    We closed on our house in May 2017. It was built by CMS Homes, LLC. Our septic field began having issues in September, 2017 with dead spots and standing water. CMS advised us to call the installer they subcontracted with, *********************. Trinity said this is normal the first year. A year later, the issue was much worse.I have spent the next 5 years trying to get them to fix the issues. Most of the time has been spent waiting on voicemails/emails/texts left with CMS or Trinity that go unreturned. During this time, Trinity and CMS did try a few fixes. They fixed a broken pipe at one of the areas with standing water. They tore down a berm and used the dirt to cover the field. Trinity's latest solution is to add another field at a cost of $6,000+. I emailed the owners of CMS in February 2022 asking for a resolution, but they have ignored my email. In October, 2021, the septic panel failed. Two licensed septic installers determined this was because the conduit plug was placed inside the septic tank, had fallen out and gases were seeping into the panel. They both quoted $1300 to replace the panel. One of installers noticed our septic aerator was turned off in the basement. Neither CMS nor Trinity told us about the aerator, so it had apparently been off for the entire 5 years.We have engaged the county and a county septic inspector. They said the field is worse than any they had seen that was only 5 years old. We are getting biomaterial at the surface. Their theory is this is because the aerator had never been run, but it could also be the high **** content in the soil of the field. The inspector also confirmed that the area where Trinity wants to put a 2nd field is not large enough. The advice from the inspector is that we have to start completely over with the field and the panel does need to be replaced. We have already begun the process by having 5 soil sample pits tested. In total, we've spent $1,000+ just to discover a proper fix, but no resolution.

    My experience with CMS was very disappointing and I would not recommend them based upon my experience. CMS's communication was very poor. The didn't ask things, like where do you want electrical outlets. Often they did not follow-up on issues that needed addressed during their grace period where they stated that the would address issues. When I first moved in, the supervisor of my property told me not to look too hard foe problems with the house, which were many. For instance, most of the doors did not close properly (still don't), paint left on the floor in many places throughout the home, even though this was mentioned several times to the supervisor. The flanges on the shower arm was never attached, in spite of the fact that the CMS supervisor was told, and this problem can be easily seen, as they never were attached. Before I moved in there was a obvious 2-3 foot crack in the driveway concrete that only got bigger. The CMS staff, that concrete wasn't a covered issue, in spite of the fact that the crack was there before I closed. An enormous amount of construction waste was left in the yard for me to clean up including disposable, plastic empty drink containers, construction stones, bricks, pieces of siding, metal bands, 2x4s, etc. There were numerous screw pops (too many to count) when I moved in. I had to pay $380 to have my cooling/heating ducts cleaned because the construction debris had been swept into them which caused the need for frequent dusting. The supervisor who was supposed to oversee my construction argued with me and ignored me on several occasions, when I bought issues up that I felt needed to be addressed.

    CMS Homes completed a pre-closing walk-through with the customer prior to closing. At that walk, any defects found were identified and either addressed that day or following closing. The customer received at closing a years **** ***************** Warranty. The warranty document describes in detail the scope of the warranty. The warranty closely follows and is consistent with the ************************** of ******************* ******** Industry Standards Manual. A copy of the new home warranty is available for view on our website and a copy is available for customers to receive digitally or in hard copy. Included in the warranty is 1 year material and workmanship, 2 years delivery systems and 10 year structural. Our records show that during the first year this customer submitted 8 items at 60 days after closing, 8 times at 10 months after closing and 1 emergency request. Our records indicate that subcontractors were notified of the warranty items and that they were subsequently completed. We do acknowledge that certain request were made by this customer that were outside the scope of the warranty. Even though a few were addressed as a good will gesture we came to the conclusion that we needed to cease any action on items that were outside the scope of the warranty in order to insure that our good will was not abused.
