      I am submitting this statement against Tri State Rental & Sales/Tri-State Buildings/***** *** ****** The company owes me $12,200 after agreeing to a consignment arrangement where the business sold my 12x32 Lofted Barn Cabin in February 2021. Since then, I have repeatedly reached out to ***** ***** directly through phone calls and text messages as well as showing up to the business in-person. During this time I have made every effort to work with the company on payment options. In return, I am still waiting to be reimbursed $12,200 from a consignment sale that happened in February 2021. It should be noted that the business has renamed itself and changed locations multiple times.       My friend and partner ***************************** sadly passed away on 3/16/2022. Due to having no family in ******** I did not want to stay down there by myself, so I chose to move closer to my son. I decided to have an auction to sell ******'s stuff as well as some of my own belongings before the move. I had done business with ************************* when purchasing a carport, from Tri State buildings. While he was at my home in ********, he asked what I was planning to do with all my stuff. I told him my plan was to sell it prior to the move. He mentioned that he did auctions so I chose to have him do our auction.
      The Auction was held on May 21, 2022 at my property address of:

      He had written down the auction information on apiece of orange scratch paper. I asked for a proper receipt for my records prior to my move to ********. I did not receive payment until 6/24/2022 which was the day that I left. I went to a local bank *************** to open my checking account with the funds from the auction.Soon I received a charge back as the checks were drawn from a frozen bank account. After contacting ***** numerous times, he told me that it was an issue with the bank, and he got it straightened out and to redeposit the checks. Once again, the checks came back as no good. I was in constant contact with ***** who promised to send a cashier's check.I waited over two weeks and no check had showed up. He said that it had been sent certified but was unable to locate the receipt so that I could got to the post office to track it. After not following through with that promise I offered the solution to drop off my payment at US Bank in ********. I had spoken with ****** who was my banker and she said she would put the check where it needed to be. Though ***** assured me he was minutes away no check was dropped off still to this day.
      Since then, I have not had any contact or communication with *****.

      In April of 2021, my husband and I purchased a carport and put $1,000 down. They stated they were a bit behind so we gave it time. We received a few calls on scheduling and by this time it had surpassed the contracted time on the receipt we received. We requested a refund, and we’re told we would receive one. We also received a call from the distributor in another state, stating they only received a portion of our down payment, meaning the location in Hunnewell kept the other portion. We have contacted law enforcement for this matter.

      I am rejecting this response because: we were promised a refund, and according to the contract, a refund is not given unless circumstances for the order have changed. Which they had.

      I have ordered a building back in March the dealer keeps telling me different dates that my building will be here I finally got ahold of the contractors that supposed to be doing the building there is no date set for my building to be here I've been waiting over 7 months now and all I wanted was for them to reimburse me the money I have put down as I keep getting the runaround when told them I no longer and waiting for them to do their job both parties keep telling me they're not responsible to reimburse me my money

      PER THE CONTRACT AFTER 72 HOURS REFUNDS ARE NOT ISSUED. MR. ***** WAS NOT GIVEN THE RUN AROUND FROM US BUT TRISTATE CARPORTS INC NORTH CAROLINA. WE RETURNED NUMEROUS CALLS AND SPOKE TO HIM ON DATES FOR DELIVERY GIVEN TO US BY MANUFACTURER. AS TIME AND RESOURCES ALLOW TRI STATE CARPORTS ASSURED US THEY WILL BE BUILDING HIS BUILDING. THE COMPLAINT IN OUR OPINION NEEDS TO BE ON  TRI STATE CARPORTS NOT TRI STATE BUILDINGS. AFTER TRYING TO DISCUSS THE MATTER MR.***** BECAME VERY ANGRY AND THREATENING. HE HUNG UP AND LAST WORDS WERE VULGAR AND HE WANTS YOU. HE THREATENED AN ATTORNEY SO AT THIS TIME WE ARE NOT ISSUING A REFUND AS LEGAL FEES WILL BE TAKEN FROM HIS DEPOSIT. HE SIGNED AN ARBITRATION AGREEMENT NOT TO SUE OR REPORT TO BBB HE IS IN VIOLATION OF THAT AT THIS TIME.

      We saw an ad on FB for a metal garage. So we put a down payment down, $680.00. They said they would be out in two months. We had to pour the concrete. We called them back when we hadn't heard from them, it was two months after signing the papers. I called in May. It was supposed be delivered to us in mid-May and it wasn't. They said they were behind and it was going to take one or two more months. They said someone would be contacting us to put the garage up. I called the 800 number that I was given--the scheduling department. They told us that the company had put 10 of the buildings on hold. And they didn't know why. The scheduling company wouldn't be coming out. About a week later, a representative from the finance company called and said he doesn't do business with the company because of the bad business dealings. When I learned about this, I called tri-state back, I asked for my down payment. He opened another loan in my husband's name. He said that it would cost more because of the switch of Finance companies, but it was the same finance company. As of right now, I don't have a garage and I don't have the down payment back either. He told us to pour concrete, which cost us $2800 to pour, and move an existing carport, $200, before he would deliver the garage, that's the only reason we had concrete poured. We are also paying for storage because the garage hasn't been delivered as promised.

      Our company is a dealer for Tristate Carports Inc of North Carolina. After 14 weeks we contacted Mrs. ****** and she stated she wanted to go with a different company and financing. We got her approved thru a new company that can build in 14 days locally. She refused that and wanted to stay with the original price and contract. After letters and numerous calls they still wanted to go with Tri State carports and not the new local manufacturer so we cancelled financing. Again we spoke to them before they contacted you and we offered a refund again they did not want it. Then we sent a letter out trying to get a resolution and they called and said yes to pay for their concrete, storage and pain and suffering of 12,000. We declined and offered a deposit refund. Now we are going to incur attorney fees and a refund will no longer be offered as they are going to sue. We were verbally cursed by the husband. Please note that we had over 120 orders and only 10 people are still waiting or didnt want a refund. The manufacturer was contacted again and stated they would get to them as time and resources allowed under unforeseen circumstances. We prayfully ask this matter be marked as resolved
