As you can see from the contract the company quoted me a bid that included reduction of "the trees along the house". It did not say reduction of the treed "that are along the house." From the notes that I made on the signed contract, you can see that my neighbors, who had to give consent, also interpreted the bid as the larger trees (not just a few clipped branches). When the company came back out, even the workers agreed that the larger trees should be agreed to the fence line along the house. The company is claiming the completed the job. It took them 20 minutes and they only removed a few bushes. They want me to pay the full amount. I sent $200 to cover the bushes and am willing to pay the balance if they complete the job but not if they do not. Please help me work this out.

Ms. ******** you added to our proposal.

We can only honor what we have proposed.

The added description was later proposed to you for an increase in cost. The arborist that originally proposed the work went to meet you and discuss it but was dismissed from your property.

I will be happy to set up a time with you to discuss all.

On May 22, 2020 my husband ***** ******** hired Rays service to cut down all limbs hanging over our house and the house next door. In early June electric was shut off and crew came and removed lower limbs from above both houses. When my husband inspected the job he saw that higher limbs over both houses were not removed and asked them to finish the job before they received payment. They said guy who bid job no longer worked for company. A few weeks later crew returned, hung out in back yard and left saying they did not have correct equipment. My husband passed away 8/27/20. I heard nothing more from this company until 12/31/21 requesting payment of $1400.00. I called and spoke with office manager stating that they would be paid when job is complete. I just received another bill from them end of January. They need to finish the job or leave me alone. This is very stressful for a new widow. It is not my fault of they underbid a job. Three years ago a tree demolished our garage in a storm. By hiring these people we were trying to avoid any more tree damage. I have the original contract and pictures of high limbs over house. that should have been removed. I will also note that my husband ***** ******** was on oxygen at time of service and we had to buy a generator in order to have electric cut off temporarily.

I am sorry for your situation and will gather the information. Also come by next week when this storm has passed to inspect the situation.

We contracted with this company to cut down a tree. The contract specifies that the cost would be $920.00. The contract says that "if a lift is used" the cost would be higher. When I talked to them about the price that we were charged, ($1600) they said they rented the equipment anyway. We had discussions before contracting with them about use of equipment and that it would probably not work due to the landscape. No equipment was used because of hill located on our property.

      Business response

      11/05/2021

There was a dispute in the amount charged that the customer indicated they wanted done and how they wanted it done, The amount charged was correct according to the estimate they signed. A specialty piece of equipment was rented and paid for by Ray's but was not allowed to use on the day the service was performed.

The customers dispute is under review at Ray's at this time.

      Complaint: ********

I am rejecting this response because:

I'm sending our payment of $920.00 according to what Mr. ******* stated to me standing in our back yard that this would be the price if the portable lift was not used and it was not used.

I told Mr. ******* that I doubted very seriously if he could use the equipment on the slope so I was then told if we do not use the lift it will be $920.00 instead of $1,600.00.

I'm sorry this has come to this, always did have faith in your company, but feel a little shaken by the outcome.

I would hope that another homeowner with a situation like this that your company would send out the person who will be doing the cutting, could tell that this would not be practical for using a lift and then perhaps mistakes like this could be avoided and save money.

      Sincerely,

      ***** *****

I have been doing business with them for a long time. I had some storm damage and they came to check it out. They did not take the biggest branch down, the one that I wanted them to do. The guy came over and tore up the contract. I called them again and they came out. There was a second storm and it took down half of the large branch. Ameren came by and wanted to make sure it wasn't on any wires. They cut down the remaining branch for me. The business is trying to charge me for the full price of taking down a large branch that they did not do. I do not feel I need to pay them for a job that they did not do. I do owe them something for the work they did, but not for the biggest part of the job with was the large branch. The storm broke half of it and Ameren took care of the remining branch

The contract the customer signed and agreed to with the Arborist stated Remove the dead broken branch's hanging in the sycamore trees in the back yard. Haul away the debris. When the crew came out the first time to do that work. The customer wanted live branches cut off over her neighbors to the right and rear of her house.(that work was not agreed to and the arborist made her aware) A second arborist went out and discussed what was on the contract and she said ok. That work was performed as described in the document. I am sorry there was some confusion about this and we did meet with the customer to clarify.

I reject their answer because I never asked them to cut off live branches.  I also deny that they ever came here to clarify what I wanted to do.  Ameren came out and cut the branches for free.

It is Ameren's job to take care of problems that exist with there electric lines and not ours

We do not and cannot take care of those problems.

Again the contract you signed was for removing the dead broken branches in your tree. When the crew came to your property you requested for them to clear live branches over the power lines. That was not the contract you signed since they where live branches. At that time the original arborist came by and you also insisted with him that we do this other work. He left since there was no equal agreement on the work to be  done. You called our office and I came out. At that time you also pointed to live branches that where not part of the contract. I did at that time explain to you that the branches you where referring to where not dead. I also pointed out to you that some of the branches where laying on the power lines and you would need to call Ameren to take care of those. You did that and called us back to say they had been out to take care of those and would we come back to take care of the broken dead branches. We did send a crew there to do that and again you tried to get them to do other work that was on the contract.

      Complaint: ********

I am rejecting this response because:They did  come back after Ameren took the branches off but did not take the branch off from the 3d tree that was in the the original contract.  They did not address this when they came

that branch did partially come down after the second storm and half of it dropped in my lawn I have a picture of it.  Ameren came again just checking and they pointed out the rest of the branch that had broken off and hanging..Ameren told me not to go to that party of the year as it would fall on my head.  They removed it

You did not complete the work on the first contract and therefore should adjust the bill.

      Sincerely,

The $80,00 was not even in the original contract that you said was destroyed..if it wasn't show me my signature on a contract for $680.00.  You are making no concession for the work that was not completed.
