In November 2022 you entered a purchase sale agreement that was suppose to close 12/28/2022 the title contract never received their money or contract. The contract has been breeched 12/28/2022. I have not been able to get in connect with ***** or ****** via phone, email, or text for two weeks. I would like for them to either purchase the home or pay for damages. the home purchase is 165,000.00 or the damages would be 2000.00Business response

Hi *****, I am aware of this address and I was told that ***** from our team had a discussion from you regarding a mutual release. With Christmas and holidays we weren't able to give you a physical copy so we can instead give you a E-sign of a mutual release. Also, please see attached contract that you signed. A couple things to note. 1. A contract in the state of Illinois for purchasing and securing a real estate contract requires that it be turned into a title company and earnest money to be deposited. Did you turn in the contract to Abstract Title? If not, no earnest money could be deposited by us making the contract null and void. More over, the contract states on page 2 under Final Walkthrough paragraph the following "ACCESS, FINAL WALK-THROUGH AND UTILITIES Subject to buyer's final walkthrough pre-closing and approval. Seller agrees to make sure all utilities are on (if applicable) prior to walkthrough." Per our contract we exercised our right to owner approval. Lastly, with the request of $2000, The contract on page 1 paragraph 2 states: Earnest money non-refundable to Buyer unless the title is non-conveyable or the seller is not available to close within the time period of this contract or if the Buyer is not satisfied with the result of inspections. Subject to buyers final walkthrough and approval. We were not satisfied of result of inspection and have subject to final walkthrough and approval. With that being said we cannot hand you $1000 which was on the contract attached and not $2000. We would need this property at 150,000 to move forward. If communication was not displayed between you and ***** with that please reach out to him so you can get a answer.

I am rejecting this response because:
No conversation with ***** took place and this is the first communication I have had with ******. The Contract was not Mutually Released and as of 12/28/22 is in Breach of Contract.As far as the correct company, Home Pros is the entity that sent the contract so they are the agent and responsible for the handling of said contract. (Proof attached)
