On February 16, 2022, I paid Michael W. Crosby $15,000 to represent "Mr. **** * ****** with respect to a Post Conviction Relief, INCLUDING BUT NOT LIMITED TO action for an invalid sentence. If we are successful, you agree to follow it up by helping with his parole considerations. You guarantee to work diligently toward this goal for $15K, which covers your services up to the point of a retrial--which will, we hope, be unnecessary." In return, Mr. Crosby filed a single motion in April 2022, then failed to follow up on it--as required by the court and as he promised to do--missed deadlines and stopped responding to phone calls, email messages, and texts. We terminated Crosby's representation of Mr. ****** in December 2022, because Crosby had effectively ceased to represent ****** anyway. Mr. Crosby did not fulfill his duties as laid out in our agreement. Nor did he follow Mississippi's Rules of Professional Conduct for Attorneys (*************************************************************************************). Crosby did not pursue the legal matter entrusted to him. Nor did he keep either of us "reasonably informed about the status of a matter" or "comply with reasonable requests for information." Charging $15K for the filing of a single motion is certainly not reasonable--neither did I agree to it. In addition, Mr. Crosby did not perform the actions necessary to make that motion effective. I am asking for my entire $15K to be refunded. I have attached our letters terminating Mr. Crosby and requesting a refund from him; both were mailed to him by certified mail and sent by email. Crosby has not responded to any of my many attempts to contact him.
