      3 days after contract was signed and accepted we caught ********* removing 8 dump truck loads of dirt from our lot and hauling off to another job site. By removing all this soil our back lot was lower that both adjoining lots. causing all rain to flow into our "bucket"Our contract specified, and was signed off and accepted by *********, many specific items. The following of which ********* intentionally choose to ignore:Contract Specified brand and size of HVAC systems. ********* installed 2 hvac systems which were incorrect. Finally on 3rd attempt he installed what was specified in the contract. I was forced to pay two outside, respectable HVAC companies to inspect and document the discrepancies and installation errors in all 3 HVAC systems. Working from the vendor list he supplied, we had all our items picked and and paid for within 2 months from contract signing.After construction began, we realized, he was not following our blueprints but instead was building based on an 11"x17" sketch which was incorrect. When confronted, he stated he had to "find" our blueprints. therefore, several framing issues had to be redone.The lot was/is nothing but gravel. not top soil. *********** contract stated full sodding with *******. Instead, rolls of white nylon were laid, with no grass or topsoil to grow. Sod he provided was very early in the year and consisted mostly of just plastic mesh. There was no grass or topsoil, just white nylon mess laid over gravel yard. ********* refused to correct the lack of grass and sod issue causing excessive water erosion, especially on rear lot/hill. So far we've had to pay $15,659 to a 3rd party to re-slope and sod 1/2 of rear lot because lot was not sloped away from house and rain was washing over foundation.After 2 years waiting for construction completion he finally gave use a completion date and we sold our previous home. As it became obvious he would not meet his promise I offered to pay another contractor out of poc

      Response from Paramount Construction regarding false and inaccurate statements made by this complainant
      1. The build was during the Covid epidemic.

      2. Contract was signed 3/30/2020

      3. Closing was completed on home build 3/8/2021

      4. Homeowner refused to meet with the builder many times due to Covid concerns during the build when builder asked for them to meet. Their response was always we will go and look etc and get back with you.

      5. Homeowner had hundreds of opportunities during the clearing, grading and building to voice concerns etc over the property prior to closing and ultimately didn't have to close on the home at all if they were so displeased with the work.

      6. Builder owned property and home up until closing took place in March of 2021. 

      7. We gave them a list of vendors we recommended for products, appliances, flooring, cabinets, counter tops etc... We also told them they could use whomever they wanted they didn't have to use our suppliers because that was nothing that was required. We have always let folks choose who they want to use for all of these selections. They always dealt directly with all suppliers they chose for the work or supplies.

      8. Regarding sod, we laid Tifway 419 Bermuda rolls. The grass was high quality as we own the sod farm from where the sod came from and we sell to the public and contractors every year. We grow and provide quality grass. The rolls are wrapped in a netting to hold the rolls together. when they are ready to be put down the netting is cut and the roller lays the sod with the netting laid underside the yard. The yard had plenty of dirt and was leveled and graded professionally. their back yard is huge and there is still a slope. There was even a higher slope before we cut it down to level out the back as much as we could. The complainant was told how to care for the fresh sod that was laid. It was going to require ALOT of watering and fertilizer every few months in the beginning to ensure healthy growth. Again, the homeowner at anytime could have not accepted the property or the house if they were that displease with the build and the property. I have attached 2 pictures that show dirt work and when they began sodding the yard.

      9. Keep in mind that all the required permits and inspections were done and passed throughout the entire build up through completion to final inspection needed for closing.

      10. His allegations are false regarding nothing but gravel, there was dirt and plenty of it and there was quality Tifway 419 Bermuda laid on the entire property. There was at no time in the contract that they were requiring top soil to be laid on top of the dirt foundation. Matter of fact that is nothing we have ever done on a build when installing sod.

      11. We at no time every agreed or approved for them to pay a third party to do additional yard work on their property after close. Complainants wife reached out to me via email and advised me that they had reached out to a third party landscaper and sent us a quote for the more dirt work and sod to be laid in their back yard to their liking. I specifically advised his wife that we would not and did not authorize for said work to be completed and that we would not be paying any such bill. They proceeded and spent ALOT of money to have more work done to their liking AFTER closing on their home.

      12. The wife did reach out regarding fence polls on one side of their yard which had become loose because another builder who was building on the right hand side of their property didn't put down proper silt fencing and caused the ground to wash out. NOTE:  this was of no fault of ours. However, we agreed to have some of our workers to go out and reset the fence post for them at NO COST to them. We ate the cost on that in materials and labor. Also, we replaced sod in the front yard out by the road because it was washing out again to no fault of ours it was the builder next door to them that wasn't putting down proper sit fence to prevent washout, because mind you the road **** had already completed final inspection on the property and passed the property for closing. 

      13. Their property was sodded from back end of lot all the way to the front yard that meets the road. Again the road **** has to come out and view the property and advise if more work is to be done to pass or they find that everything is good and the property passes final inspection which it did do. 

      14. Regarding ** use prior to move in. There were delays again mind you all this was during the height of COVID and there were delays with every aspect of home building. We advised the future homeowner that they could go ahead and move into the home prior to closing because they had sold their home. We advised them we could get the remaining things done after they moved into the home. We were waiting on barn doors which had been on order several times for over 5 months. When the barn doors did arrive one of the doors was cracked in half and damaged which was no fault of ours as it was damaged during shipping and we had to return and order a replacement. He chose not to move in yet they started moving things in a few days later into the home even when they had the ** parked in the driveway. Again, COVID delays. 

      15. We bent over backwards to be accommodate the complainant which was impossible. He became belligerent with the builder and refused to speak or work with him again regarding any matter concerning his home. I then became the main point of contact for him and his wife. His wife and myself worked very well together and communicated very professionally and kind to each other. 

      16. Over the course of the past year and some months I worked diligently with the wife, coordinating property visits and repairs around them being out of town and doctors appts etc.

      17. Regarding the ** information .. proper units were installed, part of the ac parts was under another name however, it was a the same manufacturer for the part again due to covid. The sub that did the ** work did forget to connect a line and there was a leak. Once we were notified of the issue it was fixed and repairs were done on the leak in the bedroom ceiling.

      18. Issue with screened in porch they contacted me in MAY of this year to advise their was a leak in the roof where the screened in porch and the house connected. Complainant stated there was no flashing on the roof. Yet, there was flashing because once again it would have never passed inspection. We sent our ops mgr over to check out the issue and he found there was a leak however, there was flashing. While he was there he called the roofer sub we have used and he came over to review the area. He also stated there was flashing on the roof, however, homeowner wasn't satisfied with the flashing that was there and wanted more and a different kind. I was advised that the roofer and homeowner were going to be working directly with each other to get the roof fixed and we would pay for the repairs to try and please the homeowner even after the fact that the 1 year home warranty had expired in March 2022. I followed up with the message to the wife stating that I understood that they would be working directly with the roofer and once the roof was completed for them to let me know and I would contact the painter sub to set up date and time for them to come and repair the paint and treat the area that had leaked on the back porch. She said she would. I then get a message from them abt 2 weeks later advising they have heard nothing from the roofer and would I contact him. I did and he said that the special flashing that complainant had requested wasn't in stock and was on back order and he was waiting on it to come in. Mind you complainant never took the roofers information or number to follow up with him regarding the matter. Once the roof was repaired which i believe it was 2 days later I contacted the painter to set up date and time after I received available times and dates from the complainant. The day the painter was scheduled to come they were late showing up and the complainant got made because he said we made him miss a doctors appt. Which when we set scheduled the day they approved there were no issues. They ended up coming later and stayed and finished the repairs. Sub called me after they finished and I sent wife a text and asked her if they were satisfied with the work that was completed and she said that she would have to wait until after the paint dried and she would let me know the next day and I never heard back from her and that was on June 14, 2022. We paid for everything even though we didn't feel that we were responsible.

      19. We worked through all this with delays, shortages of materials, sub contractors and ALWAYS worked everything around the complainants schedule. We were NEVER allowed to be on their property or in their home if no one was there. Every visit had to be preplanned and scheduled. Which we did our very best to meet all scheduled times. We were at the mercy of sub contractors schedules and availability, on companies and vendors waiting on materials and COVID issues. 
      In closing, we have completed several repairs over the past year and coordinated with sub contractors that had done work for them in their home. Wife was always very nice and complainant was NOT. He was always very belligerent and rude to whomever was sent over to the home. Some of our employees that went over to do certain things were always talked down to and he was ALWAYS putting down our owner and the company because they would communicate the information back to us. He also accused us of sending help over that couldn't speak English and that had no idea why they were even there which is all FALSE. We do indeed have Spanish speaking employees however, if we ever sent over anyone from our office we had a lead that spoke fluent English and supervised and communicated to the help as to what needed to be done and were able to fully communicate with the complainant. We never went to their home not knowing what we were going for nor not having prearranged the visit. 

      We went above and beyond to try and please the complainant through the entire build and after. We are not going to reimburse them for a landscaper that they hired to do additional work to their property months after they closed because I advised them we wouldn't at the time the wife presented the information to us. We are not going to re-sod their yard or do any other work for them or their property. We are not going to reimburse them for a ** living when they were offered to move into their home. Complainant chose to move an ** onto the property and NEVER once mentioned at anytime before this complaint they wanted reimbursement. 
      Every new build will have some issues and they are always resolved. This person was never pleased with anything from beginning until now. The builder has been in this town his entire life and has built hundreds of homes over the years. He is a reputable person in the community. COVID was the main factor for the delays with the home build. We were not the only builder that was experiencing these delays. Bottom-line the build was good quality and the subs we used are good quality people. We worked very hard to try and please the complainant and addressed all concerns that were brought to our attention. We fixed some and others we felt we met our responsibility in the matter.
      I was happy to work with complainants wife through out all this as she and I were very cordial and worked well together. There is really nothing else to say regarding the complainant. He became very irate and belligerent and refused to work any further with the builder. Therefore, I became the point of contact between the complainant and my boss regarding their property.
      I have included a couple of pics that one of our people took when they had finished the dirt work in the back and as they were laying the sod rolls. The rolls cover 360' sq ft per roll.

      I am rejecting this response because:
      Their response is untrue.  I stand by everything I stated in my original complaint.  One time they showed up unannounced and I could not let them in because we were leaving. All other times we were held hostage to whenever they felt like showing up, mostly unannounced, and as I stated they always asked US why they were there. Most subs claimed they couldn't speak English therefore very difficult for me to tell them what to do. The Sod was laid in February, way too early for it to be mature enough to be harvested it was nothing but nylon mesh, as shown in pics. After trying to communicate with Paramount the first few months and being lied to repeatedly, I had to create a paper trail. I have copies of all texts and emails documenting everything he is disputing.  Once again I'm not going to take the time to dispute every one of Paramount's responses but overall they're all untrue. Everything references back to my original complaint which is the true sequence of events.   This complaint is already on the docket with the ***************************** for resolution. As stated in my original complaint the resolution I seek is: Reimbursement for re-sloping and sod work performed by third party because Paramount refused to correct (have copies of refusal).  Re-sloping & installation of mature, quality sod throughout entire lot (excluding area already repaired by Blythe).   Since we were repeatedly lied to by Paramount, I'm also forced to request a third party, chosen by me, to review, approve, monitor,  and final acceptance of any of these issues Paramount attempts to repair themselves.
