      On 9/7/22 my husband & I put $2700.00 down on a 2007 Nissan Pathfinder at Auto's Unlimited. When we signed the contract we told ***** that our first payment would be late so that we could get the vehicle legal & the title sent off, ***** said that'd be fine. On 9/30/22, we paid $548 to get the vehicle legal. On 10/30/22 around 1 am, I looked outside after hearing a noise & seen a tow truck backed up to my car. I went outside & asked what they were doing, they informed me that I was in default & that Auto's Unlimited had sent them. I told them we were not in default & hadn't recieved anything from the dealership & offered them the $200 payment. They informed me they couldn't accept money from us, I asked to see what paperwork they had & was ignored. They told me if I gave them the keys I could get my stuff out. I went inside for the keys & called my husband. He said that they couldn't take it without Auto's Unlimited going through the legal process & to stall them because he was on his way with the statue, so I sat in the vehicle. S & T Police showed up the same time my husband did. My husband showed them the statue & the repo man said he'd been doing this for years & it was perfectly legal. One of the officers walked over to me & said, "Let's get out of the car, so they can do their job". I told her that we hadn't seen any paperwork, she walked over to the repo man & returned with a copy of the title application. I told her we hadn't recieved anything from the dealership & that we had they payment, she said we had to let them leave. The next day, I called Auto's Unlimited & left a message. An hour later, I went up there & had a 20 minute conversation with *****. I offered him the payment & he said that he has no say & between my BBB complaint last time we bought a car & my husband threatening to sue the night of the repo, the owner wants the remaining $3800 owed on the car. He stated he sent notice on 10/24 & called all week, which is a lie. We have proof he didn't.

      I am the manager of Autos Unlimited, but not the owner of the business.  I am writing to respond to complaint no. ******** ***** ******.  I have enclosed copies of the front and back of the security agreement and the title application indicating Autos Unlimited as the lienholder.

      The vehicle was sold to the ******** on September 7, 2022.  The first payment was due on October 7, 2022.  After the first payment wasn't received, a letter was mailed out indicating that fact.  I made numerous attempts to contact ***** and ***** on the phone numbers they provided the week prior to having the vehicle repossessed due to their defaulting on the contract.  After the vehicle had been repossessed, ***** called from the number I had from her and claimed that * ****** had problems the previous week.  The night of the repossession, they gave their key to the repossession company and were able to get all of their belongings out of the vehicle.  If there is anything left in the vehicle that belongs to them, we have no interest in it and we will bag the items and have them available to them within approximately 24 hours.

      To Whom it May Concern,
       A security agreement and installment contract was signed by ***** * ***** ****** for the 2007 Nissan Pathfinder on 9/7/2022.  In that agreement, it states that they promise to pay $200 a month on the 7th of the month for 19 months beginning 10/7/22.  The contract also states that they would be in default if they did not perform any obligation that they have undertaken in the contract.  Upon default, the remedies, including repossessing the vehicle is also listed on the installment contract.  The first payment was not made on or before October 7.  I had received zero communication from either of them explaining why they hadn't fulfilled their obligation under the contract, so a letter was mailed to the address on file the following week.  Approximately a week  later, after not hearing from them, I tried to call both of their numbers they had given to me and got no response.  At this point, due to the defaulting of  the contract and in order to protect our rights as the lienholder, paperwork was issued to a repossession agent, and subsequently, the vehicle was repossessed.  Immediate messages were left on our voicemail, indicating threats of legal action, etc.  At this point, we deem it to be in our best interests to no longer finance the vehicle to the customers that are threatening us simply because they failed to perform their duties under the contract.  When ***** came in the following Monday, I explained to her that they would need to pay the vehicle off, and gave her some examples of other lending institutions they could try to reach out to in order to help them achieve that goal.  I also told her that I had been trying to get in touch with them the prior week on their phones.  She immediately told me that T Mobile was having problems and that's why I couldn't reach them. The simplest solution for not getting to this point would have been to make the payment that they had promised to make in a timely manner, or they contact us to explain why they weren't able to.  That did not happen and is not disputed, and is why the vehicle has been repossessed.  I hope this information will help in bringing this situation to a conclusion.
