Hired Jason Casaus on May 26, 2021 to begin construction of 30 x 40 ft. garage with living quarters. Advanced payment of $13,000 paid in advance. Casaus failed and refused to complete the construction, failed to appear for work on a regular basis, and abandoned the job. Casaus has failed and refused to refund any portion of cash down payment. Job was to build 30 x 40 x 5" ft. concrete foundation placed on 4" compacted fill. Casaus partially excavated and trenched land leaving work unfinished. Worley ***e is 91 years old and a veteran on disability.Business response

I have worked with this particular home owner from last fall thru the permit process. I made drawings that were hours of work (all unpaid). He was told by his city he needed an engineer (not my drawing) for which he paid around $1,800. Once we received the permit that took about eight or nine months to get, I started work around May 25, 2021. I then received a down payment and began layout/excavation with a new engineered drawing not from my own.
There were some discrepancies with the engineers drawing; they wanted a 3 1/2" concrete floor. I fixed that with said engineer and was given the go ahead using JCC specs.
Another problem was weather. It did rain early on but was contained to a few days out of work, all while still making progress (I encourage you to look at our internal records provided). Remember they were made for JCC records for future estimates and taxes.
From that point we finished getting our excavation completed, with weather troubles to the extent of (12) thirteen and loads out and (1) loan sent back empty (per general)...which is outlandish. At this point, around June 5, 2021, the general started changing my scope of work that was previously agreed to by the home owner. JCC went along with this new scope (all the while being told by the general JCC would be compensated for additional time). The general also gave me a stop work order around June 9, 2021 "due to rain," per Lampley Construction.
JCC has always dealt with projects that require working in wet job conditions, and have never had a problem, other than a small schedule change. However this particular general didn't agree, and the homeowner agreed with the general. On this job, the general wanted this project to sit vacant for approximately ten days (with JCC rented machinery thru Luby Equipment), until June 19, 2021 when the general had his new sub contractor on site to take out the remainder of dirt, along with the added driveway change order (which was not on my initial proposal or any change order to date). You will see with my videos/pictures that JCC did most of the work on that day (Refer to picture June 19, 2021), along with the very conservative change order dated July 8, 2021 that is also included in this packet and still unpaid.
I understand this summary was a large amount of info, however this project should not have been this difficult, (due to poor management by the general). No project of this size ever goes perfectly, and that being said...this project went wrong because of the change in scope and the ridiculous experiments by the general of approaching common civil construction problems. This general, placed in charge by the homeowner, is not a mason, operator and has very little civil engineering experience. Once JCC lost control to Lampley Construction because of his manipulation of Mr. *** is where this project turned into fool's errand. He collected over $25,000 and hasn't lifted a finger to date. It doesn't take a construction savvy person to see what was happening here.
JCC has completed multiple jobs this size, larger and smaller since this nonsense. The only difference is, all our other JCC projects didn't have a manipulator as a general and definitely do not take multiple vacations during very important timelines.
I reached out to the general thru multiple calls and meetings for weeks, trying to finish this project. However JCC was hindered by the general's idea of how he thinks a project should go, "and rain." (This same general was causing the same issues simultaneously on another job site at this time FYI).
To summarize...I was paid $13,500 in three payments all with smiles, somehow the general gets involved, kills JCC schedule and outlook, dictates material orders and inspections from us. (Biggest problem with that is the general takes too long or he was stalling, it took months for plumbing to go in which is two day job). JCC has put in upwards of $18,000 worth of work. I understand that Mr. *** is upset, but he's upset with the wrong company. (The civil portion of this house would have been completed months ago had he kept with our original scope). JCC finish date was scheduled with the elevation change, with rain, with all the added change orders was June 20, 2021.
I wish him the best with the remainder of this project.
