On May 8, the contract was for 16x20 concrete pad, bush hog bamboo area, install 6 spout connectors, 500' of drainage pipes, 2 pop ups, 5 loads of fill dirt, 2.5 load of lawn max, and grading. I have paid $8,892 of the contracted $9,137. I owe $245. As we settled on cost for $745 for attached EST0122. **** has not been back to my place since approx 1st of July. He owes me 2 pop ups that he damaged and covered up during grading that can't be located. He did not use 500' of drainage pipe. He cracked the concrete with his machine and hasn't fixed it. His invoices consist of inconsistent prices. I spoke with him regarding the price of fill dirt. His original charge is $170/load. It never states how much dirt is in a load. I had a changed order to add a load of dirt to the initial invoice. He charged me $265 for that load, and stated that this was $95 more due to hauling of debris. He never hauled debris or anything, as the stuff was pushed to the back of the property line after bush hogging. He charged me $175/load on the last invoice for fill dirt. He has only delivered 3 of the 5 loads of fill dirt. He charged me for 2.5 loads of lawn max at $350/load. He has only delivered 1 load of lawn max. The grading charge on the invoices hasn't been explained as to why I'm being charged 3x. I've reached out to **** ******* many times via phone and text to resolve this issues of financial discrepancy and completion of work. Based upon the charges he's presented me, the project should have been around $6,800, not $9,137. I am seeking for **** to finish the project: fix cracked concrete locate and replace popups 2 loads of fill dirt 1.5 loads of lawn max grading of the yard I am also seeking a $3,000 refund for this project as compensation for the financial discrepancies on the invoice and the inconvenience of this not being resolved in a timely manner. I have printed invoices, pictures, and text messages to support all of the above issues. Thanks Brandon Turner

      Business response

      02/02/2023

When the job was completed, he didnt have the money to pay for the job, and he wanted additional work done.

There was a small repair that we needed to do, and I texted him to see if we could send guys over there, and he didnt respond.

The next time I heard from him was when he filed the complaint with the BBB

I can still have my guy go back to make the small repair; he just needs to contact me.

I dont wish to do any additional work for him at this time.

I am rejecting this response because:

      it isn't accurate.

He has been paid in full for every invoice he has sent me. He hasn't sent his guys to finish the job. He hasn't sent his crew to repair the crack. I don't need to respond to his text, I need him to send his guys to fix the crack. And it looks bad to have a $3500 patio with a crack that he caused. That's going to look bad forever unless I find a way to cover it up. I've called him multiple times since the text message and he hasn't responded. He knows he's not done the job correctly, and has avoided me. I sent certified mail to his business and he didn't sign for it. At this point, it's become a small claims matter in court and that's my next steps to getting money back so I can have the job done correctly. I don't want to do business with him anymore, so I'm willing to let a judge determine the outcome.

Grading to my property at ***** **** ****** **** contracted with **** ******* of Earth Movers Grading & Hauling, LLC was not completed correctly and would not pass Mecklenburg County Code Enforcement inspection. After several attempts to meet **** ******* of Earth Movers Grading & Hauling, LLC to go over what needed to be corrected and several attempts by **** ******* of Earth Movers Grading & Hauling, LLC to correct the grading, **** ******* himself said in a text to me that he was not happy with his own grading job. I was forced to hire another grading company to correct the problems in order to complete construction of the new residence on the property, have all inspections passed and place the house on the market to sell. The issues with **** ******* of Earth Movers Grading & Hauling, LLC held up progress on and the sale of this property for weeks. I have requested he refund $1,100.00 of the $2,200.00 I paid him for the grading job as I had to hire another grading company to correct the problems created by and the problems not corrected by **** ******* of Earth Movers Grading & Hauling, LLC at a cost of $1,800.00. On August 31, 2022 I sent an email, text and left a voice mail requesting that this refund be made and the detailed reasons behind the request which are in an attachment to this BBB complaint. As of this moment, I have received no response in any form, which I requested be sent in an email so I would have it in writing. Please see the attached details of the issues regarding the contracted work. Thank you.
