I paid Banks Contracting & Remodeling LLC $3,366.16 of $6912.04 for a bedroom remodel. I did reschedule the start date on 2 separate occasions due to scheduling conflicts. I was advised by ***************** with Banks Contracting & Remodeling LLC of "restocking fees". I ultimately had to cancel the project due to personal issues. When I requested a refund I was told that I was only *********** $700.00 due to "restocking fees". *** advised that they would see me in court to settle this dispute. Unfortunately, Banks Contracting & Remodeling failed to appear in court on two separate occasions despite being served by the St. Louis **************************** at there home. As a result of Banks Contracting & Remodeling LLC failure to appear in court, I was awarded $2,744.08 (minus the non-refundable deposit of $691.20 but in addition to court cost) by ******** Circuit Court 22 ********* City Small Claims Court ( ************************** order *****). I am requesting the Banks Contracting & Remodeling LCC pay the judgement of $2,744.08 as ordered, adjudged and decreed by the court or provide me with the material that was "restocked" along with an itemized receipt of the "restocked" materials. Unfortunately I did not receive the summons properly to fight this scammer.   This person went to jail!    I gave him months to reschedule, losing money on each reschedule.   I have the text messages to prove the information and that he was incarcerated and charged the date on many occasions based on him wanting to cancel the contract after the allow time to do so.   He accepted a bid in March 2023, made a deposit and rescheduled 3 times for a start date between March and June 2023.   **** to jail for what ever reason and had his son requesting a refund and gave options to get just the floors done, because hes has cancel the contract due to him not being available and he stopped the work/contract.     He finally gets out of jail in late August 2023 and I owe him money.      They gave the summons to my tenant!   I did not receive it personally or at my business address! I would have beat this in court and have documents to prove it!
