Real Property Management Headwaters (RPMH), is our landlord/apartment manager. When we were originally signing the lease, we explicitly asked if they knew about anyone who smoked nearby, mainly the other tenant that we share a wall with. They stated that there was no smoking allowed in their rentals. Even states so in our lease agreement. After signing the lease, we moved in a few days later. To our surprise, the neighbor we share a wall with smokes marijuana. The rental we live in on ******** has the inlet for the forced air system right next to the other tenants front door. When they smoke, it ***** it in and blows it through all the house on our side. We informally asked them to smoke somewhere else on the property, as it was affecting us greatly. They agreed to smoke on the other end of the property. The problem continued. The smell of marijuana is almost a constant odor during all times of the day and night. It has started to soak into our furniture, our clothing, our carpet, our food, etc. When talking to RPMH about this is***, they changed out the forced air system filter, hoping to help lessen the effect. It did not. When we expressed our concerns for not just our health, but our rights as a tenant to quiet enjoyment and the increased nuisance of a constant stench, they told us to get used to it or move, in a round about way of course. They are refusing to do anything further. We then told them that we will begin looking for another place to live. They told us they would charge us to the end of our contract or until they rented the space to someone else, whichever came first, since we were contractually bound by the lease. We told them that if they tried to charge us for a single day past the day we left, we would *** them in small claims court. They have not responded to us since then. Smoking is not allowed in the rental property at *********** either unit. The air intake for the furnace is for combustion air and is a closed system. It is not the same air that is circulated through the apartment. The air that is in the apartment is the air that gets filtered, heated and recirculated through-out the apartment.
When ******, the tenant initially reported the concern regarding the smell of cigarette smoke, I met with the neighboring tenant and asked him to smoke away from the property so that it would not affect the neighbors. He agreed to do so.
I have been in Kaidens apartment three (3) times since he moved in. The first time was when he initially raised the concern. The second time was to install a new dishwasher. The third time was to change the furnace filters. On all three occasions, I could not detect the smell of cigarettes or marijuana in the apartment.
I have done an inspection in the neighboring apartment and found no evidence of any type of smoking in the apartment.
Our communication with ****** and his wife has been that there is nothing illegal or any lease violation being perpetrated by the neighboring tenant. He has agreed to smoke behind the property away from the unit.
Regarding the early termination of their lease, our lease follows Montana Law. ****** requested to meet with me to discuss his lease and what options they have. I agreed to meet with him and had a meeting scheduled but he canceled and never rescheduled.
****** has stated that they plan to move, which they have the right to do if that is what they choose. I have not received a notice from him informing me that they are actually moving so there has been no need for a response.
