On 1/30/24, a homeless person burnt down my home.  I had no insurance, Busy Beever Auction and Estate Sales, a man who called himself Steve, who said he was the owner he said he felt sorry for me and wanted to help me.  I had him do what he called a pickers sale with only 24 hour notice.  He sold some of what little was left.  He forged my initials on the pages, he replaced in the contract, than I told him I could not read, because I did not have my reading glasses.  This man has not paid me a cent.  He and his wife are liars, crooks, thieves and they use aliases.  They take advantage of old people like me I am 75 years old.  He saw that I was depressed and vulnerable because of everything I had lost in the fire and the loss of my home. This man has lied to me about everything, he and his wife these people are truly predators, Busy Beever Auctions, I have learned since this that he has a criminal record in Kansas and Missouri plus civil suits against him and numerous bad reviews.  Please do not do business with Busy Beever Auctions.  He hires ex-convicts, everyone in his business are crooks like him, the MO attorney office is investigating him.

*** *** Had an opportunity to pick up his check at our auction house. He instead became violent, and the police were called by both parties. We are working with the ******** Attorneys General office as we speak about how to get him a check on Neutral ground without mailing it as we already mailed one check. You are welcome to call *** ******** at the Attorney Generals office to ask about emails we have shared. Talking with their office has been very slow but we email back immediately once we have received a response. We can also forward all of these emails.

This is the amount this company owes Mr. ***.

We cannot stay in business if we overpay clients. Per our receipts taken for his sale this amount is correct. Mr. *** received cash compensation from Busy Beever as well as monies from a buyer that bought property from him.

If he wishes to proceed in any manner with Busy Beever, it will be in a court of law.

Contracted with this company to do a estate sale, he reported that he sold $6900.00 worth, after his unprofessional and threatening behavior i decided not to use him for the on line part of the sale, especially after reading the prior complaints he has had with you in just 3 years he's been part of your system. He refuses to give me any money, told me to take him to court, and if judge tells him to pay me only then would he.

We did collect about 6900.00 from Mr. ******* estate sale. Unfortunately Mr. ****** Cancelled the second portion of a signed contract auction in which we would have collected between 40 to 60,000 in proceeds. This is a direct violation  of our contract in which the breach is a 3,500 dollar fine. There was not an instance in which we were physically or verbally abusive to result in his decision. Mr. ****** simply didn't like the prices he was getting for his items and started verbally letting us know.I will not talk about the unkind things he said her because its pointless. He also wouldn't allow us to sell some of the bigger ticketed items unless they had a very high price which means we do not collect proceeds on those. His behavior was very off and disrespectful and yet we stayed the full term of the first round of his auction. Our contract states we do wish for arbitration before court. We ask that Mr. ****** to pay for  arbitration to proceed. We would have owed Mr. ****** 4,968.00 before the breach. After removing items and cancelling the sale plus over pricing items he now owes us a sum. We know we will never see this amount so pointless to put the amount here.  We are strictly enforcing our policy and any abuse. We gladly send our contract portion that states the breach and any reason for it as well as our arbitration portion if need be.

December 3, 2021 I hired Busy Beever to sell all of my items (see attachments) in a 10'x40' storage unit and a 15'x20' garage. The items resale value is approximately $44,000. The company has only sold about 20% of the items (per invoices I've received) for a total of $2,236 of which I have received $1,341.60. I understand that in an estate sale/auction situation I may not receive resale value for the items, however I do believe that the items should have sold for at least 30% - 35% of resale value, or around $14,300. The owner has ignored my requests to let me see my remaining items, and to abide by the contract we signed. The owner has been extremely rude to me and is now avoiding me. I have given the company over 37 days to respond to my requests, but they have not responded. I believe they are taking advantage of an older handicapped person and have stolen my belongings. I would like the company/owner to pay me the fair market value for my items that they have kept and not paid me for, and for my items they have used for their business without my permission and without paying me. I believe a fair resolution would be a cashier's check in the amount of $7,000 (this amount is in addition to the previously paid amount of $1,341.60). I have pictures of the items, receipts for purchases of the items, a spreadsheet with a list of all of the items, etc.

***** went out and met with Ms ***** and agreed to help her liquidate the items that she could no longer sell from her online business due to medical reasons.  ***** explained to her that since she did not have a space for our company to setup and sell her items, that we would have to find other clients that would be willing to let us add her items into their sales so we could slowly liquidate her items for her.  We have been able to sell her items at two estate sales and a LIVE auction so far.  We do not have control over who will let us add to their sales.  This process was explained to Ms *****.  We also cannot control the prices that ultimately the customers pay for her items, but we did explain that she would not be getting anywhere near full retail like she was used to with her online sales business that she can no longer do.  We do feel bad that it has taken so long to sell all of her items, but ***** has been out there loading, unloading, selling, and repacking her stuff to take it from sale to sale to try to help her out.   We have now offered her items in 3 separate towns and no one is offering to pay retail for her items so we sell them for what we can.  Ms ***** has been provided detailed invoices for each sale, listing out items that we were able to sell up to this point.

I am rejecting this response because:

As you can see from the previously attached copy of the contract, text messages between the owner-***** and myself as well as emails, and the now attached copies of the invoices I've received from Busy Beever, the company has not complied with their own contract.

They have not sent me itemized invoices as it states in the contract, which not only violates their own contract, but appears shady in them proving what was actually sold (I have purchase receipts and a spreadsheet of the items they were given to sell).

They have not used their resources (shown at the bottom of the contract and on their website) to value and price the items correctly or to even label them correctly (I.E. lot of "glass" vases sold was actually all crystal vases, etc.).

They have not kept me abreast of when and where my items are being placed for sale prior to or even after most sales so that I may have the opportunity to see my items at the sales.

As you can see from the text messages, the owner admits to using my items in his business for his buyers without paying me for those items.  And, he refused to come to ******* (where my items are being stored) to allow me to see what is left as our accounting of what has been sold does not match up.

I have sent multiple emails to the company requesting responses to my questions, etc., but nobody has responded to my questions, nor have they agreed to meet with me to allow me to see my remaining items.

I believe the owner (*****) of Busy Beever is taking advantage of me and the fact that I am disabled, and has essentially stolen my property.

Again, I request payment in the amount of $7,000.00 to compensate me for my property, and once that payment clears in full Busy Beever may do whatever they'd like with those items.

I have attached the detail pages showing that you were sent an itemized list of what was sold from the sales that we were allowed to add items to.  I think your definition of itemized is different than ours and that may be causing some of the confusion.  As we explained many times, when we sell items at a LIVE auction (for example), things are grouped into like items and put into a box.  So if you have screwdrivers and tools and hammers, those would all get sold in one box or what is called a box lot.  Sometimes there are many things that get sold in what is labeled as a Misc Tote, or Misc Lot because its things that the public was not interested in purchasing separately, but when the auctioneer added them together, a registered bidder in the crowd was willing to purchase them.  Sometimes these go for a decent amount, but most of the time they go pretty cheap because bidders are there to get things at the lowest price possible.  We do feel bad that your items have not brought the value that you felt they should, but ultimately the public decides how much they spend on items, especially at the LIVE auctions.  As a side note, your original attachments showed the same detail pages listing the items sold.  I think you might have been looking for a 'detailed' list such as vase A, vase B, Funko Pop A Funko pop B, etc, but as shown in the texts you attached, that is not the way that the detailing is done at a sale especially for items added into another client's sale.  We have added your items in to every client's sale that would let us.  We do not determine the timeline for those because this involves bringing someone else's items into their home potentially taking away from the sales that they could be earning and not every client is willing to do that.

I am rejecting this response because:  Busy Beever is avoiding responding to me about meeting with me so that I may view my remaining items so that we can be on the same page as to what has been sold and what is left to be sold.  I have not seen my items since December 2021.  I have not heard from Busy Beever regarding my requests from the email I sent them on 4/12/2022 (8 weeks ago) which included wanting to see my remaining items.  They have also avoided responding to that request in this BBB complaint.  Busy Beever has also not sent me any information regarding specific sales that my items are placed in so that I may see my items at the sales.  Busy Beever has their own website and does online auctions on that website, therefore again has no excuse to not be selling my items.  Busy Beever has not responded to me for 8 weeks.  They will not meet with me to see my remaining items.  I trusted Busy Beever to sell my items, to communicate with me regularly regarding sales, and to be honest about what is sold and what is left to sell - all of which are in their contract.  This purposeful avoidance by Busy Beever of not communicating with me and of not letting me see my items equates to theft.  They have taken advantage of a disable older person.
