  ******* ******* responded to my ad on the Thumbtack app to complete Tuckpointing on 4 chimneys. I live part time in StL and part time in Wisconsin so we talked by phone. He completed an estimate and I hired him. He was unable to secure proper insurance (stated many excuses), nor pay for the deposit fee for the needed equipment (financial reasons) but I continued to work with him, changing the start date several times. We finally came up with a plan where I would pay him the needed deposit fee for the equipment with the understanding that it would become the fee for the work. They did not take credit cards so my husband, ***** ****, used our Credit Card to PayPal 3600.00 to his 'partner ***** ****** on 9.20.21, I Venmo'ed ******* the diffference of 104.00 which was withheld from the original PayPal amount since it was for a service. The contract was sent back, signed by me on 9.28.21 after a week of no response from his about changing some of the language. I made a note on the contract with the appropriate language annotated. The work was due to begin on 10.4.2021. We were not in town, and our camera's showed there was no activity. On 10.6.21 I called ******* to determine what the hold up was, and he said they delivered the wrong lift and the one they needed was not available. I asked why the wrong one was delivered and he said because he thought we had a circular drive in the back, which was inaccurate and he should have known. He had a bunch of excuses about trees and insurance and such and when I point blank asked if he intended to complete the job he said no. I requested a full refund of the 3600 and 105 at that time and he stated it would be sent immediately. As of today, 11.15, 2021, We have not received any refund. I have been in constant contact with him via text to see when the refund would be made with no resolution. We have filed a complaint with MO AG, and requested a refund via PayPal and our Credit Card company

  She sent a deposit for the lift to my business partner though PayPal, when the lift was delivered, the house was too narrow to get it in. I didn't want to cause any damage to her home or her item, so I declined to do the job. The rental company was going to refund my business partner that way we can refund the consumer. I was in communication with her about the whole process on how to get her money back. My business partner lied about the refund and about the consumer getting it back, however, I do believe she received her refund via PayPal.
