***** requested $3000 from myself and my fianc as the down payment to properly repair our porch in September. We have a signed receipt from him for the amount and what it is for. The communication with ***** before we gave him our money was amazing. Once he got the money from us, he went off the map. Would ignore us for weeks at a time. ***** claims to have medical issues that has been preventing him from starting the job on October 9th as originally agreed upon. November 8th, my fianc messaged ***** that we would like our money back due to extremally poor communication and not starting the job yet. ***** has still ignored us and continue to claim, "health problems", but he claims he already bought the materials which does not make sense if he is having extreme health issues. Our porch is in very poor condition and could collapse at any time and that is why it is vital we get our money back so we can get a trusted contractor to perform the job.Initial Complaint

On 9/24/2022 I hired *************************, owner/operator of *****'s Construction and Repair, LLC., to install two concrete pads at my residence. The total cost of the job was $10,900.00. ******* required a down payment of $6000.00 which he received in cash (see included receipt from business). I signed no contract and was never asked to by *******. Some work by another company had to be completed before ******* could perform the concrete work. He was informed that the prerequisite work was scheduled in November 2022 via voice message on his work phone and a text message. He advised in November 2022 that the concrete work would have to wait until Spring 2023 to which I agreed. I received absolutely no contact from ******* regarding the start of my job between 11/2022 and April 10, 2023. In March 2023, I had a medical issue that required hospitalization so I decided against completing the concrete job. I called and texted ******* on April 11, 2023 and asked for a refund of my deposit. I received no call back from *******. I again called him on April 13, 2023 and left a message but received no call back. On May 1, 2023, ******* contacted me by telephone and stated he would refund my deposit. I waited for approximately a month but did not receive any refund. So I contacted ******* by phone on June 8, 2023. He stated he had sent a check for the full amount of the deposit to me through the U.S. *************** I told him it never arrived. He said he would check with his bank to see what the status of the check he sent was and, if it had not been cashed, he would send a replacement. That same day, I texted him my address just in case he did not have it on file. I have texted and called ******* several times and left messages on his work phone since June 8, 2023, inquiring about the status of my refund on the cancelled job. ******* has not responded in any way and I still have not received my $6000.00 refund.Customer response

** ********* of 2022 my home's basement experienced water damage. I hired a company to waterproof the basement. As part of that waterproofing I also hired *****'s Construction and Repair to facilitate the tear out and remodel of the basement. On May 30th, 2022 I sent *****'s Construction and Repair a check for the down payment. In late June 2022, ***** and another crew member arrived and completed tear out of my basement, which was done over two days. After ************************* finished their job on June 29th, 2022 ***** never returned to complete the rebuild. Over the remaining course of 2022 I attempted to contact ***** multiple times. On three occasions ***** returned my contact, each time saying he was delayed with personal issues. On November 1st, 2022 ***** contacted me, apologized, and said he'd be out the following day. ***** never arrived and continued to ignore communication attempts for the next two months.On January 13th, 2023 I submitted a complaint through ********** ************************** The ************************* was unable to make contact with *****'s Construction and Repair through numerous attempts.Business response

This complaint is being worked out as of now. I am sorry that it got this far. There are a lot of variables that came to play in this situation. I am still not ********************************************** being sick. I am normally fast and efficient in doing my work.
