This man came to look at my roof and he asked me to sign a form giving him permission to get on the roof. He handed me a form that said "Insurance Permission Form" and i signed it. He would not give me a bid no matter how many times I asked for one. Now he is saying that I signed a contract. No where on that form does it say that it is a contract. I feel that he fraudulently got me to signed that form by pretending it was something else. I would never agree to do business with a company that won't give me a bid.Business response

Iapologies, I’m sure I addressed this complaint (assigned ID ********). But I can’t find my original reply correspondence.So I will address this issue from the beginning. ***** ******* (the complainant) was approached to see if she would like her roof to be inspected for hail damage, free of charge.Proclaim Restoration found the roof to have hail damage.We at that time undertake contacting the ins. Company for the home owner to get a claim opened for *** ******* and to try and get damage covered for repairs.This is when she signed a contract for us to do this work on her behalf, a good faith process.Insurance denied part or all of her claim at first, and we continued attempts and correspondence showing extra pictures of damage to get the hail damage repaired at the cost of what the insurance decides. At all time we let the customer know we would do the repairs for whatever the insurance claim would pay. No more than that, if I provided a bid for the repairs that is $2,000 over what the insurance would pay. We agree from the beginning to do the repair work not for our bid amount, but for the insurance damage report. That’s why we don’t provide a bid.After getting the damage on the roof approved and covered, that is when *** ******* decided she would profit by getting bids for the damage and repairs of her roof. Proclaim did give her a bid, which we normally don’t have to do, because we agree from the beginning to do the repair work not for our bid amount, but for the amount of the ins. Damage report.She then wanted to pursue a cheaper price, after we did the work to get the roof approved,she thought she could profit from the insurance company and keep the extra money. Which is insurance Fraud.We would not give her a lesser bid amount for her to profit. We don’t participate in Ins. Fraud.Even though she signed in good faith a contract and we could pursue legally to have her stand by her signature on the contract. Proclaim Restoration sent *** ******* a letter and a copy to the insurance company, stating that we were no longer connected to her ****************(copy of letter attached). I am rejecting this response because:The sales person representing Proclaim on the 'VERY FIRST DAY' , (approximately 6/8/22), said I needed to sign a form only to be able to take pictures of my damage on my roof and so they could contact my insurance company to help with getting approval for roof replacement. He never once said..."this is a contract" and at the top it was only noted as an Insurance contact form..... I repeatedly ask for a bid and told him I would get other bids, (which I don't think anyone would let someone do work on their home without an approved bid). Still the sales person NEVER said I signed a contract---- "UNTIL" I got tired of waiting for Proclaims bid, then I told him I was going to go ahead and get other some more bids.... Then he told me the "Insurance" form was a contract. While on the phone with him I felt threatened and very uncomfortable.
To go back a little ---- I did actually go to the sales persons superior and ***** ******* the first of August to talk to him and he told me he would get the bid for me,,,,mind you I have been trying to get a bid since June 8th., almost 2 months... ** ******* then sent me a text regarding "our skylight"....We don't have a skylight!!!! So at that time I made my decision I could not not trust this company doing any work on our home.
Another issue was the insurance certificate for the company that would be doing the work was expired when I asked for proof of insurance.
In conclusion I think anyone within their rights should receive a written bid when requested and not continually getting a run around....I did not want a "surprise" bill at the end of the work for additional money on the roof replacement. They should be told they are signing a CONTRACT not an insurance form from them to be able to talk to our insurance.
Also, just wanted to say: It was said that asking for other bids is "insurance fraud" by *** *******.... He should know that it is always good business to get more than one bid for a job to be preformed on your home.
