On November 24, 2022 I paid Col-Yer Tree care $6,275 to install a French drain, downspouts, connectors and remove a tree at the following locations in *** ******* **: ***** ********** *** ***** ********** **, and ***** Tanglewood Rd. The work was that was done was of very poor quality and did not resolve water pooling issues in the yards. I have contacted **** numerous times to have the problems fixed and he’s unable or unwilling to do so. Prior to having the work done, he guaranteed his work; however, after the work was done, he stated that “water is going to stand no matter what.” He should have mentioned that before I paid him to install a water mitigation drain. He personally told me he would guarantee his work and the drain and downspouts would take of the water issues. On May 2, 2023 I asked him to call me about the the poor workmanship. He has yet to contact me.

      ********** ********

I am rejecting this response because:
Col-Yer Tree Service was given many opportunities to fix the problems. I don’t trust that he or his company has the skill or expertise to fix the issues to my satisfaction.

We are going to small claims court.  He said he is going to fix it but we don't think he is capable of fixing it.

As a follow up to our conversation last week, following are details from our court case against Col-Yer Tree Care of Lake Ozark, MO.On September 6, 2023, the 25th Judicial Circuit Court of Pulaski County ruled in favor of the plaintiff and against Col-Yer Tree Care in the amount of 4277.50.  Photos were provided to the judge which indicated the drainage/water issues that Col-Yer claimed to have fixed, were in fact, not resolved.Thank you for updating the information on the BBB website to reflect the outcome of this case.  Please contact me at ***** ******** if you have any questions or need additional information.

On June 6, 2022 we hired **** ******, the owner of Col-yer Tree Care LLC to fix ruts in an area of our gravel driveway and add gravel to the entire driveway as well as clean out 3 culverts that are under the driveway. And to add a couple railroad ties and attach them right above the culverts - total cost of $6000.00. We have a few acres section full of trees. We didn't hire **** to do that but since that is his main business he offered and said he would do all of it for $2500.00 more, so we agreed. The way **** "fixed" the ruts was to dump big, chunky rocks on the driveway. We can't drive over giant rocks like that. **** and my husband got into a big argument, both yelling and cussing. **** left it that way. Now my husband cannot mow or weed eat the grass on both sides of all that rock. **** said to just use weed killer. We have well water and we do not use any chemicals on our property. **** should have told my husband exactly what he planned to do and he refused to do so. We have a few acres that are covered in trees. For an additional amount of money, **** said he would take care of cleaning up the entire area. Well, he didn't. Before the driveway and the trees were done (he kept going back and forth between the 2 projects) **** asked me to pay him so he could get the money to his bank and when he got back he would finish. He seemed honest and trustworthy and his mother was sitting there (he had ***** pick her up so her and I could meet) so I agreed to go ahead and pay him, especially with his mother at my house. My husband saw the driveway and was really angry at the mess it was in. **** told us he would finish the job. On July 1, **** texted **** and apologized. **** responded and said he would come back out the week of July 5. Since then, we have left several phone messages and **** hasn't responded. On August 17, 2022, I saw and spoke to **** at the gas station. He said he would come out on Aug 18 and take care of things. He didn't show up or call.

I was hired by the ********* to fix their driveway and their culvert issues. We had agreed on bringing in 3 inch rock and putting base rock over the top to build up the road. From previous rains their driveway was washed out in multiple places. The rock was delivered two days before I started the work and nothing was said about the rock being too big. So I started putting down the bigger rock and *** ******** said that **** ******** would not like this. was the only way to fix their driveway without putting in a concrete driveway. So I spent an additional two hours trying to And nothing was said about the rock being too big. So I started putting down the bigger rock and *** ******** said that **** ******** would not like this. Even after agreeing that this was the only way to fix their driveway without putting in a concrete driveway. So I spent an additional two hours trying to fix the problem And after putting the base rock down as you can see you can definitely drive on the driveway.
One thing was left out was how hysterical **** ******** was. She came out the second day and was crying hysterically shaking. She said she hated her life and she felt like she was in prison on her own property. She said she did not have any friends because her husband would run them off. They had just lost their son the previous year and so I spent some time talking to her and praying for her. We finished the road driveway and fix the culverts and dug out all of their creeks leading to the pond. I then spent an additional three hours cleaning out the edge of the pond from drainage issues that was not part of the deal and removed two large stumps that a previous contractor had left all for free. I would of charged 1750 for this. After seeing *** ******** blow up and he started talking about guns. This made me very uncomfortable being a combat veteran. We talked extensively about the job when it was finished. He understood that this was the only way to fix his driveway unless they wanted to get a concrete driveway. I asked to be paid in full and he did so. When I’m finished with the job I asked to be paid in full upon completion and satisfaction of the homeowner. I never asked for any money upfront . He then paid me info and and. Regards **** ******
