      Placed a $3,100 down payment on a metal building. When permits were approved the company raised the price 38%. when I balked at price and asked for deposit back they refused. Sent registered letter but it was not accepted.Need advice on what to do.

      In August 2021 we wrote a check for a deposit of $2873 approximately to this company for a barn and a carport. Several times he said he was coming to bring the barn and carport materials. He never showed. We got a call from him or texted us and said that there was going to be a price increase. I went to see him. He said with the money that we gave him we could either get a smaller barn or we would have to sign another contract and give him more money. I asked for our money back and he said he wouldn&#**;t do that. He had no control over the price of the materials.

      I placed an order from M & P Nursery on October 1st of 2021, this was for a 24'x80' carport garage and installed. I put $5,000 down for my deposit, it was suppose to arrive in 4-6 weeks. It has now been over 5 months and i still do not have this garage, he has gave me multiple dates of when it was suppose to be delivered but it never shows up. I call him asking when it will arrive and why it didn't show up, he calls me back anywhere from 1 or 2 days later or 1 to 2 weeks later and gives me excuses and then a new date that never happens. I would just like my refund which i have a receipt of back. i have talked to other and found out there is 10 to 12 other people he has done this to and they have never gotten there deposits back.

      I felt this complaint has been resolved.  I spoke with the customer a week ago and told him that I would issue a refund and they can come in and pick out something else that equates to the value of the refund.  He was going to come and look at the inventory.  He has not shown yet, but the invite still stands.

      I am rejecting this response because: I have been in contact with the business and he has told me he will not refund me my money, I have put $5,000.00 down for a building I never received. After talking with him a couple of times over the phone he has made it very clear he will not refund me my money. He did say I can have in store credit which I do not want. I did ask for him to send pictures of what sheds he had in stock just to look at and see if I could make one work. Of course the sheds he sent me were more expensive then the $5,000.00 so that I have to pay him more money. He only had two in stock or I can order something from him, I do not want to order anything from him as the last time I placed an order from him it got me into this situation. I would just like my money back.

      The company I am complaining about has stated he thought this was worked through and we had came to an agreement on an exchange for my refund. That is a lie and I think this needs to stay open and looked into farther, I am not trying to drag this out any farther then it needs to go but I want my $5,000.00 back or an exchange of a portable building that he has in stock.

                      I went down to his place of business on April 23rd thinking he would actually do the paperwork of the exchange like you stated on BBB for an in stock building. He would not write the paperwork up stating I would take (the build I picked out) in exchange for the $5,000.00 he owes me. He kept coming up with excuses saying that is not legal and his attorney would have to look into that and that the attorney would contact me on April 26th, (which did not happen), he also said he didn’t know the tax for the new building I was interested in taking on exchange so it would take a few days to get with the company, as well as I count him other lie’s the more he talked. I asked when the attorney sends me this legal document, it will have their letter head stating there name, number and address correct? He answered back with probably not, so I have no way of contacting this attorney that is suppose to be legit.

      I am rejecting this response because: I have never seen this attachment I added to this email. He sent it to me as well as the attachment he uploaded to his last email here on BBB. He sent me both those attachments personally, I think it is weird that he didn't even upload it to you as well. I don't agree with only getting half my deposit back as well as paying what he wants up front with an additional driving fee added. I have already paid $5,000.00 that I'm trying to fight for back as he never delivered what I put the money down for. I do not want to give him an additional $3,668.36 in advance and never receive this building as well.

      We met with *** ******** and wrote a 20% deposit check for $1725 March 2021 for a garage that would be installed by his company. We signed the contract showing the “balance due” amount. He penciled us in the 1st week of July 2021. We suggested a site visit due to the terrain. He agreed to visit when we got closer to the install date. We made a couple of changes & agreed to a revised contract on 5/30/21 that showed a "balance due" amount of $6389.74 payable upon completion per the contract. After several attempts as early as June 2nd, we agreed on a site visit on July 25th. *** informed me of a $3000 price increase. I told *** I was under the understanding the deposit locked us in to the price on the contract. He said that our money was put in escrow to purchase materials but also indicated he hadn't purchased the materials. He also said due to Covid and the price increase of steel lead to the $3000 increase. 7/26/21 my wife & I decided that we weren't going to proceed as the increase was unacceptable and asked for a full refund. Acting in good faith, I was willing to forfeit part of our deposit for his time and site visit. I attempted to agree on a lesser refund amount of $1525 and again $1300. He ignored my emails and only returned 1/2 of our deposit in the amount of $862.50. 10/1/21 I emailed *** “Since you decided to only refund 1/2 of my deposit does that mean I have store credit for the other half? You didn't buy my material so what did you use that money for?” 10/7/21 Jim’s response “The 1st 10% is non refundable, over the 1st 10% thru 50% is a store credit. I issued you a cash (check) refund for the >10%, so were done...even on this matter. I would be willing to consider the non-refundable 10% to be wholly or partly towards a similar type bldg purchase in the future.” Nowhere was this information provided prior, during or after signing the contract until this email. I would like *** ******** to refund the remaining $862.50.

      Ordered building from M&P Nursery 3/15/21 for 20,462.18 made deposit of 4,093.00 to be installed in 6-8 weeks. Later requested to have additional pricing for walls and garage door, never received updated pricing or date of installation. 1st week of June received a phone call stating they were ready to install building that week (3 days notice). Was going on vacation so was unable to have site prepared and never received additional pricing for items to be installed on building which was not a big deal just lost of additional sale. Seller stated he would reschedule for the next week. Upon return tried to contact seller left several messages, texts etc to confirm date of installation with no response. Finally spoke to seller and was informed that they are no longer making material for my building. Requested return of deposit and was informed that the deposit would not be returned. After several attempts to have deposit refunded now material is again available but that the cost of my building has increased by 40% and will be another 6 months out. At this point I would just like a refund of my deposit, was willing to pay in full for an installed building at the price agreed upon, but this has not happened almost a year later.

      We ordered a prefab shed/carport garage that was delivered and preassembled prior to arrival. At arrival, doors were cut to wrong size and walls were crooked. Tried to contact the company multiple times since 9/4/21 less than a month after the delivery and was told it would be resolved within 2 weeks. Company has since neglected to follow through on promises to correct issue and is saying that we are responsible for not being able to measure their work. Company also has not provided a date for the resolution and states it’ll happen when it’s convenient for their schedule. We offered to take a partial reimbursement since this is such a hard fix to get them to follow through on and have been denied this option as of today. Part of the walls being crooked is that now, our new concrete also has to be redrilled. Make sure you measure their work. The phone number we have been texting matches his business contact. We don’t build sheds for a living. We bought a prefab for this reason.
