      My husband bought me a massage for Mother's Day and I made an online reservation two weeks ago for a massage and a body scrub. In the online reservation I had to give my CC number in order to reserve my spot. In the "message" section of my appointment I let the owner know that I would be paying with a gift certificate.I arrived at my massage on Friday, December 15th at 3:40. The massage therapist was was friendly and quickly got me on the table. Within 2 minutes of my massage she tried to sell me back my gift certificate and keep the $165 that had already been charged to my account. I kindly told her I would talk about this after my massage.Close to 4:40 (my massage was an hr.) she proceeds to tell me she doesn't want me to be alarmed by the charge on my card and that in fact she will charge me. I can't even put into words her rationale! I wish I could, I think it would help me. She abruptly left me on the massage table stating that the massage was over, it was an hr. I was stupefied--got dressed, went to the lobby and was trying to figure out a way to record her nonsensical business practices. I told her that I didn't mean to offend and that her crooked business ways have and bad reputation have preceded her and that I was savvy enough to take screen shots of my online reservation, make copies of my gift certificate, as well as the charge on my husband's card in May for the gift certificate. (In all actuality, I made no copies BUT I should have!! I read her Yelp and ****** Reviews but knew she didn't give refunds, plus I was hoping for a pleasant experience. As I said this, she came from out of the back room telling me I was being unpleasant and she called the cops--all within a minute. She has them on speed dial, clearly. I was speechless! I left the establishment determined to stop this thief.When I got home I received a call from ****** with HPD telling me I had been served a no-trespass statement from her.

      I feel like I need to address the following:

       

      1.  MANY MANY MANY complaints have been filed on YELP and on GOOGLE.  

      2.  I wonder if this woman even has a valid license to practice **********************.  I'm a teacher and I know that I have certain duties to fulfil and behavior to have if I wish to NOT have my license revoked.  I"m wondering if there is a board of decision makers that are aware of this woman.

      3.  ****** at ****************************** served me a "No-Tresspass" from Ocean Spirit Massage.  Are customers allowed due-process, or does whatever the proprietor say count automatically without equal justice?

      4.  And finally, do any officials read reviews for a character profile if/when investigating?

      Enclosed is when ****** booked, when she received her confirmation in which she received a notification of a 24 hour cancellation policy in which she did not adhere to.  *** scheduled a two hour claiming she received a two hour gift certificate when very clearly it was for an hour of deep tissue or body scrub in which she scheduled both claiming to use her gift certificate after already paying on line for a two hour not for her hour gift certificate in which she showed me when she arrived still expecting the two hour for a one hour gift card also enclosed.  When mentioning she only had an hour gift certificate ****** became disgruntled demanding I give her a free two hour as she refused to leave her gift certificate which she was charged for her hour session and her hour she canceled within 24 hours while receiving her two hour massage.  
      ******************* is more than welcome to gift her gift certificate she refused to pay with to someone else but ******************* has been trespassed as the police were called from her disgruntled nature screaming threats while making false accusations on myself and business because she refused to pay or leave for the service she ordered or use her gift certificate in an attempt to steal from the business and claimed some reputation as her excuse to attempt to receive free services.  *** was impossible to serve or make happy as we tried to refund her but she refused to leave her gift card which left no choice but to follow normal guidelines for all clients and apply the 24 hour cancellation policy.

      Also enclosed is *** intake form where all sales are final is clearly labeled along with 24 hour notice to cancel or the entire session would be charged.

      To show the character of *** you can see how she fraudulently makes accusations and claims in order to get free money or service from businesses as to why she was trespassed from Ocean Spirit Massage by the owner.

      $165 + $85 = $250 not $300 as claimed.

      ************************* claimed that she knew what her husband had bought and that I should give her a free two hour.  No ***** is claiming her $50 on top of giving her free service with no gift certificate for her payment,

      Thank you for allowing me a rebuttal so I can defend myself in this mess. 

      Yes, I booked two services. My gift certificate, as you can see, says two services on the back, as pictured in the attachment.  I also sent the owner a message stating that I was paying with a gift certificate, and Id like to see the archived message stating this if you have it.  As stated before, the owner offered to re-sell me my gift certificate and she keep the $165 charge on my credit card.  I was not okay with this and let her know that I didnt want this. Nothing more, nothing less. 

      I feel the $300 financial loss was accurate since I was technically charged twice for the same service. Once on my card ($165) and the money my husband spent on the gift certificate ($102).  I am not trying to make any sort of fraudulent claims, I was combining the two purchases that were made and at the time I wasnt sure what my husband spent on the gift certificate, so you can see the total cost was $367 The proprietor did in fact receive money from my husband AND from me for the same service. 

      In making the online reservation, I chose the options from the pulldown menu that were also listed on the back of the gift certificatesee attachment.   These services were evidently different from what my husband purchased, how was the consumer to know this?  Please note there is no dollar amount listed on my gift certificate.  Not once was any of the difference in services/prices communicated to me, not once! 

      I have stopped payment with my bank for the $165 purchase and showed them that I was charged twice for the same service.  My husband and I can deal with the financial loss of this mishap, but what is infuriating and ethically wrong is the fact that she can do this with no repercussions to her business or her license.  I am not done on this end.  I will take every avenue available to let the public know how corrupt she is.  Its surprising her business is still operating and its evident to me that she needs the money more than we do.  Keep it.

      I find your accusations of my character false and slanderous to a disgusting level.  Its frustrating to me that the police took your statements as fact without talking with me about itthats an entirely different issue and I am working with authorities to rectify that.  I can confidently say that I was neither unruly nor threatening in any way.  Your remarks here and to the police are wrong, and the most unjust part is that it cant be proved in my favor.  You can say anything, so can I, yet nothing will be proven.  Butin the end I can rest peacefully knowing that Im doing right. Im using the resources available to me as a consumer to fix this, if possible, and more importantly I know Im not lying, embellishing, or using slander for my benefit--you are--and that cant be easy for you.  This will pass and will be forgotten by us,but it will weigh on your conscience, Im sure. Even your typed messages seem angry, accusatory, false and unsubstantiated. 

      I have tried to gift my certificate to people, but no one wants to be around your establishment after the way to treat customers.  Literally no one.
