The builder of our home Cannon Builders refuse to fix negligent defects to our home. We are still within warranty. Every single window in our home leaks, are molding through the corners, even ice forms inside the home. Our counter tops are separating and become uneven and pulling away from the wall. Our dining room floor has a gigantic hump in it that you can trip over. The house is less than a year old and acting like a 100 year old home. When we saw the home being built they didnt cover floors etc during snow falls and let the snow remain on exposed subfloor as well. The warranty company is called pro home. They said Cannon Builders told them that its normal for these things to happen.

We have was just at there house today to take care and address the issues.  We have contacted the countertop company and they are replacing the top.

We had ******** lumber over there prior to this to address the window issue.  They are not leaking they are actually air tight and if they was leaking they would not have condensation on them.  This is cause from the humidity in the house to high in the winter time and extreme cold temps on the outside.  It is the same concept as you getting a soda in a cup in the summer time and the condensation builds up on the outside of cup because of the cold inside the cup.

we explained the countertop pulling away from the wall also for some reason the coldness causes this issue on all home with the kitchen on exterior wall and will return in the summer months and the bottom needed caulked rather than grout.  This was explained to them also.

The hump in the floor is under an 1/8" which is with in standards and this was shown to them in the book and by running a string line from wall to wall and showing the the 1/8.

My husband and I bought *** ******* ** Aug. 2022. In our loan through the VA a 1 year warranty (*******s). We have made several claims that have not been fixed that cannon accepted in the beginning but now are stating these claims have been fixed. When I asked for documentation showing these claims have been fixed they emailed me a false document. I emailed pictures showing that these claims haven't been fixed and *******s also sent an email showing that the claims haven't been fixed. Cannon is refusing to address the claims. Our cabinets are falling apart because of missing pieces that a cannon employee pointed out and not put together properly and was with in the 12 month warranty contract. We paid for a warranty that we aren't receiving. As soon as I emailed Cannon the photos of the claims that weren't fixed that responded with no they are fixed. I can not upload all the documents as the file is to big. But my email is ************************* and I can email every document needed that way.

      ***** and J***,

I removed ******* emails from this thread now because thenew home orientation pre-closing walk does not pertain to them.

We're still trying to figure out what you are claiming is not competed. Your new home orientation pre-closing walk was done 8/17/22, a day before you closed on the house, all 19 items on that list were either repaired that day or were reported to the sub-contractor (such as the dishwasher door, it's possible they didn't show up without us knowing that). Nothing has been mentioned that an item was not completed up until now.

According to ******* your 30 day walk was not called in to be scheduled, so they have nothing on any outstanding items.  The 11-month final term walk was done on good will after your 1-year warranty was up on 8/18/22, with the work scheduled out for Cannon this past Monday.  Nothing mentioned on the final documents of items still outstanding from a previous walk.

With your first email you sent ***** you attached the New Home Orientation Report, this is the list that I need claim number(s) from that you are saying are not completed.  Any pictures you can send me to correspond with #'s would be helpful too.

Hopefully we can get this all cleared up,

All 12 items on your pre-closing walk list have been completed.  They were all done before you closed on the house. Cannon is not aware of any outstanding items that have not been completed.

      Business response

This is ***** ******* with Cannon Builders responding to your
email.  We have partnered with Pro-Homes and they take care of all of
our walks with the homeowner before they close on there home. Once the
walk has been completed Pro-Homes sends an email of the walk list to the
office and to my Superintendent.  Then my superintendent will take care
of the walk items himself if possible or schedule them out and reports
back to pro homes what is completed and what is outstanding.  The
homeowner also get a 30 day walk which the owner has to list what issue
they have and these buyer never did one.  Then they are allowed a 1 year
walk in which they did do and turned in.  These items are marked by
pro-homes as either warranty or homeowners maintenance.  They are
complaining about a barbwire fence that is on the property line which
was put up years ago by the farmer that backs up to there property
nothing to do with us.  They are also complaining about erosion as you
will see in one of the emails that the 10 year old can stand in it and
cant see her head.  My super has looked at this and this is not even
close to that otherwise we would have fixed it.  We also have a grading
disclosure that was signed prior to purchasing the home about yard
settling and erosion will only be fixed one time in the year.  The other
issue they are complaining about is the cabinets.  At closing the
pro-homes walker has them open and close ever cabinet and drawer to make
sure working properly which was done.  The one year walk had cabinet
broke which when we got there the whole face was pulled off the cabinet
and the countertop was broke and the only way either of these could of
happened was from force.  My super inspected the drawer and the bracket
in which that hold the drawer guide was broken in half.  It is our
belief that the drawer was over loaded and something was stuck in the
drawer and therefore could not open the drawer and they yanked on it and
this cause the bracket to break and pulled the face of the cabinet off.

The dishwasher is also and issue and was reported at time of closing and
was setup with the supplier to install a new door and not sure how that
got dropped on getting replaced and never heard anything until the one
year walk.  We asked for the serial number for warranty and they said
they would contact the company directly and would not give us the serial
number.  The fire place mantels we use have a trade mark of a pearl
inlay as you will see they do not believe this as there mantle still has
the red tape over it or they tried removing the pearl but we believe it
the red tape over the pearl to keep from getting stain on the area.  If
there is anything else we can assist you with or other questions you may
have I will be you contact person again thanks for your time.
