We paid this company over $2000. The agreement was to remove all of the gravel beside our house and replace it with dirt. So we could grow grass. They left greater than 50% of the gravel and also damaged our house with a large piece of machinery. They are only willing to compensate us $300 for the damage to the house plus all the gravel that was left behind. That is disproportionate to the services paid for and renderedBusiness response

After initial job was preformed, client contacted me (******* ******) to remove all of the gravel that was initially put down. During removal of the gravel, damage was done to the property and client was contacted via phone call and made aware of it immediately. Client advised on the phone to not worry about the damage, but a $300 screened dirt credit for damages and remaining gravel was given. Credit is still yet to be claimed. Client was advised that the Skid Steer preforming the removal was still to big and that left over gravel would still be there. Client received a first responder discount on top of another discount for damages and inconvenience of left over gravel. A full load of gravel was put down for the initial job and a full load of gravel was taken away from the jobsite for gravel removal.Due to the client not wanting to pay hourly rates and to prevent further damage to the property, the contract was terminated. Client advised that they would have a different company finish the removal and they would contact us at a later time for the dirt credit. The amount of $1000 requested for the gravel removal is not correct. Client was billed $600 for both dirt pile removal and gravel removal. Client claims that the gravel removal was never provided, however we have provided photo evidence that it was. Client was only billed for 9 hours, but recorded time on the jobsite is 14 hours. The invoice that was sent to client has been provided.Customer response

Complaint: ********
I am rejecting this response because:
We paid over $2000 for work. We only received half of the services rendered. We are also currently reviewing our camera footage on property so we can add up all the hours that they alleged they worked. we have multiple messages stating “yes all of the gravel and dirt” I also have a supplemental invoice from someone that we paid to finish the job that they were unable to do. The invoice clearly states removal of all gravel and dirt. That was not the case. We also have multiple bids on damage to our house from qualified professionals. Every estimate on that is over $300. We do not want him returning to our property after he failed to finish the job the first time and damage the property. The $300 credit that he wants to give us will not even cover the damage to the house, let alone the gravel that he left behind and then dumped dirt on top of it. The first few pictures is how he left our yard after numerous times I have messages stating “all gravel and dirt” he literally dumped dirt over a better gravel in our backyard. I have a landscape professional who is willing to testify on either a notarized document or in person should disco further that him and his crew dug up large amounts of gravel in our backyard. They stated it was not removed and the dirt was simply dumped on top of it. I also have a supplemental invoice for the work that you see in the final picture in which another another company came in and finished the job that he did not. I am currently asking for half of the money back because only half of the job was complete. I was advised by a local news media that deals with consumer protection that she would do a report on the case as long as I submit a report to the Better Business Bureau and the ******** *******s office. I have done both. I have heard back from both I am just waiting on the response from Graves excavating from the ******** *******. Once that happens, the local news agency has agreed to talk about what occurred. It is not fair that they left large amounts of gravel, dump dirt over it and called it “job done.” This is my first step of doing what is right. I will take every legal step that I am able to to protect my rights as a consumer. At this point I have disputed 50% of the charge on my credit card. If they agree to that, I will drop what I’m doing. If not I will do everything within my rights as a consumer such as small claims court‘s, local news media etc.
Sincerely,
***** ****
