I was in a car accident in February of last year, my car was totaled, I had a concussion and body injuries, and had treatment for close to a year. I am still suffering with pain and emotional distress from the accident. Michael Demayo's office advised me to stop my treatment which I thought was premature, because I was still dealing with pain and emotional trauma from the accident, they said the insurance company will not pay for any more of my treatments. I hired them because I thought they were a trusted firm and they would fight to get me compensated for my pain and suffering. They did not deliver and I am very disappointed with them. They did not have my best interest. They only presented to me $7000 unbelievable and unacceptable. I declined the settlement, they told me that was the best offer and top offer. I asked to talk to Michael Demayo several times, but they refused to allow me to talk to him, and I refused to sign off on the settlement. Then I was told, if I want to take this case to court, it will build up court and other fees and the attorney fee will be 40% of the settlement amount, that was to discourage me from taking case to court.I would not recommend this law firm to fight for you in a personal injury case. They do not fight for you and do not have your best interest.

I began receiving calls several months ago from people claiming to be "from Camp *******, **************" & using fake telephone numbers. My number is on the national do not call list, I told several of the callers that I don't qualify, and I asked other callers to stop calling me. Despite this, the calls have continued. One such call took place on Nov 17, 2022, came from a spoofed number, a "boop" sound occurred a few seconds after I picked up, then "**** from Camp *******" introduced herself. I decided to track down the law firm that the call would ultimately be sent to in order to see if that might stop the calls, so I played along with her questions. She told me that she needed to transfer me to her representative, but was unable to do so because she said that my number is blacklisted (likely because I am on the do not call list). She needed another number to call, so I gave her one that I knew could be transferred. I was sent to "****" who told me she would transfer me to a law firm for my claim. I asked for the name of the firm and was told that *************************** and Pulaski Law were the firms she represented. I was then transferred and told that I had reached DeMayo Law Offices, which was not one of the firms mentioned. This person asked me some questions and then the line disconnected. I was then immediately called back from another spoofed number and a new person, but that also disconnected. I then had another call from another number and person. They eventually sent me a text message with a Docusign-type link that took me to a contract with DeMayo, which was also emailed to me (and has been emailed to me multiple times since). I reached out to DeMayo with this info, was quickly put in touch with an attorney there named ***** who said he was tasked by the partner to get to the bottom of this. He asked for an email with the numbers that called me, which I provided. He told me he would let me know what he found out, but I haven't heard back after 5 months.

Response to **************** by DeMayo Law Offices, LLP:
We have attempted to communicate with **************** by calling him several times to first understand his complaint, confirm that we have never solicited him or any client, and try to get more information on the false allegations and resolve any miscommunication that he may have with our law firm. We have been unable to reach him notwithstanding our repeated attempts.
**************** indicated that he was initially contacted by our firm about Camp ******* litigation, however the telephone numbers he said as those used to contact him that were provided to us were not associated with our firm or with any vendor or agent we utilize. The numbers, ************ and ************, are not presently in service? Thus, the allegations made in this complaint are false.
**************** indicated in an email to our firm that he utilized false names (***********************, ***************************) to track data and monitor which phone calls were made to him. Neither our law firm nor any of our vendors have any record or any information on **** or ***************************?  Why **************** was using false names is a mystery to us, but we did not have a record of his name or the false names. Moreover, none of our vendors have any record of ****************, including his phone number.
Even though we had never contacted ****************, once we were notified that he did not wish to be contacted, we provided ****************** number to our vendors as someone that should not be called and provided his name (along with pseudonyms **** and ***************************) as individuals who should not be contacted.
We are confident that **************** would only have been contacted by our law firm if he had initially made a telephone call or an online inquiry himself asking to be contacted to discuss making a claim. Our law firm does not contact potential clients by randomly soliciting them.

      Customer response

      05/02/2023

I am rejecting this response because:

They are making claims that are false, for example they are saying they called me several times to try and get in touch when they have only called me once and it was the day that they responded to my complaint on the BBB. I have called them back multiple times without anyone ever answering, and sometimes with someone picking up and hanging up. There is no way that this is a "good faith response." I now have evidence that a call center that they are using was the caller and was under their control. I'd also like to offer a rebuttal to the numbers they mentioned not working and that this somehow proves that I did not get a call. These numbers were "spoofed" exactly so that a complaint like mine can be ignored and deemed to have no merit. This is a very common practice and there is no way that the firm is unaware of it. Their 3rd party intake center sent me a recording of the call that is in question, which I think proves that they are mistaken at best in their claims.

      Kind regards,

      ***

We are limited by Attorney- Client Confidentiality rules in what and how much we can respond to this complaint. The client was certainly presented with a summary of a proposed settlement and given options.  We did NOT sign or agree to accept any settlement on his behalf.  The top offer was presented to him for acceptance or rejection. All offers and settlements require the signature and agreement of the injured party.  When the top offer was initially presented to the client, he was unhappy with the offer and was given several options. We did not recommend litigation because in our opinion he would come out worse, however we gave him the option of seeking the assistance of new counsel.

We allowed him additional time to make a reasoned decision and when he was still unwilling or unable to decide, we notified him that we would be withdrawing as his legal representatives in the matter which would allow him to pursue the matter further with another attorney or independently and would not charge him a fee. It was at that time, he contacted us and decided he wanted to move forward and settle his case.

The attorney personally met with the client again, went through the settlement once again in detail, explaining how the funds would be disbursed.  He was provided with a written summary which he signed. We checked to see if any of the providers had been reimbursed by **************** and disbursed immediately upon confirmation that his health insurance was not utilized.  The client had full disclosure of all matters, reviewed the offer for approximately 3 weeks before deciding independently to accept, and spoke with his settlement attorney on 8 separate occasion to provide him with information regarding the settlement and answer all questions. There is no merit to this complaint.
