      On 10/9 I went wedding dress shopping at Something White Bridal Boutique at 3:00pm. After feeling some pressure from the stylist, I did end up putting a deposit down on a wedding gown. They charge a deposit of 50% of the total cost, which is much higher than an other shop I have heard of. That same evening after leaving the shop, I realized that I made is mistake and wanted to cancel my order. Email #1 was sent on 10/10 at 9:02 am- well under 24 since being in the store. I did not get a response to my request till 10/12 and the email chain with timestamps is included below. The transaction of $1459.28 officially went through my account on 10/12. In email #8, the owner states that I am unable to put my deposit towards anything else in their shop because the 50% goes straight to the designer in entirety however, in their cancellation agreement, it states that their boutique keeps the deposit for any "liquidated damages." I'm confused and want answers/my deposit if I am being lied to.

      To whom it may concern,

      **** ***** entered into a special order agreement with Something White Bridal Boutique on October 9, 2021 to purchase a wedding gown and veil. That special order agreement explicitly states in bold print that “ALL SALES ARE FINAL – No returns, cancellations, or exchanges.”  Notwithstanding, after Ms. ***** claimed she fell in love with a wedding gown at another bridal shop, Something White Bridal Boutique agreed to accommodate her request to cancel her order under the terms of the cancellation agreement signed by Ms. ***** on October 15, 2021.  That cancellation agreement released Ms. ***** from her obligation to pay the remaining balance of the purchase price and clearly states multiple times that Something White Bridal Boutique will retain the full amount of Ms. ******* deposit as compensation for its damages.  Something White Bridal Boutique denies that Ms. ***** was pressured or lied to in any fashion.   There was no misunderstanding.  Bottomline, Ms. ***** agreed to purchase a wedding gown from Something White Bridal Boutique after hours of trying on different gowns, thereafter Ms. ***** decided she liked a wedding gown at a different bridal shop better and, notwithstanding her written agreements with Something White Bridal Boutique to the contrary, Ms. ***** now believes she should be able to unilaterally cancel her order with Something White Bridal Boutique and receive a full refund of her deposit.

      I am rejecting this response because:


      First and foremost, my main question was not answered. I have said on multiple accounts that I do not expect to get my deposit back and just because I do not expect it, does not mean it would not be nice to get it back. I paid $1500 and have nothing in return! I understand what I signed and the repercussions of that. My understanding of that has been made clear with evidence of that in the email chain.


      That does not change that I was given false information, that of which you can see in the email chain that I sent with my initial request as well. Yes, the cancellation contract says that Something White Bridal Boutique retains the 50% deposit on paper - I want to know why I was told otherwise, that it does not stay within the shop but instead goes to the gown designer in entirety, when I specifically asked. What I was told via email when I explicitly asked (in hopes of getting a little something for my money), contradicts with the cancellation agreement and I would just like to know where my money is going and more importantly, WHY I was told something different regarding that. If the bridal shops defense to this is that this is all listed out in the cancellation agreement multiple times, then why was I told something different?

      Lastly, I get to decide how I felt during and after leaving that appointment and with all due respect, Ms. ***** ****** was not present for it therefore has no true idea the dynamic of it. The stylist I worked with was very nice but regardless, I felt pressured whether that was their intent or not and they do not get to decide otherwise for me.
