      oct. of 2022 trenchless solutions repaired the water line from the curb stop to the city main after digging the hole they talked the neighbor into replacing theirs to prep for the work i needed to peel back a 8' section of my fence they left on a saturday having patched the road yet leaving a 24' long 2.5' deep ditch from the street into my yard the fence still open with a couple pieces of caution tape across the following tues. oct. 11th they billed me for the entirety of the work on that very billing statement it says they will "backfill and compact excavations" i emailed back there was still a hole in my yard and they said it was on the list and they'd get to it one month later they bill me again still a ditch in the yard fence still open caution tape torn blowing in the wind some dogs got into the yard tore up a water feature dug up some landscaping when i reminded them the job was incomplete i was told "snow has been a hindrance" for three weeks after they drove away there was no snow i was billed again in jan. feb. after reminding them they still were not done on march 17th they said they would be out weather permitting 2 months later on may 17th i let them know i was charging them for time and material to finish the work and would deduct it from their bill their response was to send another bill with a late fee for 7 months they have been absent and they want a late fee the asphalt patch oozed into the hole they did not fill so the road has a significant dip as well as a good foot drop at the edge of the pavement all these communications were email including in november when i informed them if i had to fill the hole myself i would charge them for it i do not know how to deal with a company that has made zero effort finish and thinks the answer is to send another bill i do not know what options are available to me and am thankful for any assistance thanks ****

      Good Day,

      As is often the case with us coming out of Winter and moving in to the Spring months, we tend to be very busy.  As a company our core focus is replacing or rehabbing underground infrastructure.  Historically we prioritize fixing the broken underground lines of your neighbors and community members above topside cleanup.  As a result we do a lot of emergency work and often it takes time to schedule one of our team members to mobilize back onsite.  Our preference would be to not perform Winter work due to its challenges, but this is not what we choose to do.   It is very challenging to get subcontractors onsite for cleanup items.  For example, we have several concrete and asphalt patches across town that are nearly a year in the waiting.  This is an unfortunate reality of the current business climate.  A bill was sent out in October of 2022 for the work that was performed.  ********** on invoicing are part of a computerized system that does follow *** on outstanding invoices with remaining balances.  Any payment for services already completed would be beneficial.  We will be importing topsoil to dress to the excavation area.  This was not a line item on the bill, but we will perform this service (may have already had a team member onsite yesterday to start the process).  I feel confident that we will come to a resolution with the topside items of concern.  Thank you.

      I am rejecting this response because:seems pretty basic , dig a hole , fix pipe , fill hole , there's equipment and man power on sight , just push the dirt back in , where did all that dirt go . as to their response , they first told me "its on the topsoil list. when my crews get some time they will git it done." no mention of subcontractors or scary winter. one month later , after no contact just a new bill , i told them if i have to fill in the hole i charge $1000 an hour and i can start right away , the response was "we will get it done. snow has been a hindrance." for the first three week it had not snowed .they say " this is not a line item on the bill " all of my bills list 10 numbered lines ,  #7 , " 7) backfill and compact excavations " that's line #7 , it appears they may have only come by on may 22 after receiving a complaint from b.b.b. , trenchless solutions could have at least told me to button up my fence its gonna be a while or oops forgot be there next week , zero communications only bills w/late fees now

      I am rejecting this response because:yes trenchless solutions came out to address their own asphalt work , but that was not a concern of mine it was a observation , my concern was and still is that trenchless solutions led me to believe they would be out to complete the job , on two occasions over two months they stated they would get it done , three months after they abandoned the work site after as i said earlier , caution tape flapping in the wind , then when dogs got in the yard and dug up a couple small trees and damaged my water feature thats when i decided i needed to finish the job myself , that was a month after i informed them of my intentions , i did it with a wheelbarrow and a shovel , in the snow , my concern is that trenchless solutions continued to bill me for incomplete work , i have time , material , and property loss and trenchless solutions has yet to acknowledge any of that

      This jobs is complete.  The invoice is currently over 8 months past
      due.  There has been no payment for work performed and finalized. 
      Topsoil was completed and was not included as part of the original scope
      of work.  It is challenging for us to issue a refund on work that we did not invoice for.  We performed additional onsite work that we did not charge the client for.  We can waive the late fees to date ($825) for non payment.

      I am rejecting this response because:trenchless solutions statements -10/14/22 "it's on the topsoil list. when my crew gets some time they will get it done." 7/31/23 "topsoil was completed and was not included as part of original scope of work " - which is it - why a topsoil list then - and why was time not originally allotted to complete the task at hand - 11/10/22 "we will get it done. snow has been a hindrance" - it had not snowed until the first week of nov. - 3/17/23 "i'm assuming your not paying due to the excavation work not being completed" 7/31/23 "the invoice is currently over 8 months past due" - how is it past due for "work not being completed" - i'm paraphrasing until i recover an expired BBB correspondence - this was not a billable item - line #7 on bill "backfill and compact excavations" - 3/17/23 "as weather permits we will be out to complete the backfill and excavations" - 5/18/23 received bill - weather had permitted for some time with no attempt by trenchless solutions to "complete the backfill and excavations" - there is no indication trenchless solutions was ever coming back until i filed a complaint on 5/18/23 - i had checkbook in hand in oct. '22' ready to pay on site when they came back and finished - they never did - so i can waive some fees here as well - if trenchless solutions sends me a bill for $5,000 i'll pay it - or if they would like to tell this tale of contradictions and absence - we can do that
