I bought a Car from here 2 months ago. They gave me a title, but it was not the right title. Now they are telling me I have to wait 7 days to get the title they should have given me in the first place.Business response

He's right about the title. We did give him the title but we didn't know the previous owner requested a duplicate title. We told the customer we have requested a copy of the title and it should be back this week. The customer returned the car and he got his money back.Customer response

I am rejecting this response because: No i did not get my money back after a million tinted of asking they offered me a new car that I still am yet to get cause it was a crack in the windshield which wouldnt pass inspection. They say they are waiting on ************ that was Thursday Im still waiting

Paid $300.00 Deposit for purchase of used truck to hold while securing financing. Used the financing recommended by dealer. Once financing was approved, I requested the all transaction documents to be signed at closing including sales contract, financing terms, title, etc.) prior to my arrival for review ahead of time as agreed (since the date date we were to close we were working late and would only have 15-20min before dealer closed). Issue: Dealer refused to send any documents We called finance company, they refused to send financing documents and Fiance company stated sales documents are at dealer. The deal did not go forward since we never received the transaction documents to review. The dealer refused to return the $300.00. The truck was sold immediately after The dealer breach the deal by not providing the transaction documents to review prior to closing the transaction. Dealer did not provide any transaction documentation, no financing terms, etc.Business response

The customer left a deposit for a vehicle, we told them deposit is not refundable . We waited for more than a week , we contacted them multiple times but no answer. They got approved for finance, but for some reason never called us back, nor they replied to our emails or callls .the vehicle was not sold right away, we wanted them to buy the vehicle , but we thought they changed their mind since they never called us back .
here is a copy of the deposit recipe clearly mentioning that deposits are not refundable.Customer response

My Response to these key points:
· 1. “we told them deposit is not refundable”
Response:
We are not challenging the fact that we understood the deposit was non-refundable.
We state that the agreement is null and void because the dealer did not enter into this agreement in good faith and had no intention of honoring the agreement.
And as a result of us accepting the agreement, the dealer (by their actions/inactions) showed no interest in honoring the agreement since they had the funds in hand.
· 2. “We waited for more than a week, we contacted them multiple times but no answer”.
Response:
This statement is a lie.
I challenge the dealer to prove this claim.
We did not get any calls. We never received a VM from the dealer.
The dealer alleges they contacted us multiple times but no answer, however by this statement they also admit to leaving no VM. If the dealer did in fact call multiple times, produce the phone records proving multiple calls (but receiving no answer).
· 3. “They got approved for finance, but for some reason never called us back, nor they replied to our emails or calls”
Response:
As we have stated, Aarow Finance was their finance company. We had no knowledge of this finance company. We were referred to Aarow as their preferred finance to turn the transaction around quickly as the agreement was, we had to approximately three (3) days to secure firm financing and close the sales transaction.
4. In addition, the response from the dealer does not address the merits of our complaint:
ü That the dealer’s alleged multiple attempts to contact were in response to the finance approval.
ü Once financing was approved, I requested that all transaction documents to be signed at closing including sales contract, financing terms, title, etc.) prior to my arrival for review ahead of time as agreed.
ü The response from the dealer does not state whether the transaction documents to be signed at closing including (sales contract, financing terms and agreement, title, inspection, etc.) were ready for signature; and
ü that the transaction documents were emailed in advance for our review; and
ü Since the dealer had our email address, why did they not send an email (after multiple attempts to contact but no answer, especially if the deal was ready to go forward, or if they were about to cancel the transaction.
ü The deal did not go forward since we never received the transaction documents to review.
ü The dealer breach the deal by not providing the transaction documents to review prior to closing the transaction.
ü The agreement is null and void because the dealer did not enter into this agreement in good faith and therefore, had no intention of honoring the agreement.
ü The non-refundable agreement implies failure to complete the transaction due to our actions. There is also a Good-Faith due diligence expectation that requires the same from the dealer.
ü The dealer had a duty to enter the agreement in good faith (since we demonstrated our good faith by providing the deposit under their terms).
ü The dealer had a duty to good faith due diligence once they became aware of the financing approval, by exercising good faith measures to ensure the transaction could be completed. The dealer failed to deliver the good faith due iligence after having care, custody, and control of our deposit that we agreed was non-refundable.
