      I hired this company to do a variety of work. Some of the work he did himself, other work he contracted out. The subcontractors have not complete the work. I paid him $12,000 electronically. I've had another contractor come out and say that this contractor frauded me out of about $7000 for the floors. The work was done sloppily and I have to have them redone. I've incurred other costs to have the work redone or demo'd.

       Originally, we came in for a estimate on epoxy flooring in her basement. Upon arrival customer pointed out the 4 post beams in basement, concrete humps, and the drain, all of this she stated, “she wanted not visible”. My contractor and I advised that we would be able to create built-in shelves to hide the humps and the drain. I explained to client that the basement flooring was incompetent of getting sanded because it was covered with asbestos which could cost her an additional $10,000 to remove. We also informed client about another option of poured self-leveler over the whole floor to make new fresh concrete. After informing client of other options, she preceding to sign a electronic contract.   We came back in once client was available and framed and drywalled the shelves. The floor was completed after the shelves was completely framed and drywall which took 3-4 days to complete. At this point the client could’ve decided not to continue or add any additional suggestion.  My contractor (not subcontractor)and I confirmed with client is this what she wanted and she responded “yes”, I informed client that this will be a perfect time to add anything or take something out she stated “no”.  The client added on another contract to do trim work in the basement and baseboards and added drywall work and then she added to build a closet upstairs that needed electrical work which was subcontracted out through me.  Also, a bathroom which all work was completed drywall framing two coats of mud it was just needed to be sanded when return to the job and it was brought to my knowledge that she wanted to demolition Built in shelves which was 85% done told her that will open a can of worms when I return to the house it was already demo. I tried to settle with client to get her out of the contract because at that point she defaulted the contract because we couldn’t finish what we originally agreed on because the work was removed by someone else. I even helped her out with a plumber, and she defaulted on the last portion of payment.
       I am asking for the full amount which is owed to me for the bathroom the closet the framing of the built-in shelves, trim baseboards. She allows other contractors to come in and make her think something was done wrong which I have footage of every process of the job that she wanted in her contract and then she decided to take the built in shelves out of the contract. Whoever removed the work that I completed didn’t care how it was removed. During the removal of the shelves and drywall the floors were damaged by nails and screws. Which my photo will reveal.

      I am rejecting this response because: The work was incomplete and the partial work that was somewhat completed was unprofessional done by UNLIENCED SUBCONTRACTOR HIRED BY Mr. *******. First please have Mr. ******* remove my home from ALL his social media, since he never asked, and I didn’t give permission to show my home. There is so much to this story, and I will try to sum it all up from what I recall. When I first met with Mr. ******* it was for a floor bid to do epoxy flooring in my basement. During our conversation I was explaining to him how I have had so much bad luck with contractors and giving my money away for bad work. I expressed to him my frustration that I’ve had in the past and just wanted a few more updates to my home. He went on to show me pictures of his home and what he could complete and who he knew to complete certain jobs.  I did a walkthrough of my upstairs explaining things that I wanted done as well as a ½ bathroom in my basement. At that point he said he could accomplish everything I wanted done. He went on to say regarding the floor it might cost me around $6k-$7k, but he would go home write everything up and send over a contract/agreement. He mentioned to me about the 4 support beam bumps in my floor as well as a drain on my basement floor. Basically, stating that he could create some type of enclosed boxes so that he can level the common flooring and the epoxy would stop at the even drain line, which would cover the support beams as well as the floor drain. I went along with the idea because I later said I could possibly make them out of book shelving. I am a woman not a contractor nor a floor expert. I didn’t ask for the un-useful boxes to be created at that moment, HE did. It was his idea in my opinion to make his job easier. Once these boxes were built, I never liked them due to them taking up too much useful space in my basement. At one point the contractor, Mr. ******* and myself were looking at them and I was not in favor of the look, but Mr. ******* assured me that they would look good and to trust him, so I did. Weeks later the more and more I was seeing the boxes, I was not in agreement with them. At this point no more work is being completed, so I mentioned a contractor that could meet us and we get a price for him to finish the work. Due to Mr. *******’s subcontractors not showing up. After the meeting Al gave his price to demo the boxes (which I paid for $250.00) because Mr. ******* acted as if it was my problem. I’m so glad I had my hired contractor to remove the boxes because it was trash and materials still in there on my floor. They (his hired contractors) used these boxes as trash cans, and on several occasions, I requested to Mr. ******* not to forget to remove the trash, that I could see while they were being built. Of course, he said don’t worry he will take care of it. Me not being on the job site to watch them, the clean out never happened. I’m not know all the other trash that I couldn’t see in the other boxes due to him putting the drywall on top. Mr. ******* had no intention of completing the unfinished work, nor the completion of the Epoxy flooring that I was displeased with. The more and more I saw the floor the more and more I saw the sloppiness of the work as well as the floor design was not what I had in mind. There were bumps and bubbles in the flooring, spill overs in my doorways and no clean finishes.  I had another company come out to try to fix what was done and was denied (letter attached). This company stated that there was way too much material on the floor and that the floor was not prepped correctly. We conferenced in Mr. ******* to see what was used and he was very rude to the other company’s employee and didn’t want to say what product was used nor how he prepped my floor. He did not use a Dimond sander which was one of the reasons I was denied a fixer upper. The machine from what I’m told is about 800 pounds and wouldn’t make it down my basement steps. Which further lets me know the floor wasn’t prepped correctly. With the boxes out, the floor was coming up in spots that the boxes where not nailed down. Which leads me to believe I could have had huge problems in the future with this floor not sticking to the leveling agent he put down. You will also see with my new vinyl floor this professional cut around the beams, put trim and quarter round down. Once the boxes were demoed correctly this was the worse work I’ve ever seen, as you can see on the photos. The other side of my basement floor is damaged also with epoxy drops due to Mr. ******* not cleaning after himself and not caring about the other part of my concrete basement floor. He was not coming back to correct the floor after the boxes were removed, nor the incomplete work for the ½ bathroom, and upstairs. My reason to believe this is he had a pair of special epoxy spiked shoes in my basement since May and he took those shoes the last day we met which, was on 7/12/2022. At this time, I will NOT give payment for unfinished work that I NOW must pay another contractor, plumber, and an electrician to complete. Per my bank, $14,529.00 was paid to The Ceramic King in addition to the new contracts that he didn’t finish (bathroom basement, wall upstairs, and closet upstairs) I will be out of additional funds due to his unprofessionalism & lies. The unlicensed plumber was paid $1,400.00 with an original verbal quote of $1,900.00. I had another person to give a quote of $2,500.00 and Mr. ******* said that was too high. I found out both queots were a bit expensive for the quality of work that was done. I paid TOP QUALITY PRICES FOR LOW QUALITY OF WORK. A day later Mr. ******* comes with the price of $1,900.00 from someone he knows to do the plumbing. This agreement was not fully completed, and I feel I’m owed money back especially for the floor. I paid this $7,100 in full and the boxed were not completed which was a part of that contract/agreement. I asked for the plumber information to discuss the $500 balance that was due when the job was completed. The balance of $500 was to be paid once the toilet and vanity was installed, this never happened, and I paid over ½ the $1,900.00 to Mr. ******* for the plumbing. I had to pay someone with a truck to pick up the toilet and vanity from Home Depot, and this cost me $50.00. I believe I was not given the plumber’s information due to Mr. ******* not paying him the fair share of the $1,400.00. These people he had in my home looked as if they had drug problems, and I know regret to have them in my home. There was electrical work incomplete as well that I am in the process of having rewired due to the bad wiring. I now have a licensed electrician to complete the work professionally and correctly per code standards. It has come to my attention also that Mr. ******* bad talked my contractors such as my licensed electrician so that he can get the job and my money for him to subcontract out. He acted as if he had my best interest at hand when he was the one taking advantage of a single black woman. I had an estimate for $2,500 from a plumber, and Mr. ******* came back with a bid of $1,900. The plumber and his female helper, looked to be on narcotics, I am ashamed to say. I owe $500 on this incomplete job. I had to pay someone to pick up the toilet and vanity that cost me $50. Mr. ******* talked bad to my plumber and electrician so that he can get the job and pay little or nothing to the type of people he hired for the job. The work was horrible and again the boxes were his idea. Mr. ******* didn’t know how to address the support means nor the floor drain which every basement has. Mr. ******* has been paid for more than 50% of these jobs that I now must pay someone else to complete. The electrical was ALL wrong and was rewired due to a fire hazard to one of the plugs in the basement. One of the electrical ceiling ports in the upstairs “closet area” is also incorrect. I have a company that denied fixing the epoxy due to the wasted material that was used and the floor was not prepped correctly. I have the new floor installed that took less than 2 days, that cost me $4,474.96 and I am very satisfied with the outcome. At this time, I don’t have the final cost for the electrical work that has to be done, but I can supply that later, since the electrician started today 8/2/2022.The contractor cost was $2,075.00 for all the incomplete work Mr. ******* didn’t finish. I have attached photos, and contracts. I have plenty of photos and videos to support these claims. Again, I am owed money back and I can’t put a % on incomplete work. I paid out over $14,000.00 to a man that I have nothing to show for.

      Everyone that was at her home worked for me. She has not paid me anything. I did the job. She had another company company come out and work on it and removed some of the work we did. At this point, she is just trying to make me look bad. We can go to court if she wants.

Original start date 8/16 pushed back (due to cabinet production delay) to abide by four-week timeline Contract manipulation Made contract modifications without both parties’ agreeance and acknowledgment (Changed timeframe from 15-21 to 6-8 weeks, Payment arrangements Never received detailed material list before the start of the project per contractual agreement. After demo a payment was made the invoice was changed by ** with only the acknowledgement of the payment not the changes.Agreed to additional flooring projects prior to start (8/16) was complete in less that 4hours this did not extend or delay project his inability to work did. he Mislead us about having a skilled crew, timeframe .On average of 3-5 hours per week of labor performed by ** and less than 15 hours a week by ***** I questioned process, timeline, crew .There was never enough work being done at any given time; owner voice this concern several times(see screen shots).Paid for said complete work and was not/still isn’t completed ** reassured home owners that the job was going to get done, excuse after excuse came. Work was and has been incredibly inconsistent. ** is aware and apologized and on 12/2 wanted to make it right by offering a refund for incomplete work that was paid on 11/15, advised owners he was inroute but never showed up. ( ** Claimed hospitalized )12/6 he decided he didn’t no longer want to refund us and that he would complete A PORTION of the work to meet deadline, home owners requested that he complete prior work in home before starting new project. ** advised that he wanted to do things his way, home owners voice opinion that nothing has been complete.** told owners via text this his project and he will do It how he want

      ***** ******* the owner of The Ceramic King hereafter referred to as **, was hired after assurances that he and his team of skilled contractors could complete the job. In an effort to make sure ** and his team did not overcommit while doing this project we (the ********) made it very clear that he was to only start after other preexisting projects were finished, scheduling our job out months in advance. The original and only signed contract refers to a 15–20 business day completion timeframe for this reason. Even still he overcommitment which led to the job not being completed in the agreed timeframe, sloppy work because of rushing or getting things done to quickly, costly mistakes and referring to a substitute company he just so happened to find to help meet the completion date.

      Although we know it is common for contractors to work simultaneously on a number of contracts, we were assured that this would not happen with our job, now it seems that ** is more concerned with chasing another contract payday and the completion of his own project than the fulfillment of his existing commitments with us.

      The crew was not properly outfitted and seemed to struggle with the job. The ceramic king and team constantly needed to use and borrow the owners’ tools, ladders, wheelbarrows, tarps, shovels, buckets, etc. and did so most of the time without asking; and on one occasion a crew member was told to “just use the owners nail gun” after ** sent another crew member to gather tools for a different project. The inexperience of ** and his crew is what we wanted to avoid, being that this is the most important quality when we decided on a contractor. We were promised someone who had sufficient and relevant experience for the kind of work required. However, more often than not ** was forced to micro-manage crew members so that the task would be done seemingly proficient. All except one of the crew members appeared new and lacked the necessary skills to do the job well, as a result they were only tasked to demolition and light duty jobs like handing over tools or additional materials. The proficient crew member mentioned that he does 80% of The Ceramic King’s jobs and that most of the jobs are smaller in scale compared to our project.

      This innately causes a dilemma, not only is there merely one skilled contractor who is spread thin, the hired contractor does not show up routinely and when he does it’s only to do very minimal work. Just enough to keep the job and say that he’s been there, and then he disappears. We have mentioned this concern to the contractor and when he finally comes back, he does a little more then disappears again but never quite finishing anything. He would even make up excuses and say we need to go to the store for parts, supplies, or materials and while we’re gone to fiche it, he leaves, or wait until we run to pick up the kids from school to leave out right after us. ** averaged 3-5 hour per week at the job site (and some weeks none at all) and his lone skilled crew member averaged 10-12 hours per week at the jobsite. Manly showing up late mornings and in the afternoon. ** will now say that there were outside sources causing delays to the project, but this is not accurate. The devotion to showing up to the jobsite, enthusiasm to preforming the work, and skills necessary to make it all happen were absent, and so was he. Neglecting the project and not meeting progression milestones were by far the biggest contributing factors to causing delays and missing the deadline

      Additionally, his inexperience came to light when we were given instructions on how much material to buy. By this project being fairly large we wanted to only purchase the things that were necessary in the quantities that were necessary. ** informed us we needed to purchase an additional ten percent for


      scrap pieces, which we did not have a problem with, nor did we question his measurements at the time of purchase. After the wall tile and flooring were done, we had a tremendous amount of material left over which equates to thousands of dollars that did not have to be spent. Not knowing how to measure the space correctly led to a gross over purchase of material. More specifically the wall tile cost us over

      $200 per box, and we had seven boxes and a few whole pieces left over out of the sixteen we bought. Even worse ** put the tile up wrong and then left, so that when the owners returned home to see the mistake ** had to call another crew member who was about to leave to remove the tile and scrape the mortar off of the wall and the backs of the tiles. In trying to fix **’s mistake the crew member had to use an additional five boxes to redo the tile wall ultimately costing us time, labor and money. Furthermore, the floor tile is uneven and has created multiple trip hazards around the house, which ** said he would fix in November and has yet to do so; this will cause for additional use of materials as well.

       

       

      Cleanliness was a problem throughout this undertaking or rather the lack of cleanliness. From the start of the project the only effort made to preserve the clean environment was by poorly placing a plastic barrier between the kitchen and a room off the kitchen. This was done during demo but served more as a visual blockade than stopping dust or any other particulates from passing through. ** and his crew worked in almost every room on the main floor and around the house, (the kitchen, laundry room, dining room, living room, two bathrooms, garage, driveway, back patio, back yard, and front yard) and left their workspaces a mess. While maintaining this untidy approach they also manage to track dirt, sawdust, drywall dust, joint compound, grout, mortar, etc. throughout the house, on the walls, doors, handles, floors, pavement, bricks, grass, flower beds and more. Instead of using the table saw outside to cut the pieces needed to lay the floor they did so in the garage that stores furniture from the house, food items, new and old appliances, the new kitchen cabinets, tools, and a classic 1969 Mustang Boss 302 that we were not given the opportunity to cover up before they decided to use this as a workspace. ** and his crew displayed even more disregard after the owner requested that the wood flooring not be cut in the garage by cutting them in the house. The dust was everywhere, and we were forced to change out the filters in all three furnaces and hire a heating and cooling technician to service them for $750.

      The wet saw for cutting tile has stained the back patio, they splashed mud and water on our appliances, smoker, BBQ grills and siding. Not only were they leaving the house in disarray we had to remind them to pick up and put up their tools and saws after using them and after our one-year-old son decided to play with them. We constantly picked up chip bags, soda cans, cigarette butts and all sorts of clutter from the jobsite. When we asked a crew member why he is not cleaning up after himself he told us **

      yelled at him stating, “you are my skilled guy, I don’t pay you to clean up” however no one else showed up routinely to clean. The project progress was so far off schedule that he only filled the dumpster halfway after being rented for two weeks, also leaving a wall oven in the driveway that wasn’t taken away with the rest of the demo. From there they would place any remaining trash or waste into my waste bins or in the bed of my pickup truck for me to haul away.

      ** is often late or doesn’t even bother to show up to meetings set by himself or the owners, which a is big indicator that he doesn’t know how to manage his time properly, thus not capable of managing the project appropriately and did not stay true to the timetable allotted for this job. Furthermore, the contractor is avoiding conversations and questions by doing this. By beating around the bush this shows the lack of professionalism and problem-solving abilities and is a red flag that ** is not up to the task.

      Even when important topics need to be brought up, we’ve had to do so over the telephone because he


      does not make the time to meet up to discuss the project nor does he allow us the opportunity to show him our concerns. This has not been a very effective way of communicating with the contractor and has led to several errors. It has been a challenge to work with ** do to his poor interpersonal skills and social skills, any concerns or critiques are met with opposition making him a difficult person to deal with. But instead of voicing how he feels to us he turns to social media as his outlet, knowing that we can or could see the negative post.

      We have been overly patient and accommodating regardless of the lack of work that has been completed, the inconsistent work schedule, and tradesmanship of the contractor. ** was not blind to the fact that he was not performing to his best ability or to the standard he told us he could. Knowing this he offered two possible solutions which included giving us a partial refund for the flooring and trim, as well as bring in a third-party sub-contractor to place the cabinetry and help meet the deadline. We were on board to entertaining these ideas, but he never showed up to this meeting the was called by him to discuss it farther. ** is so far removed from this project that he did not even know which week we were entering, and the owners had to remind him that the approaching deadline was closer than he thought. Next time we spoke with him, he was adamant about starting a new portion of the project. We were confused because not one of the projects that had been started were completed thus far. He had been applying mud to the ceiling and walls for weeks, the floor wasn’t done, the trim wasn’t replaced, the doors needed to be shaved, the wall tile wasn’t grouted or sealed, fixture not replaced, etc. So, when we asked ** to finish the current work before starting on any additional contract items he insisted on doing the project how he sees fit and that we can’t tell him how to run his business or his project. From there he sent a crew member to gather the rest of his tool and told the only working crew member to leave.

      This crew member refused and decided to continue working, however now without any tools.

      We invite whoever has judgment over this arbitration to come witness for themself all the unfinished projects, the poorly placed tiles and some of the lingering mess that still needs to be cleaned up. We wanted the contractor to be focused on the task at hand and not to provide subpar, sloppy, or rushed work. Redoing a bad job is more expensive than doing it right the first time. However, he’s not interested in fixing his mistakes, he’s just good at making excuses. The only consistent thing he does is miss meetings, deadlines and make unfulfilled promises. After the first on site payment via the invoice he maliciously extended the contract timeline without proper paperwork or consent from the owners. A more experienced contractor would have factored in enough time to anticipate minor delays and not given an improbable timeline to persuade the client selection. Now we stand accused of not being good patrons and liars not willing to honor the agreement. We were so looking forward to the completion of this project with The Ceramic King that we allowed ** to take possession of a washer and dryer set that we sold to him and agreed to take payment off the back end when the job was done. Now adding more delay with this litigating instead of just doing the right thing, we have not had use of our home for more than three months and the near future. The bottom line is that the work has not progressed as it should have due to the lack of preparedness and effort by the contractor we hired and that he seems to chase contract paydays by doing the bare minimum to secure a payment.

      We feel that we he is not skilled or competent enough based on the prior work completed thus far. We have included text logs and photographs to support our statements and observations Customer demand that **:


      RECTIFY INCOMPLETED WORK THAT CUSTOMERS PAID FOR, REFUND PORTION OF MONIES PAID TO ** FOR PARTIAL WORK AND PAY MONIES FOR REIMBURSEMENT

      ·         Rectify: Fix the projects that were underway and left incomplete: by replacing and repairing uneven floor tiles (10), shave doors down (6 doors), installing all floor transition pieces, baseboards, threshold, repairing ceiling, seal tile, finish dry wall (mud and sand), properly cover exposed electrical wire, complete bathroom. (HOWEVER, TOMMY CAN BE THE ONLY ONE THAT CAN COME TO THE HOME TO COMPLETE THE INCOMPLETE WORK).

       

      ·         Refund: Partial refund of $4670.00 for the partial completed work, we paid in full and the work was not completed. (Bathrooms incomplete, ceramic floors incomplete, laminate floors incomplete, trim, transitions and thresholds incomplete, light fixtures not installed, drywall, mudding and paint incomplete, door cutting incomplete, etc.) ** is aware of these things and he made note to complete after owner addressed that we’ve paid for these tasks and they were yet to be completed.

       

      ·         Reimbursement: $620 for washer and dryer ( owners gave ** a washer and dryer set with agreement to take it out of balance at end), $1,100 for Bathroom tile (extra bathroom tile used from ** mistakenly installing it the incorrectly, he is aware that we were charging him for the additional tile used, the tile cost $39.99 per piece ** used an extra 5 boxes 28 pieces), $70 for two damaged rugs, $34 brooms and dust pans sets (2of3), $300 for Professional cleaning service and $290 for floor tile delivery we paid and ** agreed to reimburse us = $2414.00

       

      In total we would like for ** to give us $7084.00

       

       

      Addressing ** complaint

       

      1.       We never changed the configuration of the design of kitchen. We had our kitchen designed and paid for since 6/2021. ** seemed overwhelmed when the upper cabinets arrive, he questioned us about what a Peninsula was and what was a toe kick when inquiring about the kitchen cabinets the day he attempted to put them up.

      2.       We decided not to paint the kitchen wall after having the trim painted, we notified ** that we were keeping the original painted wall and only thing that needed to be painted was the ceiling. We never told him we were going to paint anything.

      3.       ** wanted to hang the kitchen cabinets on 12/6/21, homeowners advised him that we would like the other projects to be completed before hanging the wall cabinets. Our main concern was that the celling was not completed, and the contractor would get mud, dust particulates and paint on the cabinets. He had not made any attempts to project and preserve none of the other project surfaces at this point.

      4.       On his complaint his primary concern is about the contractual pay date by referencing another 1/3 is due. From the original agreement we were to pay in 3 installments (the deposit, after demo, and at completion). After the Demo ** requested via text to do 4 payments instead of the agreed upon 3 which would have been ( deposit, demo complete, floors complete and completion) We didn’t have a problem with paying how he wanted to be paid. We paid every


      time on time in full amounts requested with no problem. However, adding this additional payment ** essentially was able to secure more of the final payment before completion.

      5.       ** changed the time frame to 8 weeks without our agreement. We noticed the change after the demo payment and made asked ** about it, to which he replied it’s been 8 weeks the entire time. Although we know this wasn’t true, we gave him up to the full 8 weeks nonetheless. Our countertop installer came over 11/9 and 12/3 he is unable to order our countertops because the cabinets were not installed. The bottom cabinets came in 10/11/2021 all of the top cabinets came 11/24/2021 (there were 16 days from the day all of the material was on site and the day ** made the complaint about not having enough time meet the deadline). During most of this time no work was performed at all.

      6.       Nothing on our end prevented him for completing the work he just created this compliant to halt the project once he realized he would not meet the project deadline.

       

      Breakdown

      ·         Before the signed contract ** bided and made assurances to his ability and the workmanship of his crew, assuring at least four- six skilled workers. There was not ever a point were more than two people worked on our project at a time after demo. Demo was completed in the first two days. I voiced this concern early on and ** made assurances that things would be done timely and efficient. ** is not capable of doing the work solo

      ·         Original and only signed contract stated a completion time of 15–21 days, with term starting on October 19, 2021. Original start date 8/16; Owners pushed back (due to cabinet production delay) to abide by four-week timeline.

      ·         Contract manipulation throughout. ** Made contract modifications without both parties’ agreeance and acknowledgment (Changed timeframe from 15-21 to 6-8 weeks, Payment arrangements, Never received detailed material list before the start of the project per contractual agreement, added items, we notice that when we went to print that there were things added and changed, ** made reference to the invoices throughout merely as receipts. (We notice a change in 3 different contracts when we went to compare and print for our records)

      ·         After demo a second payment was made and the invoice was changed by ** with only the acknowledgement of the payment not the changes.

      ·         ** listed amount due different than what we have calculated as amount due. There are also deductions that were not included that ** is aware of and failed to include: ($1100 (extra used bathroom tile) $620(washer/dryer/plug) (damaged rugs) $70 (2of3) brooms and dust pans)

      ·         Agreed to additional flooring projects prior to start (8/16) was complete in less that 4hours this did not extend or delay project his inability to work consistently did. ** Mislead us about having a skilled crew and the timeframe. An average of 3-5 hours per week of labor performed by ** and less than 15 hours a week by him and his crewmember (***** There was always only 1 person) I questioned the process, timeline, and crewmember time after time and ** made guarantees there were no problems .There was never enough work being done at any given time; owner voice this concern several times(see screen shots).Paid for said completed work and was not/still isn’t completed ** reassured home owners that the job was going to get done,


      excuse after excuse came. Never agreed to 6- 8 weeks of work ** added that within the contract without our knowledge. ** created a new contract that has not been SIGNED the original contract was signed by Mrs. ******** and **.

      ·         Deadline of 12/9 was discussed and agreed upon with ** and owners, I offered to extend it to 12/10. On 12/6 ** said that it would take him and 4 guys two days to complete everything and would be done by the end of week. ** and the 4 guys never showed up. Work is and has been incredibly inconsistent. ** was aware and apologized on 12/2/21 wanted to make it right by offering a refund for the incomplete work that we paid for on 11/15/21, advised owners he was enroute to offer refund and to introduce us to a third party to finish the remainder of work, but he never showed up. (** Claimed hospitalization). On 12/6/21 he decided he no longer wanted to refund us and that he would complete a portion of the work to meet deadline and create a work order to do the remainder. Homeowners requested that he complete prior work in home before starting a new project task. ** advised that he wanted to do things his way, homeowners voice opinion that nothing has been 100% completed, and we would like one of the spaces put back together before anything new project began. ** told owners via text that,“this his project and he will do It how he wants to do it”.

      Dates of Contact (All contact was made via text, phone and in person)

      ·         5/26 walk thru / consult

      ·         5/27 Contract signed paid deposit $5500

      ·         7/19/21 called him to push back start date because cabinets got delayed, the new start date was (10/11). Owners ask how long project will take because we were planning to get an ****** and needed to book, he advises via phone and contract 15-21 business days or 4-6 weeks at the most depending on if everything was present. I advise him that 6 weeks was the most time I would allow but they had to be done by the end of the 6 weeks which would have been the week of 11/22. Once that week came, I had verbal and text communication that the last day would be 12/9 which would be at 8 weeks two weeks past deadline.

      ·         8/10 he came to house to measure all the spaces included added rooms (added room the bathroom and two laminate floors

      ·         8/18 added the extra bathroom and two small rooms of laminate wood floors to contract

      ·         8/25 ordered all floors back splash ** agreed to pick up

      ·         9/7 ** asks us to pay for delivery because he never picked up tile from store, and the store kept calling. We paid he said he would deduct from total $290

      ·         9/16 had phone conversation to move dates due to production of cabinets he advise to text him changes noted new changes (10/18 start date, end date 12/3 order counter11/1) REQUESTED a detailed game plan we never received. I advise cabinets be /delivered the week of 11/22(they arrived 11/24

      ·         10/11 called advise him to start on 10/19 because I was out of town 10/18, he said that was ok

      ·         10/19 start demo of kitchen

      ·         10/20/21 he called to discuss the bathroom floor because it was concrete under it decided to go on top and not remove floor, he advises he would trim doors to fit and would be even with other floors he adjusted the price by reducing $600.00 less due to less work being done and no demo of floor required.


      ·         10/21 ** text he was making a new payment plan of 4 payments to add the plumber fee and the other floors he said we was on hold until plumber got done the plumber came next day.

      ·         10/22 I ask about new total and paying plumber, PAID $3300 all demo complete – left nails on sub floor and dust and huge mess.

      ·         10/23 I questioned the sub plumber work because it was rigged and going through the studs, Mr. ******** had him take down to be corrected we advise ** of what happen via text and phone, he contacted Jason and advised us that he is coming back to correct

      ·         10/25 no contact made said he was not coming due to taking his kids to doctor visit.

      ·         10/26 I ask when plumber was coming back because no contact was made and left pipes open and exposed, leaving foul smell in my house. The plumber came back that evening at 230 after contact with ** he stayed till 11:45 pm correcting his error.

      ·         10/27 the electrician showed up 2 hours after expected eta - electrical partial complete never showed up to finish to date

      ·         10/28 ** started ceramic floors (kitchen, foyer, 2 bathrooms hall and laundry room

      ·         10/29 no show I text him at 4pm he said he was working at an open house at Harris Stowe advise that his guys having issues and they are unable to come, and he would be in touch

      ·         11/2 I text him to see when someone was coming, he said that ***** was in route, owner question if one person would be only coming per day and owner express this as a concern that we didn’t feel that they will meet deadline. ** reassured that we would not go past that deadline if everything were present. I reminded him that everything with the exception of the upper cabinets/countertops which he was aware they would come at the very end and that should be the last task being completed I then questioned the timeline and requested itemized breakdown of scheduled work he text 6-8 weeks was needed. I text back questioning him that was not the agreed upon time frame and as long as they are out by 12/9/21 which would be at 8 weeks I would be ok as long as they met date, we (originally agreed on end date 11/23/21 and 12/3/21. he said they would be out and done. I was ok with extended it because I would still have to put my home back together for Christmas.

      ·         11/3 ** and Jamal came and installed wood floors in 4hrs in both rooms after I complain that my kids kept stepping on staples that they left expose for 2 weeks.

      ·         11/4 I question lack of work being done he text to reassure they will be back on schedule 11/5 due to no one ever showing up after being told they was on the way.

      ·         11/6 sold dryer agreed to add to back end and take out of total

      ·         11/9 I text and called no answer he finally sent a text saying he was in hospital and his guys couldn’t get in touch with him yesterday to show up 11/8 sent text and calls no response. reimburse for grout sealer 35.47 x3

      ·         11/11 he texts he was putting laundry room back together since he has all other spaces out of order laundry NEVER got back together

      ·         11/12 installed the remaining of the tile floors did not install transition pieces or hang any dry wall back up he advise he would do the next day he came. he requested payment talked via phone I ADVISE VIA TEXT ILL PAY HIM ON 11/15

      ·         11/15 Owner advise the proper way to install the tile for bathroom he confirmed competency with a text confirmation and via phone call – paid$3300


      ·         11/16 never showed up after stating that ***** was coming at 12. I also advise him that I would be charging them for using 3 of my brooms and dustpans he said he would buy 2 and call it even for buying the sealer for floor for one in which I agreed

      ·         11/17 I notice that the payment amount was different than what was discussed I advise him he said that it was okay and apply to back end, he advises that Jamal and ***** was coming they never showed up he. I made contact with tommy; he advises that ** requested them to complete his project instead of coming here. the entire time ** was telling us that they were in route instead of being truthful. WE REQUESTED for the 3rd time to put laundry room back together still incomplete

      ·         11/19 I advise ** of floors installed in correctly and causing household members to trip he said he would fix. he came to home and inspected, apologize, marked them with an X they never got fixed.

      ·         11/22 ** came to home to do a walk thru made a note and signed it of all work to be completed. In which owners have paid him for he reassured us that it will get done. None of the work to date has been complete he was present for 20 minutes.

      ·         11/23 ** came for 2hrs - I voiced concern on 11/22/21 via fb messenger to ** by commenting on a photo he posted showing him and ***** competing other work. I voiced the lack of work being done and how deceitful he has been not showing and telling him and or Tommy is in route but with no intention to ever show up.

      ·         11/24 ** sent ***** for 5 hours to correct wall since he did not do properly (discuss via phone on 11/19- ** understood that he would be correcting, and he sent ***** to repair) – upper cabinets came expect 3 and a box of hardware in total we had 40/43 boxes of cabinetry here

      ·         11/29 I advise to paint the ceiling only because we were keeping the kitchen as is no paint needed. We ask would that reduce the price since we was not painting he said $400-500 would be off ,then told us that he would have to sub the kitchen out to another contractor because he isn’t able to do the molding and the cabinets because he didn’t know it would be a designer kitchen and he has no crew, we advise him he should have been upfront with us that he is incapable of completing the job, and that the we are not paying for a sub that’s not our responsibility. Conversation happened via text and phone; we requested a in person meet to be on one accord which he agreed but never showed.

      ·         11/30 I contacted ** because 2 cabinets was hung, and the ceiling wasn’t complete along with other task not being done in home and told him I did not want kitchen started due to potential damages to cabinetry he advise that he would cover those 2 up I requested to be taken down because I was not confident and they would not destroy my cabinets .

      ·         12/2 Homeowner made phone contact to get on one accord. Based on our perception of the conversation ** was taking responsibility for lack of work, errors made and willing to accommodate us. Hours after the conversation via ** offer refund due to his lack of work and said he would call us and come to home to speak in person because translation was lot via phone and text and would be brining some contractors with him to complete the job. ** never responded back when we said “okay” and text a text at 6am saying he was yet again hospitalized. At this point this has been his 3rd hospitalization since the project.

      ·         12/3 ** text saying sending worker tommy and he never showed owner ask for contact to be made none was made.


      ·         12/6 ** text the owners this morning to advise his eta was 10-1030 and that him and a crew of 4 would come and complete the job. I advised ** via text at 1130 that I had to leave because no one has shown up or any contact had been made. We went back and forth all day via text. ** would not pick up the phone to speak to us. At 4:30pm ** sent a text stating he was enroute when advise we wasn’t present because we had no knowledge that he was coming. Proper communication was never made he then said that he would come in the morning on 12/7/21 because he couldn’t wait for us and had to get his son but never set a time, owner ask serval times for time and response was never given. All on this day 12/6/21 he requested ceiling paint on same day as joint compound also instructed employees to gather and remove all tools from location (nail gun, drill and saw). Sent Jamal in the morning to retrieve nail gun and drill and told ***** to take wet saw when he left job site. ** knew at the start of day he had no intent on completing our job he needed a reason not to, so he created a disagreement about the order of operation in which the customer wanting their project to be done. ***** advised us that they had another job they were starting, and this is a ploy to by time.

      I hired this company to install flooring,back splash, and counter tops. The counter top apoxy is not right, I have called him and gave him every chance to make this right, which he has failed to do. I no longer trust this company to do any work in my home, I would like a refund so I can hire a company that will provide quality workmanship.

      This consumer had a complaint about the edge of her countertop and our company provided her with a 33% refund on her countertop, no other concerns were mentioned or reported to us. Our contract does not include any trash removal. We feel the contract was completed with quality workmanship and will not offer any additional refunds.

      We provided a 33% refund on our labor not the material. The consumer has never identified or provided any inspection reports showing poor workmanship or any estimates the support this complaint. We provided the work we were hired to do. There is no mention of what damages she is speaking of and why she would not trust our company. The consumer never contacted our company about any of this prior to making this complaint, we had no opportunity to speak with her about her concerns.

      I am rejecting this response because: the business did not provide a 33% refund of what I was charged $1100 for the countertops. 33% of $1100 is $363 and I was only provided $100 and have the proof of that. As well as we never discussed or came to an agreement on how much I should be compensated he just gave what he could afford I'm assuming. Please review contract terms, I did. I receive 33% of anything. Also it will take more than $363 to correct his mistake that he refused to. Please see attached photos.
