On March 9th, Neely agreed to replace the **** in a rental we have. After some issues getting the initial payment mailed to him (wrong address delay) he arrived at the house to replace the **** and had an altercation with the tenant and decided not to perform the work. We mutually agreed to cancel the **** installation, however he refuses to return my initial payment only stating that he will be sending it. After several months I'm still waiting for my check.Initial Complaint

Paid in full up front in the amount of 5200$ in December 2023. For new heating and air units. He took my money and only completed 1/3 of the work. I have had some contact but very little and that little is him giving me the runaround. I have requested a refund for the work and parts and units that he never installed or came to complete!Initial Complaint

Neely mechanical services came out to fix my furnace. He said he didnt have the correct part to fix it so he would fix it a different way. He connected a wire that I have to pull off the furnace to get the furnace to shut off when the house gets too hot. He told me that he doesnt usually do it because it isnt a safe option but he was doing it to get us heat and walked me through the steps to shut it off. He told me that he would be back within a week to fix it the proper way when the part arrived and he never showed back up. Today, 3-27-2024 my house almost caught fire. The whole house was full of smoke and the fire department told me it was because of the furnace.Business response

With concern to this customer as I explained to them the night I was out there and earlier today on the phone that parts for that thing are not available from the manufacturer anymore and that I would do my best to try and locate a New Old Stock part or a used replacement part but with the understanding that that ******* needed replaced immediately as it is at this point in my professional opinion becoming dangerous as is obviously warranted by the fact that he said he had the fire department out there he is not paid me for a replacement part he is not paid me for service to replace the part he's only paid me for to come out and diagnose his furnace originally which I have done therefore his request for me to replace something is without validation due to the fact that I've yet to take money for anything or remove anything from the premises if he wants the furnace replaced then I am more than happy to replace the furnace at a fair and reasonable cost in line with pricing and availability of whatever system he may choose. And I would like to note that the furnace was manufactured sometime in the late '80s to early nineties making it 30 plus years old which makes the furnace Obsolete and therefore in the same nature the parts Obsolete and they're impossible to find which is what these Factories do do as a safety concern to keep these furnaces from continually operating and becoming a safety hazard to a customer again I've explained to the customer that this furnace need to replace immediately and he did at the time agree with me.Customer response

I am rejecting this response because:
You knowingly did something to the furnace that you knew was unsafe because you told me the day you were at my house working on the furnace that you dont usually do it because its unsafe. Yes, we did agree that I need a new unit. I cant afford $7,000 for a new unit. You told me you ordered the part that would fix the unit and would be back when the part came in. I never heard anything from you again.
As of now, I have let the gas company know and it will be red tagged because its unsafe.

1) you weren't paying attention a new furnace installed is only about $4000
2) now that you've informed the gas company and it's been red tagged there is no fixing the furnace it is now deemed unsafe for use. So now you have to replace it.
3) I'm not interested in replacing or doing further business with you because this right here is how you want to handle things. BUT I'd be happy to put you in contact with a number of good installers that are very fair priced, and get you the information for state assistance for these types of install needs and also companies that finance these installs as well.
4) since you neither paid for the part or the labor in advance I consider our business closed.

Was always late, and left hot wires open in our hous3 , no hotwater at all and charged us for heat strip never installed.... we had absolutely no heat or hot water in house, installed a gas unit outside and a electric unit in.....Business response

Customer is still in contractual default for $800. The customer is still in default for another $800 for electrical work that does not involve AC. There is no such thing as an outdoor gas unit. I have a signed contract from them that they are deferring the installation of the heat strip until another day to be determined. The hot wires I left open were in heat sealed boxes that had nothing to do with my install. Pre existing before I got there. I will readily admit that it is possible I did not turn the gas to the water heater. I will take fault in that if I made that mistake. I have on record 4 different times that they would not answer the door, so I had to come back at a later time. The complaint they made with the equipment manufacturer and text messages can show that they never texted me to complain about the job or to make things right, which I would more than happy to come out to fix...within reason. My resolution to them, I will turn over the heat strip they said I did not install and I will let the $1600 go.Customer response

I am rejecting this response because: we are not in default for 1600 dollars, and we had to hire an electrician to come out and fix the wires that were hot and covered in fire caulk. Never mentioned coming back to house to install heat strips..strip... why would u take final payment and put door on if u were coming back to install heat strips... I have the invoice that's says paid in full.... and all the text messages that u were at least 3 to 4 hours late for job several times.. you are not licensed in Joplin at all..... I have attached the text message about last payment..... the only thing he took off was around 360 dollars for a good review... which I did not give.... we have hired an attorney....how do u leave someone with no heat at all..... we do have all messages and the invoice that also states he was late..... this biz was paid in fulll... cash.... we had to pay another contractor to come out and fix the inside because the inspector told us our house cd of blown up or caught fire after ur finished work. We have hired a lawyer as well.....
