On January 25, 2022 and February 8, 2022, I entered into a business transaction with ******* Bennett, owner, Bennett Landscaping LLC, *** ******** ****, Madison, MS 39110 to install arborvitae trees and Japanese yews, respectively. I paid him $7,700 with all services included to install 52 arborvitae trees ($70 each) and $7,070 with all services included to install 69 Japanese yews ($30 each). Bennett Landscaping LLC was hired to complete a landscaping job started with Leyland Cypress trees. ******* Bennett recommended he replace the leyland cypress with arborvitaes. I wanted loropetalums for my fence line; he recommended the Japanese yews. He presented me with a written warranty guarantee that stated if any trees become diseased or end up dying he will come out upon request to treat the trees. I have been calling, leaving messages, texting, and sending pictures for months since March 12 of browning and dying trees. He has not offered advice on the care and maintenance of trees he recommended and installed. He answered my call maybe twice. Once, he said he was coming out to assess the damage but was a no-show. The next time he said he would contact his supplier. Since he never came to inspect the trees, I concluded he was not going to contact the supplier because he had not assessed the damage and confirmed anything. I followed up and called the business he said was supplying the Japanese yews when we discussed the purchase. They had not spoken to anyone about this situation. ******* Bennett has failed to meet his contractual obligations and I am suffering an economic loss as a result of his breach of contract which is relatively straightforward. It is costing me money every time a tree dies. Currently, there are 11 diseased/dying arborvitaes and 10 dead/dying Japanese yews. ******* Bennett must honor the contract and treat, replace, or refund for the diseased and dying trees. If he treats the trees and they are revived, they will not need to be replaced.
