I hired Timothy as General Contractor, to constuct a new dwelling. We singed a contract on 1/24/22. I Made 2 payment totaling $400O to him $2500 and $1500 before the project began (administrative fees). In the first month into the project he was unresponsive to subcontractors and failed to act as the contractor. I had to step in and spend my personal funds in order to get the foundation completed. Which resulted in spending unnecessa money on delivery fees , rentals trucks, gas and wasted time. ******* agreed to construct a dwelling for $150,000. He required a upfront fees and was paid those fees and refuses to complete the work as promised . He falsely represented his ability to construct a new dwelling, by intentionally withholding important information that he could not/ would not fund the project ( purchase materials, pay for permits, surveys ) as required by the bank. Tim Knew that he funds would be necessary inorder to complete the project and knew that the bank only pays for completed work. We both signed a draw schedule that was approved by the bank The bank will allow funds to be deposited to me but Timothy will not agree to do so, although he does not plan on spending his personal funds but expects me to do so and trust they he will promptly returned said funds back to me. He also provided false statements that he would let me purchase the material that had such Vanities, light fixtures, cabinets etc. at 1/3 of the original price for the specific purpose of gaining cash upfront, that I would not have been provided without the deception. I sent a letter to Timothy on 07/29/2022 via certified mail informing him that he is breaching our contract with his failure to perform ( contruct a dwelling) the letter was successfully delivered on Aug 03. I did not receive a response. The contractor has took my and ran as has ghosted me, refuses to complete the job, he does not want sell the materials he has or refund me
