      I am writing to express my deep dissatisfaction with Bella Landscape & Construction, LLC. I engaged their services on June 16th, 2023, and unfortunately, I find myself in a situation where the promised work date and the communication from the company has been extremely lacking and unorganized. Prior to signing the contract, I had specifically requested a lien waiver as a precautionary measure. At that time, I was assured by the company representative, ***, that a lien waiver was unnecessary, citing Bella's policy of paying their suppliers before commencing work. Based on this assurance, I proceeded to provide a down payment of $1500 to initiate the project and secure a proposed start date. Initially, I was informed that the project would commence within 4-5 weeks from the contract signing date, with a projected start date of July 27th. However, as this date approached, I reached out to ****** via email to request an updated timeline. I was informed that the project would be rescheduled for the second week of August, attributing the delay to inclement weather affecting their other ongoing projects. Subsequently, as the second week of August concluded, I once again contacted ****** for a status update. Regrettably, I was informed that due to further delays with their other projects, a new start date could not be provided. Only on August 24th, after repeated attempts to contact the company, did I receive information from ****** that the crew would be on site on Monday, the 29th of August. To my utter dismay, the 29th of August passed without any progress or communication from Bella Landscape & Construction, LLC. I made numerous attempts to contact the company via email and phone, but my efforts were met with silence. Despite explicitly requesting a refund in the absence of any completed work, my requests have been blatantly ignored. At this juncture, I find myself in a distressing situation where I have paid a substantial sum of money for services that have not been provided as promised. I am left with no recourse but to seek resolution through your esteemed organization. I kindly request your intervention to mediate this matter and ensure that Bella Landscape & Construction, LLC fulfills their contractual obligations or provides a prompt refund for the services that were not rendered.

      On Wednesday, September 6, 2023, I received a call from ***, the current owner of Bella Landscaping and Construction, LLC. During our conversation, *** explained that the fence project had experienced delays due to the bankruptcy of the logistics and transportation services responsible for delivering the fence. This explanation was surprising to me because ******, the co-owner of the company, had consistently attributed previous missed installation deadlines to adverse weather conditions and staff shortages resulting from employees being assigned to other projects over the past few months.
      Additionally, *** expressed frustration with the vendor and logistics and transportation services, stating that they seemed unaware of the fence's location. He assured me that he would reach out to them and promised to provide an update the next day.
      Unfortunately, the following day, I informed *** *hat we were no longer interested in proceeding with the fence project due to the lack of communication and the false information provided. I had lost confidence that the job would not meet my expectations, especially considering that we had reported this dispute to the Better Business Bureau.
      Given the circumstances, I believe it is only fair to request a refund of my payment. *** explained that he would not issue a refund until he received reimbursement from the vendor. In case a refund cannot be provided, I kindly requested a copy of the signed contract explicitly outlining the no-refund policy for deposits or specifying that refunds would not be processed until their establishment received payment from the vendor.
      Later that afternoon, *** called me again and informed me that they had not received any response from the vendor despite multiple attempts to contact them. I mentioned to *** *hat a strained relationship with the vendor further supports my case for a refund. He said he would discuss this matter with ****** and promised to get back to me by 8 AM CST. Unfortunately, I did not receive any communication from him, so I attempted to call him myself but received no response.

      On May 9, 2022, Bella Landscape & Construction LLC was conducting work at my neighbor's home (727 *******************, ******, **). Shortly after starting the work (within a couple hours), the co-owner of Bella Landscape (********** Partner) was driving a piece of machinery that tipped over and the brush that the machine was carrying fell against my home and scratched the siding of my newly built home (719 *******************, ******, **). I confronted *** and asked if he was O.K. and he said yes. After he confirmed he was alright, I looked at where the branches fell against my home and saw the scratches to the siding. *** apologized, said it was his fault and that he would take care of the damages, and to get him an estimate for the work.On May 19, I emailed estimates (from accredited companies) to Bella Landscape to repair the damage. Based on estimates, total cost to repair the damage was $925. There were 2 estimates - 1 estimate from a ************* (********* Radon) to uninstall and reinstall the mitigation system as this goes over the siding that was damaged ($600), and 1 estimate from a ************************ (***************************) for the siding work ($325). I requested payment be provided to me by May 23, 2022. Bella Landscape responded with the following: We just consulted with our attorney regarding this matter. Per our attorney, you need to submit 3 different estimates from accredited companies to us and we will pay accordingly. With that, they need to be hard copies or scanned. Email conversations will not be accepted.On May 26, I emailed 6 estimates (all from accredited companies) to repair the damage. The estimates included the original 2 submitted, and 2 additional estimates from Roofing/Siding companies and 2 additional estimates from Radon companies. I requested payment be made on May 30, in the amount of $925. As of May 31, I have yet to receive payment.

      I have spoke to the company and they told me they would refund me as long as I cancel the complaint.  I wrote them back and told them I will state that a proposed resolution is in progress with payment pending on 6/6/2022.  At this time, I will consider this a closed matter and resolved.
