The owner of the business took a thousand dollars as a down payment to install a fence in my back yard. I confirmed with him that the money was to be returned if he did not start the work. I have a written contract. He never came back to start the work, even after promising multiple times. Two months later, he told me he should have never accepted the job because he knew he couldn't do the work. He has given me countless excuses for not starting the work and for not giving my money back. Two months later, I have no money and no fence.Initial Complaint

We were quoted for a white vinyl fence and it was to be installed starting March 14, 2022. They didn’t come out until the 15th after having to inquire when they were coming. They came mid-morning, and did maybe 4 hours of work. The next day they didn’t come until mid afternoon and then did shotty work. The owners worker cut the wrong piece and then said he would just silicone it back together and then got angry with my wife when she called him out on it. They weren’t able to do the back part of the fence because he didn’t measure it after having walked it with his measuring tape. And then wanted to us to just use our neighbors fence that wasn’t even on our property. Wasn’t able to install the gate because he wasn’t given all the parts. He then rigged that part of the fence which fell the next day. Called him and he said he would come out and fix, he never came. We have sent several messages and he doesn’t respond. Now today we had a thunderstorm and it knocked down the complete opposite side of the fence, we have reached out to him and sent him pics of the damage and he will not respond and has since deleted and blocked all of our comments and pics.Business response

We didn’t start until Tuesday the 15th due to digrite not being out to have the lines marked, which I informed her the day of. We installed fence as discussed. During build she was confused by the back line not being out in, which I explained I didn’t have that on my estimate. I gave her a price with a discounted rate to help her. We went above and beyond by bringing our own materials over for her to use so she can let her dogs out free of charge. During the build we had a mess up with a post where we cut the wrong end. I explained to her that we can order another one and I would pay for it since it was our mistake. We finished the build with everything complete except the gate and post that we messed up. We didn’t have the latch for the gate and I explained to her that. We put this gate on, it could swing open and break the gate and the post. After everything she paid us for everything we did except for the gate and the post, which I told her not to worry about until we were finished. The next day her dad messaged me going over everything I have already discussed with his daughter and told me he would inspect my work. A couple days after he inspected it. The post we anchored into the wall magically came off and knocked down a section of the fence at which point I have been harassed by several people on something that wasn’t our fault.Customer response

I am rejecting this response because:
Missouri One Call was never requested to come out and mark lines. I have attached a transcript stating such. The fence was anchored to the bottom of the house, which is why it is still attached but not the top. We were never offered to have them pay for the post but only told one would have to be ordered because they had no extra pieces. The “discount” was $100 off labor AFTER being told they didn’t write down the right measurements.

The discount for $100 she is referring to is the back line, In which was never apart of the original quote. I gave them a discount due to the misunderstanding between us. As far as the anchoring into the post. There is a picture of the post that was posted that had a hole in the wall as well as the post but that picture has since been deleted. I did say I would order another post and I would pay for it since it was our error. I’m willing to pay back most of my labor money for a conclusion to this.Customer response
