I purchased a house this May of 2022 from this realty company. My property, according to the deed, includes 6 feet 4 inches of the lot to the south. I built a fence and a retaining wall there and got a summons for property damage and trespassing. The realty company sold this property without it ever going on the market. They are the only ones who can make this right and they are not contacting me.

This was a personal transaction between ***** ********* and ****** ********* with the property and I have nothing to do with this transaction. I have spoken with ****** themselves and explained the transaction and what to do from there.

Here's a few messages from beginning back in April these messages all cam from Murney email account belonging to ***** ********* and Murney realty I have several issues with the company and the realtor and the shady practice several items that went with house as promised were stolen by tenants as per contract I was guaranteed possession of property didn't happen because his tenants had not moved in fact he signed a new lease for them after he knew he was selling house I have tried every bit of 20 times to contact him texts, calls, email made complaint with greater realtor board and bbb as I was advised to by attorney  so I guess my only option is to take legal action for my damages and possible breach of contract

      Business response

      12/22/2022

I am very sorry *** ********* is upset with the transaction.  I have talked with him but as I stated Murney Associates was not involved in this transaction and had no idea  *** ********* went to **** Title and wrote an offer on the property.   *** ********* was an agent with Murney at the time of the transaction but he was acting as the owner of the property.  It is my understanding that **** Title informed *** ********* that he was not working with a real estate agent for this transaction and was buying without the assistance of a real estate agent or broker.  **** also advised *** ********* he should speak to a licensed attorney.

      Complaint: ********
I am rejecting this response because:
I like to know who at **** title gave Murney my contract information especially if Murney claims  has they have nothing to do with this transaction  and also who told Murney I was told to speak to attorney and why was Murney office and Murney email address used in the sale of this property I don't agree with the bully from Murney that called me and she seems to have a lot of info for not having anything to do with it and  is covering for agent so I disagree
      Sincerely,
      ****** *********

      Business response

      12/28/2022

I am attaching the contract that the Buyer prepared.   I am not sure where he obtained it but I am assuming that the Buyer got it from **** Title.  There is a statement from **** Title stating that they recommend the Buyer contact a professional Realtor or an attorney.  As  you can see from the attached documents, Murney was not involved in this transaction.  The Buyer was aware that he was bypassing the real estate company.   The contract does show Lot 40 and N 6 ft of Lot 41.  I am not sure where the fence and wall were erected.

Again, I am sorry that the Buyer is unhappy but he went directly to the title company and did not involve Murney Associates in the transaction.
