary, this project turned into a piecemealing proposition requiring numerous trips to perform work in stages, something we did not agree to at the outset.  The norm is to start and finish projects beginning to end.  In this case it was spread out over weeks and months and we never performed the worked in estimate 12691R with the exception of installing temporary supports only.  Instead, we were preparing the site for another contractor, something we did not bargain for or agree to.  This negatively affected our profitability and since we were not made aware of, nor agreed to the piecemealing of the project at the outset, it was not quoted accordingly.  After the permit was closed out, I withdrew our estimate because the nature of the piecemealing, which I did not agree to at the outset, detracted heavily from any potential for profitability.  The Customer is out no money, the services we performed to date were done at considerably less than our standard rate.  The Customer, also a business owner, is well aware of the profitability considerations in every transaction.  Customer set out on social media to defame our company, which has a stellar reputation, through childish name calling and raising baseless alarm with the public in an attempt to injure our reputation without taking into consideration the weight of his own actions and behavior that lead to our withdrawal and ultimate desire to cease doing business with this Customer.  The complaint, as unfortunate as it is,  has no merit  and does not belong on this site.  There was no fraud, no theft, no deception, no false advertising, no broken promises and the complaint was initiated solely because we decided to exit the relationship when the terms we agreed to at the outset were changed by the Customer.  Should this grievance have any negative impact on our rating and my or my company's reputation to any degree, any way, shape or form, I am determined to promptly refer the matter to my attorney.  I am that protective of my integrity and reputation. Please contact me for any additional information.  At the end of the day, I appreciate the Customer's previous business and I'm sorry this did not work out as we both originally intended.

      I am rejecting this response because: Nothing in his response is factual, I have all the contracts with the scope of work in the contract to prove everything. The contractor pouring the concrete piers was doing it as a favor to them since he was pouring concrete anyway. I just want other people to beware of who they're getting with Mark Hicks. Plus, ***** Hicks is who I was dealing with and the Jefferson county code enforcement shut them down because they tried to alter the structural part of the deck and didn't get proper permits. Even the county inspector's office told me that the contractor knows better.

      You can see from the Mark Hicks proposal number ***** that they had in their proposal to dig all four piers.

      It's quite obvious there is a fundamental and substantial difference of perspectives depending on the party.  I made it a point not to overcharge and to be responsive to the Customer.  We accepted no advance payments and the services rendered were paid by the Customer so there is no material fraud, theft or deception involved.  Since the the Customer wanted the work piecemealed around other contractors which was not defined in the estimate nor agreed to at the outset, the project became financially unattractive.  There is no contract between the parties but an approval signature accepting our estimate and approving the work defined in the estimate.  Had the project been a clean work through to completion as all other projects we perform there would have been no issue at all.  Additionally, the Customer was frequently rude to my employees which was completely unnecessary and uncalled for and exacerbated my desire to exit the relationship with the Customer.  I understand the Customer's disappointment which has clearly turned into disdain and anger.  I have nothing against the Customer.  I have no desire to harm his reputation with future contractor's. He clearly has a large project going on that is costly and stressful and our company got, what I hope is, unintentionally squeezed but nevertheless squeezed to the point the project lost all potential for synergy and profit potential resulting in my decision to withdraw.  I wish the Customer the best and wish this would have turned out differently.  It didn't and there appears to be no resolution in this forum other than the Customer's determination to harm the reputation of my "hoosier" company so this will be my final response.
