      On 10/15/22, we asked *** *******, of Precision Flatwork Construction LLC, to come to our house and give us an estimate to the pour a sidewalk with gravel lining low spots in our backyard. He came out, measured, wrote down figures, and told us it would be $5622. He wanted us to pay half the cost so he could purchase materials. My husband wrote check #5285 for $2811.00. Depending on the weather, he would come out asap and start the job. The weather turned pretty cold shortly after that date, so we didn't contact him again until sometime in March. I called him and he said, depending on the weather, he would be out here in a couple weeks to start the job. He didn't show up. I continued to call back, he always said depending on the weather. Around Easter, he said his dad had a heart attack, was on hospice, he had to go. Since then, he wouldn't answer my calls. I called from others' phones and he would call back, but would come out next week, etc. We haven't seen him since 10/15/22, he hasn't stepped foot in our yard and still has our $2811.00. After going on YELP, we have seen that we aren't the only people who have been taken by Tim Schwartz, as there were numerous complaints. We would like to have our money back, as he is not trustworthy. I don't have a copy of the check, but could get one from the bank if it would be helpful.

      ******* ***** ******** *** *******, Precision Flatwork located at **** * ***** ***** * ******* ** ***** contracted with me on 10/20/2020 to pour a concrete wall. He required $2,800 up front, which I paid on that date. Work was never completed. We texted and/or talked multiple times and several dates were set up, but nothing was ever started. There were always excuses, but no work was ever performed. Finally he said that he did not know when he would get to it and that he would return my deposit. I continued to follow up with him, but there was always an excuse on why he could not yet return deposit. When excuse ran out, he quit return any calls/texts.

      I paid almost $5000 to have a new Driveway and Sidewalk Replaced. They still have not completed the entire job or repaired the broken section of the new side walk that has broken off. After numerous calls, messages and promises to come back out and finish/repair now can no longer get ahold of them. I would like to have a refund and/or get the job complete.

      On March 19 we accepted a bid from *** to put on a porch and sidewalk in Overland Park. We put the required third down $1,379.88. He was to start project the next week. During March, April, and May he communicated that it was too wet to start project. On June 22 he was to start and he did not show. He did not return phone calls or texts. I texted numerous times to see if we were on schedule with no response. On August 5 he texted that he would return deposit. As of September 12 no refund of deposit has been received. I wrote an email indicating we had not received it. We waited 5 months for the project to be started.

      On March 14th I entered into an agreement of concreted work with ******* ******* to remove and replace a concrete patio, driveway and add a floor to a barn. Work began on the 14th and I paid him the first installment of $11,910.74 and they began work on March 14th 2022. the driveway was torn out and poured back. On March 15th the barn floor was poured and I paid the second check of $8,337.52. After that nothing ******* ******* never came back to the job. On May 13th a phone call with *** he stated he would not complete the work and I asked for a refund for the work not performed. I have cense sent emails and phone calls requesting a refund with no response.

      We tried to reach to him regarding his refund and he was wanting a refund for the patio and color I let him know we could refund the money owed on the patio but not the color since it was a special order. Tge reason it got to this was the fact it was raining and could not start that part of the project. He became bilgirant and irrationally unreasonable.

      I am rejecting this response because:  Mr. ******* has never offered any settlement in this matter and I am not responsible for the color in concrete that I did not receive.  I have never been belligerent or irrational and if it wasn't for this complaint with the BBB he would still not be responding.   *** ended the contract not me.  He was responsible for the removal and replacement of the patio and bib on the barn.  He said he would not complete the job and would refund the money for uncompleted work.  That has yet to happen.
