On March 11, 2022, I hired Above and Beyond Plumbing (hereinafter, “ABP”) to conduct a service call at my residence. During the service, I spoke with the ABP employee and requested a quote for a tankless water heater. On March 31, 2022, I received the quote to install a Navien 240a tankless water heater for $3,989.00. On April 1, 2022, I accepted and returned a signed copy of the quote approving the purchase and installation of same. Also, on April 1, 2022, I paid $1,196.70 as a down payment. On April 6, 2022, ABP employees installed a Navien System. Unbeknownst to us at the time, ABP installed a smaller capacity/less powerful version of the tankless heater to which we had agreed. Instead of the larger size Navien 240a, ABP conducted a fraudulent “bait-and-switch” scheme and installed a Navien 210a (Exhibit F). Not only did ABP install an inferior product, the product ABP installed, is defective. Since the Navien 210a was installed, we have had to call ABP to our residence to service the system three times. The first time was only 10 days after installation. In late-July, early-August 2022, we again scheduled an appointment with ABP. The appointment was set for August 2, 2022. It was here ABP identified that a part which controlled the heat fluctuation was dysfunctional and needed replaced. The part was ordered. Again on August 15, 2022, ABP had to come to our house to install the part they had ordered. We were again told this would fix the entire problem and we would not have any further problems with our water heater. Our system has once again failed. On multiple occasions throughout the last few weeks, we have tried to call ABP, as well as the owner, ****** **********, and have been met with complete silence. I have called no less than 10 times, I have emailed and I have submitted a message through the company’s website. No one has returned any of my calls or other forms of communication.
